Douglass, Reeve H. Kallen, Councillor A.M. Philipsen, Councillor, MPC Vice Chair W. Hammergren, Councillor T. Fyfe, Councillor E. Unruh, Councillor B. de Jong, Councillor L. Simpson, Development Clerk P. Elliott, Administrative Assistant, Planning OTHERS IN S. Stanway, Brooks Bulletin ATTENDANCE: 1. CALL TO ORDER The Chairman called the meeting to order at 10:00 a.m. 2. EXCUSED FROM MEETING P-89/17 MOVED BY COUNCILLOR TRACY FYFE that Councillors Clarence Amulung and Kelly Christman be excused from the meeting. MOTION CARRIED 3. MINUTES 3.1 October 26, 2017 Meeting Minutes P-90/17 MOVED BY COUNCILLOR ELLEN UNRUH that the minutes of the October 26, 2017 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-91/17 MOVED BY COUNCILLOR TRACY FYFE that the agenda be adopted as presented. MOTION CARRIED 6. S.D.A.B. REPORT The County Planner provided information on the S.D.A.B. hearing that was held November 2, 2017 for an appeal of DP 2017057. The County Planner indicated that the S.D.A.B. has 15 days to render a decision and that the decision will be presented at the next MPC meeting. Councillor W. Hammergren asked what County MPC could do if the S. D.A. B. upheld the appeal. The County Planner replied that Council/ MPC had no recourse regarding the S.D. A.B. decision. She added that the appellants or the applicants could take it to the Court of Appeal, but only if the Court determined that there was an error in jurisdiction or the S. D.A. B. had overstepped their boundaries. Councillor B. de Jong inquired about the time line for construction of the solar facility if the MPC decision is upheld. The County Planner answered that So/arKrafte has not yet applied to the Alberta Utilities Commission (AUC), but has indicated that they are planning to commence construction in spring 2018. 7. DEVELOPMENT REPORT a) Permitted Use Report — October 1 - 31, 2017 The Development Clerk responded to a question from MPC regarding a development permit on the report. P-92/17 MOVED BY COUNCILLOR HUBY KALLEN that the Development Report be adopted as presented. MOTION CARRIED 8. DEVELOPMENT PERMITS 8.1. DP 2017067 - NW 17-20-13 W4M, Art & Craft Instruction (Hot Mess Creatives) The Development Clerk provided background information on the proposed permit application. There were no questions. P-93/17 MOVED BY COUNCILLOR ELLEN UNRUH That the Municipal Planning Commission APPROVE the Home Occupation 2017067 to establish an Arts & Crafts instruction business, subject to the following conditions: This permanent permit is being granted only for the Arts & Crafts instruction business, located on lands legally described as NW 17-20-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards c) All Alberta Building Codes and Safety Codes, where applicable. It is the responsibility of the developer to obtain all permits from an accredited inspection agency. Reasons for Approval The Municipal Planning Commission has approved HO 2017067 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 3) and Home Occupations (Schedule 4 Section 9), as specified in the County of Newell Land Use Bylaw #1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted October 4, 2017. Any changes to that plan shall require the written approval from the Development Officer. b) That there are no more than 1 resident employees involved in the operation of this business. c) That the only advertising being permitted on the property be limited to one indirectly illuminated sign of 6 ft2 (.56 m2) placed flat against the building or fence. MOTION CARRIED 8.2. DP 2017068 - Block 1, Plan 8811330, NW 6-17-12 W4M, Approval of an existing 2nd Dwelling The Development Clerk provided background information on the proposed permit application. There were no questions. P-94/17 MOVED BY COUNCILLOR TRACY FYFE That the Municipal Planning Commission APPROVE Development Permit 2017068, for the approval of an existing 2133 ft2 (198 m2) single family dwelling being used as a second dwelling and a 754 ft2 (70 m2) detached garage, subject to the conditions outlined below. This permit is being granted only to provide approval of an existing 2133 ft2 (198 m2) single family dwelling being used as a second dwelling and a 754 ft2 (70 m2) detached garage, on lands legally described as Block 1, Plan 8811330, NW 6-17-12 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan approved in this application and submitted October 2, 2017. Any changes to that plan shall require the written approval of the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 10 ft (3 m) separation distance between any buildings or structures. d) That the following setbacks on all sides are maintained for the detached garage: Front (west): 300 ft (90 m), as specified by Alberta Transportation Side (south): 17 ft (5 m); variance from 25 ft (7.6 m) Rear (east): 25 ft (7.6 m) e) That the following setbacks on all sides are maintained for the second dwelling: Front (west): 300 ft (90 m), as specified by Alberta Transportation Side (south): 25 ft (7.6 m) Rear (east): 25 ft (7.6 m) MOTION CARRIED 9.
