Weiss Moved by Councillor Eckert that Councillor Daniels be excused from this meeting. Carried. 2. Minutes 1. Council Minutes -March 11.2004 Minutes of the March 11, 2004 meeting were presented. Moved by Councillor Fabian that we adopt the minutes as amended. Carried. 2. Public Hearine Minutes -March 11, 2004 Minutes of the March 1 1, 2004 Public Hearing were presented. Moved by Councillor Moss that we adopt the minutes as presented. Carried. 3. Call for Post Agenda Items The Reeve called for post agenda items. March 25, 2004 Council Page 66 4. Adoption of A e~ nda Moved by Councillor Loewen that we adopt the agenda as amended. Carried. Business From Minutes 1. Brooks Museum This item was not lifted from the table. 2. Doi Control Bylaw 1454-04 Moved by Councillor Vermeeren that the following motion be lifted from the table: Moved by Councillor Vermeeren that Bylaw 1454-04 receive second reading. Carried. Moved by Councillor Loewen that Bylaw 1454-04 be amended by deleting Section 2(g)(1): "Not longer than two (2) metres". Carried. Moved by Councillor Moss that Bylaw 1454-04 be amended by deleting Section 4(f): "No more than three dogs shall be harbored, suffered or permitted to remain upon or in any house, shelter, room or place, building, structure or premises within the County, provided this Section shall not apply to premises lawfully used for the care and treatment of dogs, operated by, or under the charge of a licensed veterinarian, nor to any premises which are temporarily being used for the purposes of a dog show, nor to any person in possession of a valid and subsisting development permit to operate a kennel or other dog operation within the County as authorized by the County's Land Use Bylaw." and by amending Schedule A by deleting: "Exceeding maximum number of dogs in a single family dwelling - $ 30.00 penalty". Carried. Moved by Councillor Loewen that Bylaw 1454-04 be amended so that Section 8 reads: "The County recognizes that it does not have available resources to be proactive in the enforcement of this Bylaw. Given this, enforcement will only be based on the receipt of specific signed written complaints". Carried. Moved by Councillor Vermeeren that Bylaw 1454-04 be amended by adding a new Section 8 to read as follows: "8. Interference with Dogs No person shall: a) Untie, loosen or otherwise free a dog which has been tied or otherwise restrained: or b) Negligently or willfully open a gate, door or other opening in a fence or enclosure in which a dog has been confined and thereby allow the dog to run at large." and by renumbering the Bylaw accordingly and instituting a penalty in Schedule A for interfering with dogs equal to the amount for dogs running at large. Carried. Vote on second reading as amended -Carried. March 25, 2004 Council Page 67 Moved by Councillor Harbinson that Bylaw 1454-04 receive third reading. Carried. .... 3. Fire Bylaw 1461-04 Administration was directed to survey the AAMD&C to determine how other municipalities deal with burning barrels. 6. Correspondence 1. Bassano Memorial Library - 2003 Annual Report The Bassano Memorial Library 2003 Annual Report was presented to Council and Councillor Moss also reported on this item. 2. Alberta Seniors Advisory Council -Seniors' Week -June 6-12, 2003 A letter from Alberta Seniors Advisory Council regarding Seniors' Week 2004 was presented to Council. Moved by Councillor Eckert that, in honour of the past, present and future contributions of the seniors of the County of Newell and throughout Alberta, we do hereby proclaim June 6 - 12, 2004, to be "Seniors' Week". K300 Financial Coro. - Reauest for Tax Payment Agreement -Block 6 Plan 9411167 A letter from K300 Financial Corp. requesting a Tax Payment Agreement for Block 6 Plan 9411167 was presented to Council. Moved by Councillor Harbinson that we enter into an agreement as per Administration's recommendation. Carried. 4. Village of Duchess -Request for Division 3 & 8 Fire Requisition Increase A letter from the Village of Duchess along with the budget from the Duchess & District Fire Advisory Committee were presented to Council. Council was advised that the necessary advertising process to increase the requisition has taken place. 5. AAMD&C -Resolutions Resolutions for the AAMD&C Spring 2004 Convention were presented to Council. Moved by Councillor Loewen that we accept this as information and that Councillors be allowed to vote as they wish. Carried. March 25, 2004 Council Page 68 6. Bassano Historical Society -Financial Assistance A letter from the Bassano Historical Society requesting financial assistance in the amount of $4,000.00 to create a History Book was presented to Council. Moved by Councillor Moss that we grant financial assistance as requested. Carried. Administration was directed to research the status of Brooks Museum's request for funds. 7. Other Business There were no Other Business items. 8. Post Agenda Items 1. Marlin Travel -Fundraising Invitation A letter from Marlin Travel requesting Council participation in the Habitat for Humanity fundraiser was presented to Council. Moved by Councillor Vermeeren that we purchase and decorate a cow for this fundraiser. Carried. 2. Zadi Investments Ltd. -Request for Tax Pavrnent Agreement -Block 2 Plan 9411167 - A letter from Zadi Investments Ltd. requesting a Tax Payment Agreement on Block 2 Plan 9411167 was presented to Council. Moved by Councillor Fabian that we enter into an agreement as per Administration's recommendation. Carried. 3. Zadi Investments Ltd. - Reauest for Tax Pavment Agreement -Block 3 Plan 9411167 A letter from Zadi Investments Ltd. requesting a Tax Payment Agreement on Block 3 Plan 9411167 was presented to Council. Moved by Councillor Musgrove that we enter into an agreement as per Administration's recommendation. Carried. 4. Mayor's & Reeve's Network Meeting with Ministers - Agenda The Mayor's & Reeve's Network Meeting Agenda for a meeting to be held Apri12, 2004 in Drumheller was circulated to Council. March 25, 2004 Council Page 69 Q 13 Beef Day A copy of an a-mail from Q13 regarding a Beef Day and Agri Day that they are hosting on April 7, 2004 was circulated to Council. Moved by Councillor Musgrove that we support this venture and also put in a display. Carried. 9. Delegation -Newell Recycling Association - Request for Fundine Doug Shanks, Vicky Stafford & Darlene Fisher, of Newell Recycling Association, were in attendance to present information and request a donation to support their organization. Excused from Meeting Councillor Loewen excused herself from the meeting at 11:03 a.m. 10. Delegation -RCMP Cst. Pete Thompson ofthe Bassano RCMP Detachment and S/Sgt. Noble ofthe Brooks RCMP Detachment were in attendance and presented their 2003 year-end reports for their respective detachments. A copy of the Risk Assessment from Southern Alberta District "K" Division ~ for the Brooks Detachment was also circulated. Lunch Council recessed for lunch from 11:57 a.m. - 12:55 p.m. Post Agenda Items (Cont'd.) 6. Offer to Sell Land to Alberta Transportation for Bow Citv Bridge An Offer to Sell Pt. SE 14-17-17-W4, being 0.74 acres, to Alberta Transportation to be used for construction of the Bow City Bridge was presented. Moved by Councillor Vermeeren that we sell this land to Alberta Transportation as presented. Carried. 7. Lake Newell Resort Sewer Line Reeve Baksa advised that the official opening of the Lake Newell Sanitary Forcemain would beheld on Friday, March 26, 2004 at 10:30 a.m. at the old lagoon site on the old #1 Highway. Moved by Councillor Eckert that any Council member who wishes to attend be allowed to do so and be reimbursed as per Policy. Carried. March 25, 2004 Council Page 70 v~ 11. Moved by Councillor Musgrove that we recommend to the Subdivision Approval Authority that the requirement to install and maintain waterlines in Subdivision 02 NL 29 be deleted as it is an industrial subdivision.
