MINUTES 3.1 November 9, 2017 Meeting Minutes P-96117 MOVED BY COUNCILLOR BRIAN DE JONG that the November 9, 2017 Municipal Planning Commission Meeting minutes be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. Municipal Planning Commission November 23, 2017 5. ADOPTION OF AGENDA P-97/17 MOVED BY COUNCILLOR KELLY CHRISTMAN that the agenda be adopted as \ amended. MOTION CARRIED 6. S.D.A.B. REPORT 6.1 DP 2017057 S.D.A.B. Decision The County Planner provided background and updated information on the S.D.A.B. decision. The S.D.A.B. upheld the M.P.C. decision with additional conditions requiring a Landscape Plan and stating that the applicant be responsible for the proper recycling and/or disposal of any broken or replaced modules or solar panels. The S.D.A.B. also recommended the County implement measures regarding Emergency Response Plan criteria, developing a plan that would highlight areas in the County that are acceptable for alternative energy projects, and expanding the notification process for large scale alternative energy projects. Council was given the opportunity to ask questions. The County Planner responded to questions from Council regarding the development permit process and opportunities to make the process more user-friendly. 7. DEVELOPMENT PERMITS 7.1 DP 2017073 - Lot 11, Block 4, Plan 9611766, SW 10-19-14 W4M, Installation of a RTM dwelling with deck; variance to side yard setback The Development Clerk provided background information on the proposed permit application P-98/17 MOVED BY COUNCILLOR WAYNE HAMMERGREN that the Municipal Planning Commission APPROVE Development Permit 2017073, for the installation of a 2280 ft2 (212 m2) RTM dwelling with a 612 ft2 (57 m2) deck with a variance to the side yard setback, subject to the conditions outlined below. This permit is being granted only to provide approval for the installation of a 2280 ft2 (212 m2) RTM dwelling with a 612 ft2 (57 m2) deck, with a variance to the side yard setback, on lands legally described as Lot 11, Block 4, Plan 9611766, SW 10-19-14 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. Please note that it is responsibility of the developer to obtain all permits from an accredited inspection agency. ul Page 2 of 4 Municipal Planning Commission November 23, 2017 Reasons for Approval The Municipal Planning Commission has approved DP 2017073 for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw #1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development a) That this development is located as shown on the site plan provided with this application and submitted October 16, 2017. Any changes to that plan shall require the written approval from the Development Officer. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That there is a 10 ft (3 m) separation distance between the new building and any other buildings or structures on the parcel. d) That the following setbacks are maintained for this development: Front (west): 50 ft (15.2 m) Side (south): 19 ft (6 m); variance from 25 ft (7.6 m) Rear (east): 25 ft (7.6m) e) That the developer must start construction before December 12, 2018. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. MOTION CARRIED 8. POST AGENDA ITEMS 8.1 Information Items The County Planner suggested that time be allocated during each M. P. C. meeting to review policies and procedures with Council and to make them aware of changes to processes that will be required under the new Municipal Government Act. Council was in favour of this. They were invited to submit topics. The Manager of Planning & Development reported that, under the new MGA, any information requested by one Councillor must be provided to all of Council. Currently, Development Permit applications are circulated to the M.P. C. Chairman and the divisional Councillor where the development will occur. All of Council receives the information when the M.P.C. agenda package is distributed. Discussion followed. Going forward, the information will be circulated to all Councillors as well as included in the agenda package. The Manager of Planning & Development requested feedback from Council regarding the release of agenda packages to the public. Currently, meeting agenda packages for M.P.C. and Council are made available to the public the Tuesday before the meeting. Discussion followed. QUESTION PERIOD A question period was held. 12.
