HomeMy WebLinkAbout1899-17 Intermunicipal Development Plan (MD of Taber) BYLAW NO. 1899-17 COUNTY OF NEWELL IN THE PROVINCE OF ALBERTA Being a bylaw of the County of the Newell in the province of Alberta, to a adopt an Intermunicipal Development Plan between the Municipal District of Taber and the County of Newell pursuant to sections 631 and 692 of the Municipal Government Act, Revised Statutes of Alberta 2000, Chapter M- 26, as amended; WHEREAS municipalities are required by the province to expand intermunicipal planning efforts to address common planning issues and where the possible effects of development transcends municipal boundaries. AND WHEREAS both the Councils of the Municipal District of Taber and the County of Newell agree that it is to their mutual benefit to establish joint planning policies and this negotiation and agreement reflects a continuing cooperative approach between the two municipalities and the desire to see well- planned, orderly, and managed growth. AND WHEREAS the municipality must prepare a corresponding bylaw and provide for its consideration at a public hearing. NOW THEREFORE, under the authority and subject to the provisions of the Municipal Government Act, Revised Statutes of Alberta 2000, Chapter M-26 as amended, the Council of the County of Newell duly assembled hereby enacts the following: 1. Council shall adopt the Municipal District of Taber and County of Newell Intermunicipal Development Plan in consultation and as agreed to with the Municipal District of Taber. 2. This plan, upon adoption, shall be cited as the Municipal District of Taber and County of Newell Intermunicipal Development Plan Bylaw No. 1899-17 3. This bylaw shall come into effect upon third and final reading thereof. READ a first time this 9th day of November, 2017. . ThepurposeoftheMunicipalDistrictofTaber(MDofTaber)andCountyofNewellIntermunicipal DevelopmentPlan(IDPorthePlan)istofosterongoingcollaborationandcooperationregardingplanning mattersandissuesofmutualinterestandaddressandclarifylanduseexpectationswithintheagreed uponintermunicipaldevelopmentplanarea(PlanArea). ThisIDPservesasaplanningtoolprovidingguidancetodecisionmakersthroughtheagreedupon planningpoliciesthatapplytothelandwithinthePlanArea.TheIDPcontainspolicythatistobeusedas aframeworkforworkingcooperatively,communicatingandmakingdecisionsineachmunicipality.Each municipalityisultimatelyresponsibleformakingdecisionswithintheirownmunicipaljurisdiction. 1.2PlanGoals TheintendedgoalsoftheIDPare: Topromoteconsultation,coordinationandcooperationregardingplanningmattersofjoint interestwithinthePlanArea. Toprovideaframeworkforaddressinglanduseconcernswithregardtojointplanningmatters withinthePlanArea. Toprovideaclearpolicyframework thatservestoguidefutureplanningdecisionsforlandlocated withinthePlanArea,affordingenhancedcoordinationofdevelopmentwithinthePlanArea. ThepreparationandimplementationofanIDPcanresultinmanybenefitstobothmunicipalities including,butnotlimitedto,thefollowing: Toestablishanapproachtoidentifypossiblejointventuresforinfrastructureandservicesharing topromoteefficientplanningandpotentialdeliveryofservices. ToreinforceandprotecteachƒǒƓźĭźƦğƌźƷǤ͸ƭdevelopmentphilosophiesandgoalswhile minimizingthepotentialforfutureintermunicipalconflict. Toprovidepolicyaddressingplanadministration,amendmentanddisputeresolutionprocedures. MunicipalDistrictofTaber&CountyofNewell 1 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|1 1.3LegislativeRequirements ThisPlanhasbeenpreparedinaccordancewiththerequirementsofthe MunicipalGovernmentAct, RevisedStatutesofAlberta2000,ChapterM26,asamended(MGA),andcomplieswiththe South SaskatchewanRegionalPlan. Specificallythe MGA requires: 631(1)Twoormorecouncilsofmunicipalitiesthathavecommonboundariesthatarenotmembersofa growthregionasdefinedinSection708.01must,byeachpassingabylawinaccordancewiththis PartorinaccordancewithSections12and692,adoptanintermunicipaldevelopmentplanto includethoseareasoflandlyingwithintheboundariesofthemunicipalitiesastheyconsider necessary. 631(2)Anintermunicipaldevelopmentplan a)mustaddress i.thefuturelandusewithinthearea, ii.themannerofandtheproposalsforfuturedevelopmentinthearea, thearea,eithergenerallyorspecifically, iii.theprovisionoftransportationsystemsfor ivthecoordinationofintermunicipalprogramsrelatingtothephysical,socialand economicdevelopmentofthearea, vienvironmentalmatterswithinthearea,eithergenerallyorspecifically,and viianyothermatterrelatedtothephysical,socialoreconomicdevelopmentofthearea thatthecouncilsconsidernecessary. and b)mustinclude i.aproceduretobeusedtoresolveorattempttoresolveanyconflictbetweenthe municipalitiesthathaveadoptedtheplan, ii.aproceduretobeused,byoneormoremunicipalities,toamendorrepealtheplan,and iii.provisionsrelatingtotheadministrationoftheplan. TheSouthSaskatchewanRegionalPlan(SSRP)cameintoeffectSeptember1,2014.TheSSRPusesa cumulativeeffectsmanagementapproachtosetpolicydirectionformunicipalitiestoachieve environmental,economicandsocialoutcomeswithintheSouthSaskatchewanRegionthrough2024. PursuanttoSection13ofthe AlbertaLandStewardshipAct,regionalplansarelegislativeinstruments. TheSSRPhasfourkeypartsincludingtheIntroduction,StrategicPlan,ImplementationPlanand RegulatoryDetailsPlan.PursuanttoSection15(1)of ALSA,theRegulatoryDetailsoftheSSRPare enforceableaslawandbindtheCrown,decisionmakers,localgovernmentsandallotherpersonswhile theremainingportionsarestatementsofpolicytoinformandarenotintendedtohavebindinglegal effect. MunicipalDistrictofTaber&CountyofNewell 2 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|2 TheRegionalPlanisguidedbythevision,outcomesandintendeddirectionssetbytheStrategicPlan portionoftheSSRPwhiletheImplementationPlanestablishestheobjectivesandthestrategiesthatwill beimplementedtoachievetheregionalvision.AspartoftheImplementationPlan,Section8:Community DevelopmentincludesguidanceregardingPlanningCooperationandIntegrationbetweenmunicipalities withtheintentiontofostercooperationandcoordinationbetweenneighbouringmunicipalitiesand betweenmunicipalitiesandprovincialdepartments,boardsandagencies.Section8containsthe followingbroadobjectivesandstrategies. Objectives Cooperationandcoordinationarefosteredamongalllanduseplannersanddecisionmakers involvedinpreparingandimplementinglandplansandstrategies. Knowledgesharingamongcommunitiesisencouragedtopromotetheuseofplanningtoolsandthe principlesofefficientuseoflandtoaddresscommunitydevelopmentintheregion. Strategies 8.1 Worktogethertoachievethesharedenvironmental,economic,andsocialoutcomesintheSouth SaskatchewanRegionalPlanandminimizenegativeenvironmentalcumulativeeffects. 8.2 Addresscommonplanningissues,especiallywherevaluednaturalfeaturesandhistoricresources areofinteresttomorethanonestakeholderandwherethepossibleeffectofdevelopment transcendsjurisdictionalboundaries. 8.3 Coordinateandworkwitheachotherintheirrespectiveplanningactivities(suchasinthe developmentofplanandpolicies)anddevelopmentapprovalprocesstoaddressissuesofmutual interest. 8.4 Worktogethertoanticipate,planandsetasideadequatelandwiththephysicalinfrastructureand servicesrequiredtoaccommodatefuturepopulationgrowthandaccompanyingcommunity developmentneeds. 8.5 Buildawarenessregardingtheapplicationoflanduseplanningtoolsthatreducetheimpactof residential,commercialandindustrialdevelopmentsontheland,includingapproachesandbest practicesforpromotingtheefficientuseofprivateandpubliclands. 8.6 Pursuejointuseagreements,regionalservicescommissionsandanyotherjointcooperative arrangementsthatcontributespecificallytointermunicipallanduseplanning. 8.7 Considerthevalueofintermunicipaldevelopmentplanningtoaddresslanduseonfringeareas, interest. airportvicinityprotectionplanorotherareasofmutual 8.8 CoordinatelanduseplanningactivitieswithFirstNations,irrigationdistricts,schoolboards,health authoritiesandotheragenciesonareasofmutualinterest. TheabovestrategieswereconsideredbybothmunicipalitieswhendevelopingpolicywithinthisIDPand willbeconsideredwhenrenderinglandusedecisionspertainingtodevelopmentwithinthePlanArea. MunicipalDistrictofTaber&CountyofNewell 3 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|3 1.4PlanPreparationProcess Abackgroundandstudyareaanalysiswasundertakenwhichservedasthefoundationfromwhichboth municipalitiescouldreviewtheexistinglanduseconditionsanddeterminetherelevantissues,goalsand objectives.OnceeachƒǒƓźĭźƦğƌźƷǤ͸ƭperspectiveswereidentified,adraftdocumentwaspreparedfor reviewbyeachcouncilpriortoconsultationwithaffectedlandowners,stakeholdersandthegeneral publicatanOpenHouse. AftertheOpenHouse,arefineddocumentwasthenpreparedandfinaldraftwasforwardedtoeach Councilforreview.Asrequiredbythe MGA,publichearingswereheldbyeachCouncilandsubsequent tothepublichearings,theIDPwasadoptedbyeachmunicipalityunderseparatemunicipalbylaws. MunicipalDistrictofTaber&CountyofNewell 4 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|4 2|PLANAREA Giventhevastsizeofthemunicipalities,inordertofocusontheborderareaandpotentialimpacts,an areaapproximately2milesoneachsideofthesharedborderwasexamined.Thepurposewastoidentify opportunitiesandconstraints,whichmayaffectlanduseplanninginthePlanArea.Afterconsideration ofsocial,economicandphysicalfeatureslistedbelow,itwasdeterminedthataPlanAreaof approximately1mile(1.6km)oneachsideofthemunicipalboundarywasadequate(refertoMap1for illustrationofthePlanArea). WithinthePlanAreathefollowingfeatureswereexamined: ResidencesandUrbanAreas LandUseandZoning SurfaceWater ConfinedFeedingOperations(CFOs) Active/PotentialSitesforSurfaceMaterialsExtraction TransportationCorridors CanadaLandInventory(CLI)SoilIndexValues EnvironmentallySignificantAreas(ESAs) HistoricalResourceValue(HRV)Sites 2.1KeyCharacteristicsofthePlanArea TheMDofTaberandCountyofNewellIntermunicipalPlanAreaencompassesapproximately17,825 hectares(44,045acres).KeycharacteristicsofthePlanAreaincludethefollowing,someofwhichare illustratedonMaps25inAppendixA: Agriculture o Alllandsarezonedforagriculturaluse. o Amixofagriculturaloperationsexist,includinggrazing,irrigatedanddrylandfarming. o ConfinedfeedingoperationsarealsolocatedwithinthePlanArea. Limited Residential Development o AsignificantportionoflandintheMDofTaberisCrownlandandcontainsfewresidences. TheCountyofNewellcontainssignificantamountsoflandundertheownershipofthe EasternIrrigationDistrictandcontainsfewresidences. o NohamletsorotherurbanmunicipalitiesexistwithinthePlanArea. MunicipalDistrictofTaber&CountyofNewell 5 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|5 Transportation Infrastructure o Theonlytransportationlinksbetweenthemunicipalitiesareprovincialhighways36and 875crossingovertheBowRiver. Natural Resource Development o Oilandgasactivityisabundantinbothmunicipalities. o ThereisahighpotentialforsandandgraveldevelopmentwithintheBowRivervalley. Bow River Valley o TheBowRiverdefinestheborderbetweenthetwomunicipalities. o EnvironmentallysignificantareasofRegionalSignificanceareconcentratedalongthe BowRivercorridor. o Thepotentialforlandthatmaycontainhistoricresourcesthatmayrequireavoidanceis locatedalongtheBowRivercorridor. Soil Characteristics o TheCanadaLandInventory(CLI)indicatesmoderatetoseverecroplimitationsformost oftheregion. o Soilclasses1through7arepresent,resultinginadiversityofagriculturalpractices. MunicipalDistrictofTaber&CountyofNewell 6 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|6 61 pihsnwoT51 pihsnwoT41 pihsnwoT31 pihsnwoT 3|POLICIES ThepoliciescontainedinthisPlanareintendedtoprovidedirectiontotheMDofTaberandCountyof NewellCouncils,subdivisionanddevelopmentauthoritiesandadministrationstomanagethelands containedwithinthePlanArea.ThepoliciesofthisPlanapplytoalllandwithinthePlanAreaboundary delineatedinMap1. 3.1General INTENT ToprovideadministrativepolicieswithinthePlanAreawhichfosterintermunicipalcommunication, consultationandcooperation. POLICIES 3.1.1TheMDofTaberandtheCountyofNewellwillstrivetoengageineffectivedialoguewhen consideringlanduse,whilemaintainingjurisdictiononlandswithintheirownboundaries. 3.1.2Themunicipalitieswillcontinuetobuildpartnershipsandfosteracollaborativerelationship withtheadjacentmunicipalitytopromoteregionalinterests,wheredeemedappropriate, includingthesupportofmutuallybeneficialserviceagreementsandsharedenvironmental, economicandsocialoutcomes. 3.1.3Bothmunicipalitiesagreetojointlydiscusswaystocooperatewithprovincialandfederal agenciesandutilityproviderstohelpfacilitatetheefficientdeliveryofinfrastructureand servicesthatareofamutualbenefit. 3.1.4TheMDofTaberandCountyofNewellwillstrive,tothebestoftheirabilityandknowledge, torefernoticesofgovernmentprojectstoeachother. 3.1.5Bothmunicipalitiesareencouragedtosharewitheachothertheresultsofallpublicly availabletechnicalanalysesrequiredbyaSubdivisionandDevelopmentAuthorityaspartof anapplication,wherethereisthepotentialforimpactsonlandsandbodiesofwater. 3.2LandUse INTENT ToprovidepoliciesonlandusewithinthePlanAreawhichreflectthedevelopmentphilosophiesof bothmunicipalities. MunicipalDistrictofTaber&CountyofNewell 7 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|7 POLICIES ExtensiveAgriculture 3.2.1AgriculturewillcontinuetobethepredominantlanduseinthePlanArea.Theimpacton agriculturalusesshouldbeaconsiderationwhendeterminingsuitabilityofnonagricultural landusesinthePlanArea. 3.2.2Bothmunicipalitieswillstrivetoworkcooperativelytoencouragegoodneighbourfarming practices,suchasdust,weedandinsectcontroladjacenttodevelopedareas,throughbest managementpracticesandAlbertaAgricultureguidelines. 3.2.3Ifdisputesorcomplaintsineithermunicipalityarisebetweenratepayersandagricultural operators,themunicipalityreceivingthecomplaintwilldirecttheaffectedpartiestothe appropriateagency,governmentdepartmentormunicipalityforconsultationorresolution wherevernecessary. ConfinedFeedingOperations(CFOs) 3.2.4ExistingCFOswillbeallowedtocontinuetooperateunderacceptableoperatingpracticesand withintherequirementsofthe AgriculturalOperationPracticesActandRegulations. 3.2.5IfeithertheMDofTaberortheCountyofNewellareinreceiptofanoticeofapplicationfrom theNaturalResourcesConservationBoardforneworexpandedCFOs,theywillforwarda copyofthenotificationtotheothermunicipality. ResourceExtraction 3.2.6Themunicipalitieswillconsidertheeffectsofvisualintrusion,dust,noise,traffic,andairand waterpollutionwhenevaluatingapplicationsforneworexpandedgravelpits,orother extractiveactivities,wheretheymaintainjurisdiction. 3.2.7Eithermunicipalitymayrequireanagreementregardingtheconstruction,repair,and maintenanceofanymunicipalroads,whichmaybeimpactedbyresourcedevelopment,when thedevelopmentrequiresaccesstocomefromtheotherƒǒƓźĭźƦğƌźƷǤ͸ƭroad. 3.2.8IfeithertheMDofTaberorCountyofNewellareinreceiptofanoticeforaneworexpanded AlbertaTransportationgravelpit,theywillforwardacopyofthenoticetotheother municipality. MunicipalDistrictofTaber&CountyofNewell 8 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|8 IndustryandEnergyDevelopment 3.2.9Themunicipalitiesmayconsiderthelocationofrenewableenergydevelopmentsandother industrialdevelopmentwherecompatiblewithexistinglanduses. TelecommunicationsTowers/Utilities 3.2.10Wherethereisanapplicationforanew,expandedorretrofittedtelecommunicationstower withinthePlanArea,theMDofTaberandCountyofNewellwillnotifytheothermunicipality toseektheircomments. 3.2.11Itisthepreferenceofbothmunicipalitiesthatcolocationoftelecommunicationfacilitiesbe undertakenwheretechnicallyfeasible. 3.2.12Thelocationoftelecommunicationtowersinproximityofirrigatedcropproductionshould considerthepotentialimpacttoaerialapplication. 3.2.13Whenprovidingcommentstoprovincialandfederaldepartmentsregardingutility development,theMDofTaberandCountyofNewellwillrequestthatconsiderationbegiven totheestablishmentofutilitycorridorswithmultipleusers. 3.3TransportationandRoadNetworks INTENT TheonlyroadconnectionsbetweenthemunicipalitiesareProvincialHighways36and875.Itis importantthatthemunicipalitiestakeintoconsiderationtheimpactofdevelopmentonmunicipal andprovincialroadinfrastructure. POLICIES 3.3.1BothmunicipalitiesagreetoconsultandworkwithAlbertaTransportationregardingthe implementationofthisPlanand,atthetimeofsubdivisionanddevelopment,considerhow developmentmayimpactHighway36orHighway875,asapplicable. 3.3.2WhenrequiredbyAlbertaTransportation,developersshallconducttrafficstudieswith respecttotheimpactandaccessontheHighways.Anyupgradingidentifiedbyatrafficstudy conductedbyadeveloperwithrespecttotheHighwayshallbeimplementedbythedeveloper atitssolecostandtothesatisfactionofAlbertaTransportation. 3.3.3ThemunicipalitiesshouldendeavortomaintainopendialoguewithAlbertaTransportation regardingHighway36andHighway875,includinganychangestothehighwaysthatmayhave importantimpactsonthemunicipalities. MunicipalDistrictofTaber&CountyofNewell 9 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|9 3.4NaturalEnvironment INTENT Bothmunicipalitiesrecognizetheconnectionbetweenthenaturalenvironmentandqualityoflifeand strivetoprotect,preserveandenhancenaturalsystemsandenvironmentallysignificantareas,while promotingappropriatedevelopment. POLICIES 3.4.1Whenmakinglandusedecisions,eachmunicipalitywill: a)utilizeandincorporatemeasureswhichminimizepossibleimpactsontheBowRiverand anyotherimportantwaterresource; b)determineappropriatelandusepatternsinthevicinityofsignificantwaterresourcesand otherwaterfeatures; c)establishappropriatesetbackstomaintainwaterquality,floodwaterconveyanceand storage,bankstabilityandhabitat. 3.4.2Landsthathavebeenidentifiedthatmaycontainanenvironmentallysignificantsitemaybe requiredtoconductanenvironmentalimpactassessment(EIA)andtheproponentshould contactAlbertaEnvironmentandParks. 3.4.3Landsthathavebeenidentifiedthatmaycontainahistoricresourcemayberequiredto conductahistoricalresourceimpactassessment(HRIA)andtheproponentshouldconsultthe HistoricalResourcesAct andAlbertaCultureandTourism. 3.4.4BothmunicipalitiesshouldconsidertheprovincialWetlandPolicywhenmakinglanduse decisionswiththegoalofsustainingenvironmentandeconomicbenefits. 3.5Interpretation INTENT ToensurethepoliciesandlanguagewithinthisPlanarecommunicatedinthepropercontextsoasto ensuretheintentofthePlanisasclearandconciseaspossible. POLICIES 3.5.1Unlessotherwiserequiredbythecontext,wordsusedinthepresenttenseincludethefuture tense,wordsusedinthesingularincludetheplural,andthewordpersonincludesa corporationaswellasanindividual.Unlessotherwisestipulated,the InterpretationAct, MunicipalDistrictofTaber&CountyofNewell 10 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|10 ChapterI8,RSA2000 asamended,shallbeusedintheinterpretationofthisbylaw.Words havethesamemeaningwhethertheyarecapitalizedornot. 3.5.2Allreferencestoaspecificagency,body,ordepartmentwereaccurateatthetimeofwriting. MunicipalDistrictofTaber&CountyofNewell 11 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|11 4|PLANADMINISTRATION&IMPLEMENTATION 4.1IntermunicipalDevelopmentPlanCommitteePolicies INTENT TheimplementationofthisPlanisintendedtobeanongoingprocesstoensureitismaintainedand remainsapplicable.AnIntermunicipalDevelopmentPlanCommitteewithjointrepresentationwill ensurecontinueddialogueandcooperation,asthepurposeofthiscommitteeistopromoteactive cooperationandconflictresolutionthroughaconsensusbasedapproach. POLICIES 4.1.1ForthepurposesofadministeringandmonitoringtheIDP,theMDofTaberandtheCounty ofNewellestablishtheIntermunicipalDevelopmentPlanCommittee(theCommittee). 4.1.2BothCouncilsagreetheIntermunicipalDevelopmentPlanCommitteewillbeanadvisorybody andmaymakecommentsorrecommendationstotheMDofTaberandCountyofNewell.In itsadvisorycapacity,theCommitteedoesnothavedecisionmakingauthorityorpowerswith respecttoplanningmattersineithermunicipality. 4.1.3TheCommitteewillbecomprisedoftwo(2)membersofCouncilfromboththeMDofTaber andCountyofNewell.EachmunicipalitymayappointanalternateCommitteememberinthe eventaregularmembercannotattendascheduledmeeting.AlternateCommitteemembers shallhavestanding.Quorumshallconsistoffour(4)votingmembers. 4.1.4MembersoftheCommitteeshallbeappointedbytheirrespectiveCouncilsatthe OrganizationalMeeting.IfaCouncilwishestoappointanewmembertotheCommittee (includingthealternate),theymustdosobymotionofCouncilataregularCouncilmeeting. Themunicipalitiesshallnotifyoneanotheruponappointingmembersandalternatemembers totheCommittee. 4.1.5ThemunicipalitiesagreethatthepurposeoftheCommitteeisto: a)provideaforumfordiscussionoflandusematterswithinthePlanArea, b)providerecommendation(s)forproposedamendmentstothePlan, c)discussandaddressissuesregardingPlanimplementation, matters d)reviewandprovidecommentonreferralsundersection4.2andanyother referredtotheCommittee, e)providerecommendation(s)regardingintermunicipalissuesinanefforttoavoida dispute,and MunicipalDistrictofTaber&CountyofNewell 12 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|12 f)provideaforumfordiscussionofanyothermatterofjointinterestidentifiedbyeither municipality. 4.1.6MeetingsoftheCommitteemaybeheldattherequestofeithermunicipalitytodiscussland useorotherplanningmatters,disputeresolution,oranyothermatterofintermunicipal importance.Additionally,anymatterinsection4.2maybereferredbyeithermunicipalityto theCommitteeforcommentpriortoadecisionbeingrendered. 4.1.7AmunicipalitymaycallameetingoftheCommitteeatanytimeuponnotlessthanfive(5) days'noticeofthemeetingbeinggiventoallmembersoftheCommitteeandsupport personnel,statingthedate,thetime,purposeandtheplaceoftheproposedmeeting.The five(5)days'noticemaybewaivedwithяoftheCommitteeƒĻƒĬĻƩƭ͸agreementnoted. 4.1.8ThemunicipalitythatcalledthemeetingoftheCommitteeshallhostandchairthemeeting andisresponsibleforpreparinganddistributingagendasandminutes. 4.1.9Atleastone(1)memberofeachƒǒƓźĭźƦğƌźƷǤ͸ƭadministrativestaffshallattendeachmeeting inthecapacityoftechnical,nonvotingadvisor. 4.1.10AnychangestotheCommitteeformat,composition,roles,responsibilitiesoranyaspectofits existenceoroperationmayberequestedbyeithermunicipality. 4.1.11WhereamatterhasbeenreferredtotheCommitteeandaresolutioncannotbefound,the DisputeResolutionprocessinSection5ofthisPlanshouldbeadheredto. 4.2ReferralPolicies INTENT Toestablishaprocessforconsistentandtransparentsharingofinformationnecessarytomake decisionsinaccordancewiththeintentofthePlan. POLICIES General 4.2.1Whereanintermunicipalreferralisrequiredbythe MGA orthepoliciescontainedinthisPlan, bothmunicipalitiesagreetosharemailingaddressandpropertyownershipinformationfor circulationpurposeswiththeadjacentmunicipality,andwhereapplicable,theƒǒƓźĭźƦğƌźƷǤ͸ƭ processingagency. 4.2.2Whereaplanorbylaw,includingamendments,orapplication,requiresnotificationstobe senttoamunicipalitythatisexternaltothisIDP,thereferringmunicipalityshallfollowthe MunicipalDistrictofTaber&CountyofNewell 13 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|13 referralrequirementsoutlinedinthe MGA,andwhereapplicable,thosecontainedina relevantIntermunicipalDevelopmentPlan. 4.2.3AdministrativestafforrepresentativesfortheMDofTaberandCountyofNewellare encouragedtodiscuss,withoneanother,forthcomingStatutoryPlansandLandUseBylaws, includingamendments,whichmayimpactthePlanArea. 4.2.4AdministrativestafforrepresentativesfortheMDofTaberandCountyofNewellare encouragedtodiscusswithoneanotherforthcomingsubdivisionanddevelopment applicationsthatmayimpactlandswithinthePlanArea. 4.2.5Themunicipalitiesareencouragedtorefertoeachotherforcommentmajorlanduseor planningmattersthathavethepotentialtoimpacttheotherjurisdiction,evenifitinvolves landsthatmaynotbelocatedwithinthePlanArea. MunicipalDevelopmentPlans 4.2.6AnewlyproposedCountyofNewellMunicipalDevelopmentPlanoramendmentshallbe referredtotheMDofTaberforcommentpriortoapublichearing. 4.2.7AnewlyproposedMDofTaberMunicipalDevelopmentPlanoramendmentshallbereferred toCountyofNewellforcommentpriortoapublichearing. OtherStatutoryPlans 4.2.8AnewlyproposedCountyofNewellstatutoryplan(excludingaMunicipalDevelopmentPlan) oramendmentthatwillhaveanimpactonthePlanAreashallbereferredtotheMDofTaber forcommentpriortoapublichearing. 4.2.9AnewlyproposedMDofTaberstatutoryplan(excludingaMunicipalDevelopmentPlan)or amendmentthatwillhaveanimpactonthePlanAreashallbereferredtotheCountyof Newellforcommentpriortoapublichearing. LandUseBylaws 4.2.10AllLandUseBylawamendmentsintheCountyofNewellthataffectlandsinthePlanArea, shallbereferredtotheMDofTaberforcommentpriortoapublichearing. 4.2.11AllLandUseBylawamendmentsintheMDofTaberthataffectlandsinthePlanArea,shall bereferredtoCountyofNewellforcommentpriortoapublichearing. 4.2.12AllredesignationapplicationsaffectingthePlanAreashallbereferredtotheother municipalityforcommentpriortoapublichearing. DesignConcepts 4.2.14AlldesignconceptsinsupportofasubdivisionordevelopmentintheCountyofNewellthat willaffectlandsinthePlanAreashallbereferredtotheMDofTaberforcommentpriorto Councilresolution. 4.2.15AlldesignconceptsinsupportofasubdivisionordevelopmentintheMDofTaberthatwill affectlandsinthePlanAreashallbereferredtotheCountyofNewellforcommentpriorto Councilresolution. SubdivisionandDevelopment 4.2.16AllsubdivisionapplicationsforlandswithinthePlanAreashallbereferredtotheother municipalityforcommentpriortoadecisionbeingrendered. 4.2.17TheCountyofNewellshallreferalldiscretionaryusedevelopmentapplicationswithinthe PlanAreatotheMDofTaberforcommentpriortoadecisionbeingrendered. 4.2.18TheMDofTabershallreferalldiscretionaryusedevelopmentapplicationswithinthePlan AreatotheCountyofNewellforcommentpriortoadecisionbeingrendered. ResponseTimelines 4.2.19Therespondingmunicipalityshall,fromthedateofmailing,havethefollowingtimelinesto reviewandprovidecommentonintermunicipalreferrals: a)15calendardaysforalldevelopmentapplications, b)19calendardaysforsubdivisionapplications,and c)30calendardaysforallotherintermunicipalreferrals. 4.2.20IntheeventthateithermunicipalityortheCommitteedoesnotreplywithin,orrequestan extensionby,theresponsetimeforintermunicipalreferralsstipulatedinthisSection,itis presumedthattherespondingmunicipalityand/orCommitteehasnocommentorobjection tothereferredplanningapplicationormatter. ConsiderationofResponses 4.2.21Commentsfromtherespondingmunicipalityand/ortheCommitteeregardingproposed MunicipalDevelopmentPlans,otherstatutoryplans,andLandUseBylaws,oramendments toanyofthosedocuments,shallbeconsideredbythemunicipalityinwhichtheapplication isbeingproposed,priortoadecisionbeingrendered. MunicipalDistrictofTaber&CountyofNewell 15 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|15 4.2.22Commentsfromtherespondingmunicipalityand/ortheCommitteeregardingsubdivision anddevelopmentapplicationsshallbeconsideredbythemunicipalityinwhichtheapplication isbeingproposed,priortoadecisionbeingrenderedontheapplication. 4.3PlanValidityandAmendmentPolicies INTENT ThisPlanmayrequireamendmentsfromtimetotimetoaccommodateunforeseensituations,andto keepthePlanrelevant. POLICIES 4.3.1ThisPlancomesintoeffectonthedateitisadoptedbybothmunicipalities. 4.3.2AmendmentsshallbeadoptedbybothCouncilsusingtheproceduresoutlinedinthe MGA. Noamendmentshallcomeintoforceuntilsuchtimeasbothmunicipalitiesadoptthe amendingbylaw. 4.3.3ApplicationsforamendmentstothisPlanbypartiesotherthantheMDofTaberandthe CountyofNewell(e.g.landownersanddevelopers)shallbemadetobothmunicipalitiesalong withtheapplicablefeeasestablishedbyeachmunicipalityforprocessingamendmentstoa statutoryplan. 4.3.4AdministrativestaffshouldreviewthepoliciesofthePlanannuallyanddiscusslanduse matters,issuesandconcernsonanongoingbasis.Administrativestaffmaymake recommendationstotheirrespectiveCouncilsforamendmenttothePlantoensurethe policiesremainrelevantandcontinuetomeettheneedsofbothmunicipalities. 4.3.5AformalreviewofthePlanwilloccurwithin10yearsfromthedatetheIDPisadoptedby bothmunicipalities. MunicipalDistrictofTaber&CountyofNewell 16 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|16 5|DISPUTERESOLUTIONPOLICIES 5.1GeneralDisputeProcess INTENT Theintentofthedisputeresolutionprocessistomaximizeopportunitiesfordiscussionandreviewin ordertoresolveareasofdisagreementearlyintheprocess.Despitethebesteffortsofboth municipalities,itisunderstoodthatdisputesmayarisefromtimetotimeaffectinglandusewithinthe Planboundary.Thefollowingprocessisintendedtosettledisputesthroughconsensusandminimize theneedforformalmediation. POLICIES GeneralAgreement Themunicipalitiesagreethat: 5.1.1ItisimportanttoavoiddisputebyensuringthatthePlanisadheredtoasadopted,including fullcirculationofanypermitorapplicationthatmayaffectthemunicipalityasrequiredinthe PlanandpromptenforcementofthePlanpolicies. 5.1.2PriortothemeetingoftheCommittee,eachmunicipalitythroughitsadministration,will ensurethefactsoftheissuehavebeeninvestigatedandclarified,andinformationismade availabletobothparties.Staffmeetingsareencouragedtodiscusspossiblesolutions. 5.1.3TheCommitteeshoulddiscusstheissueordisputewiththeintenttoseekarecommended solutionbyconsensus. DisputeResolution Inthecaseofadispute,thefollowingprocesswillbefollowedtoarriveatasolution: 5.1.4Whenapotentialintermunicipalissuecomestotheattentionofeithermunicipalityrelating toatechnicalorproceduralmatter,suchasinadequatenotificationorprescribedtimelines, misinterpretationofPlanpolicies,oraclericalerrorregardingthepoliciesofthisPlan,either ƒǒƓźĭźƦğƌźƷǤ͸ƭLandUseBylaw,oranyotherplanaffectinglandsinthePlanarea,itwillbe directedtotheadministratorsofeachmunicipality.Theadministratorswillreviewthe technicalorproceduralmatterandifbothadministratorsareinagreement,takeactionto rectifythematter. 5.1.5ShouldeithermunicipalityidentifyanissuerelatedtothisPlanthatmayresultinadispute thatcannotbeadministrativelyresolvedunderSection5.1.4oranyotherissuethatmay MunicipalDistrictofTaber&CountyofNewell 17 IntermunicipalDevelopmentPlanBylawNo.1916&BylawNo.189917 Page|17 resultinadispute,themunicipalityshouldcontacttheotherandrequestthatan IntermunicipalDevelopmentPlanCommitteemeetingbescheduledtodiscusstheissue.The Committeewillreviewtheissueandattempttoresolvethematterbyconsensus. 5.1.6ShouldtheIntermunicipalDevelopmentPlanCommitteebeunabletoarriveataconsensus, theadministrationofeachmunicipalitywillscheduleajointmeetingofthetwoCouncilsto discusspossiblesolutionsandattempttoreachconsensusontheissue. 5.1.7ShouldtheCouncilsbeunabletoresolvethematter,eithermunicipality,mayinitiateaformal mediationprocesstofacilitateresolutionoftheissue. FilinganIntermunicipalDisputeundertheMunicipalGovernmentAct 5.1.8Inthecaseofadisputeinvolvingtheadoptionofastatutoryplan,LandUseBylawor amendmenttosuch,within30daysofadoption,themunicipalityinitiatingthedisputemay, withoutprejudice,fileanappealtotheMunicipalGovernmentBoardundersection690(1)of the MGA sothattheprovincialstatutoryrightandtimeframetofileanappealisnotlost. 5.1.9Theappealmaythenbewithdrawn,withoutprejudice,ifasolutionoragreementisreached betweenthetwomunicipalitiespriortotheMunicipalGovernmentBoardmeeting.Thisisto acknowledgeandrespectthatthetimerequiredtoseekresolutionormediationmaynotbe abletooccurwithinthe30dayappealfilingprocessasoutlinedinthe MGA. Note:Usingsection690(1)oftheMGAisthefinalstageofdisputesettlement,wherethemunicipalitiesrequest theMunicipalGovernmentBoardtointercedeandresolvetheissue.
