HomeMy WebLinkAbout1326-00 Public Hearings, Regulation ofCounty of Newell No. 4 By-law No. 1326.00 A By-law of the County of Newell No. 4, in the Province of Alberta, to regulate Public Hearing procedures. Whereas, pursuant to Section 230(3) of the Municipal Government Act RSA 1995, it is deemed desirable to establish rules and procedures to regulate the conduct at Public Hearings Now therefore be it resolved that the Council of the County of Newell No. 4 duly assembled hereby enacts as follows: The Chairman runs and controls the hearing. If the Chairman feels that certain situations require a deviation from the following procedure, he shall outline the new procedure and immediately put it to a vote of Council without debate. Regular Procedures far Public Hearings: The Chairman calls the hearing to order. 2. The Secretary states the purpose of the public hearing leg. Land Use Change - SW 1.2.3.4 from Agriculture to Country Residentiall. 3. An Administrative staff member will provide a summary of the matter being heard. 4. The Chairman states the procedures which must be followed: a. Any individual wishing to speak must first be recognized by the Chair. b. Once recognized, they MUST state their name before beginning their presentation. ,~.,. c. ALL statements will be directed to Council. d. The applicant will be given five minutes to present their case. e. Anyone else speaking in favour will be given three minutes to make a presentation. Members of the public will be allowed to speak only once except to answer questions from Council. f. Council may ask questions of the applicant or speakers in favour. g. Members of the public opposed will be given three minutes to present their case and provide a rebuttal to the presentation of the applicant and anyone else speaking in favour of the proposal. Members of the public will be allowed to speak only once except to answer questions from Council. h. Council may ask questions of the public again. i. The applicant will be given three minutes far a rebuttal. j. The public hearing+s adjourned. Council goes back into the regular Council Meeting and may make their decision regardingthe issue which required the hearing. By-law 1155.95 is hereby rescinded.
