EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1. March 22, 2018 Meeting Minutes MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN that the minutes of the March 22, 2018 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission April 19, 2018 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-31/18 MOVED BY COUNCILLOR TRACY FYFE that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1. DP 2018013 - Lot 1, Block 1, Plan 1213430, SW 28-21-17 W4M School (Delegation 10:00 a.m.) The Development Clerk provided background information about the proposed permit application. C. Giesbrecht provided additional information about the application and responded to questions from MPC. He indicated that 2 school buses will bring 69 students to the school. MPC asked whether the number of students at the school might increase. C. Giesbrecht stated that it would not. County staff indicated that a condition could be added to the permit approval to set an upper limit to the number of students allowed at the school, above which the permit would need to be reconsidered. MPC asked whether renovations will be required to the existing church building to \\ accommodate the school setting and students. J. Peters indicated that some renovations will be required to make classrooms. Staff confirmed that permits will be needed for renovations. There was discussion about the location of the proposed school in this agricultural area and whether it was a suitable use. Concerns were expressed about crop spraying, ability to add to a nearby cattle operation, dust, and noise from the school ground. MPC inquired about the ability of the current septic system to support the additional use. Staff indicated that septic system requirements would be determined at the next stage of development. D. Clyne, adjacent landowner, was given the opportunity to speak to MPC and respond to questions. MPC asked the applicant how this application was different than previous applications submitted for the same use at this location. The applicants responded that they have looked at many different areas for a suitable location and this site fits their needs the best. P-32/18 MOVED BY COUNCILLOR TRACY FYFE that the Municipal Planning Commission APPROVE Development Permit 2018013, for the operation of a school, subject to the conditions outlined below. MOTION DEFEATED �# Page 2 of 5 Municipal Planning Commission April 19, 2018 P-33/18 MOVED BY COUNCILLOR WAYNE HAMMERGREN that the Municipal Planning commission REFUSE Development Permit 2018013 for the operation of a school, for the following reasons: 1. It was determined that the intensification of the church site (a 1-day per week use) with the addition of a school/student learning center (an additional 5 days per week) at this location is not suitable, as the impacts to the adjacent agricultural lands would interfere and materially affect the use and enjoyment of the adjacent lands due to increased dust and noise. 2. This application is not materially different from the previous application and does not mitigate previous reasons for refusal. MOTION CARRIED LEFT THE MEETING C. Giesbrecht, J. Giesbrecht, J. DP 2018014 - Lot 2, Block 1, Plan 0510040, Hamlet of Cassils Moved in attached garage The Development Clerk provided background information on the proposed permit application. MPC inquired about the need for a security deposit, since the garage did not require heating or plumbing. Staff indicated that the security amount was the minimum required for a moved -in building as per Land Use Bylaw requirements and that MPC had the discretion to reduce or remove the amount of security required for permit approval. P-34/18 MOVED BY COUNCILLOR TRACY FYFE that the Municipal Planning Commission APPROVE Development Permit 2018014, for the installation of a 364 ft2 (34 m2) attached garage with a variance to the setback from the road right-of-way, on lands legally described as Lot 2, Block 1, Plan 0510040, Hamlet of Cassils. This development approval is subject to the conditions outlined below. DP 2018014 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Hamlet Residential District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of May 10, 2018 (21-day appeal period) The development must be located as shown on the site plan approved with the application and submitted �) March 27, 2018. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. Page 3 of 5 Municipal Planning Commission April 19, 2018 b) Any additional development shall require prior approval of a separate permit application. c) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. d) That the following setbacks are maintained for this development: Front (north): 80 ft (24 m) Side (east and west): 5 ft (1.5 m) e) That the developer shall provide a $2500.00 security deposit, as the minimum required amount under County Land Use Bylaw. This deposit will be refunded when the County inspection agency submits the report stating that all work complies with Alberta Safety Codes requirements. f) That the developer must start construction before May 10, 2019. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. General Information for the Developer - Regulations & Codes The proposed development must comply with: a) The provisions pertaining to the Hamlet Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED 7. POST AGENDA ITEMS There were no post agenda items. 8. IN CAMERA There were no in -camera items. 9. INFORMATION ITEMS 9.1. Wheatland County - Proposed Land Use Bylaw Amendments, Bylaw # 2018-06 There were no comments or concerns about Wheatland County Bylaw #2018-06.
