MUNICIPAL PLANNING COMMISSION MEETING
September 7, 2017
The regular Municipal Planning Commission Meeting of the County of Newell was held in the
County Office at Brooks, AB on Thursday, September 7, 2017 commencing at 10:01 a.m.

P-71/17 MOVED BY COUNCILLOR TRACY FYFE that the minutes of the August 10,
2017 Municipal Planning Commission meeting be adopted as presented.

P-72/17 MOVED BY COUNCILLOR ELLEN UNRUH that the agenda be adopted as presented.

6. SUBDIVISIONS
6.1 2017-0-130 - Lots 1 & 7, Block 1, Plan 831 1559 & SWI/4 8-19-15-W4M, To
correct an encroachment of an existing shop by subdividing a 2.5 acre (1.0 ha) portion of
SW1/4 8-19-14 W4M and consolidating the land to the adjacent parcel, Lot 1, Block 1,
Plan 831 1559.
The County Planner provided background information on the proposed subdivision
application.
There were no questions from MPC.
P-73/17 MOVED BY COUNCILLOR TRACY FYFE THAT the Country Residential subdivision of
Lots 1 & 7, Block 1, Plan 831 1559 & SW1/4 8-19-15-W4M (Certificate of Title No. 861
179 845A, 861 179 845D, 131 301 278+16), to correct an encroachment of an existing
shop by subdividing a 2.5 acre (1.0 ha) portion of SW1/4 8-19-15 W4M and
consolidating the land to the adjacent parcel, Lot 1, Block 1, Plan 831 1559 BE
APPROVED subject to the following:
RESERVE: The 10% reserve requirement, pursuant to Sections 666 and 667 of the
Municipal Government Act, be provided as money in place of land on the
2.5 acres at the market value of $4000.00 per acre with the actual acreage
and amount to be paid to the County of Newell for Municipal Reserve
Purposes, being determined at the final stage.
CONDITIONS:
1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding
property taxes shall be paid to the County of Newell.
2. That the subdivided portion of the SW1/4 8-19-15-W4M be consolidated with the
adjacent parcel legally known as Lot 1 & 7, Block 1, Plan 831 1559 in a manner such
that the resulting Certificate of Title could not be subdivided without the approval of
the Subdivision Authority.

There were no questions. The report was accepted as information.

8. DEVELOPMENT PERMITS
8.1. DP 2017053 - SE 5-20-14 W4M, Construction of an accessory building with a
variance to setback
The Development Clerk provided background information on the proposed application.
D. Rempel indicated that since the property is quite narrow, placing the shop in the
middle of the yard would make it difficult for a vehicle to access the building. He added
that he felt the shop would look better set within the trees and tucked behind the house
than in the middle of the lot.
P-74/17 MOVED BY COUNCILLOR LIONEL JUSS That the Municipal Planning Commission
APPROVE Development Permit 2017053, for the construction of a 900 ft' (84 m2)
accessory building (shop) with a variance to the setback, subject to the conditions
outlined below.
This permit is being granted only to provide approval for the construction of a 900 ft2 (84
m2) accessory building (shop) with a variance to the setback, on lands legally described
as SE 5-20-14 W4M. Any additional development shall require prior approval of a
separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Agricultural District and all relevant schedules, as
outlined in the County of Newell Land Use Bylaw #1755-12.
b) All Federal, Provincial and Municipal statutes, regulations, codes and standards.
— ; c) All Alberta Building Codes and Safety Codes, where applicable.
Reasons for Approval
The Municipal Planning Commission has approved DP 2017053 for the following
reasons:
1. The proposed development complies with the Municipal Development Plan.
2. The Development Authority is satisfied that the proposed development is suitable for
the purpose for which it is intended under the Agricultural District (Schedule 2) and
Standards of Development (Schedule 3) as specified in the County of Newell Land
Use Bylaw #1755-12.
3. No objections have been received from adjacent landowners or referral agencies
with respect to the proposed development.
Conditions of Development
a) That this development is located as shown on the site plan approved in this
application and submitted July 28, 2017. Any changes to that plan shall require the
written approval of the Development Officer.
b) That the property is not used for conducting a business or commercial operation
without first obtaining the required permits.
c) That the proposed accessory building is not used for living purposes
d) That there is a 10 ft (3 m) separation distance between any other buildings or
structures.
e) That the following setbacks on all sides are maintained for this development:
Front (east): 118 ft (36 m) minimum as specified by Alberta Transportation
Side (north): 25 ft (7.6 m)
Rear (west): 25 ft (7.6 m)
Side (south): 15 ft (4.6 m), varied from 25 ft (7.6 m)

8.2. DP 2017054 - SE 5-20-14 W4M, As -built approval of a dwelling with variance to
setback
The Development Clerk provided background information on the proposed application.
There were no questions from MPC.
P-75/17 MOVED BY REEVE MOLLY DOUGLASS That the Municipal Planning Commission
APPROVE Development Permit 2017054, for the approval of an as -built 1474 ft2 (137
m2) dwelling, 676 ft2 (63 m2) attached garage and 640 ft2 (59 m2) deck, subject to the
conditions outlined below.
This permit is being granted only to provide approval for the approval of an as -built 1474
ft2 (137 m2) dwelling, 676 ft2 (63 m2) attached garage and 640 ft2 (59 m2) deck, on lands
legally described as SE 5-20-14 W4M. Any additional development shall require prior
approval of a separate permit application.
The proposed development complying with:
