EXCUSED FROM MEETING All members were present. 3. MINUTES 3.1. May 24, 2018 Meeting Minutes P-43/18 MOVED BY COUNCILLOR KELLY CHRISTMAN that the minutes of the May 24, 2018 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission June 7, 2018 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-44/18 MOVED BY COUNCILLOR HUBY KALLEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk responded to questions from MPC. MPC members provided information about the historical house being moved to the EID Park in Scandia, indicating that the house was built in 1907 and is being moved from Rainer. MPC added that they had sent a letter of support for the house move to the museum. ARRIVED AT MEETING M. Harbicht arrived at 10:07 a.m. 7. DEVELOPMENT PERMITS 7.1. DP 2018028 - Lot 1, Block 37, Plan 1610712, NE 28-21-13 W4M, Installation of three moved in multi -unit dwellings. The Development Clerk provided background information on the proposed permit application. There were no questions. P-45/18 MOVED BY COUNCILLOR BRIAN DE JONG That the Municipal Planning Commission APPROVE Development Permit 2018028, for the installation of two 4320 ft2 (401 m2) moved in four-plex dwellings and one 3840 ft2 (357 m2) three-plex dwelling on lands legally described as Lot 1, Block 37, Plan 1610712, NE 28-21-13 W4M. This development approval is subject to the conditions outlined below. DP 2018028 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2) and Standards of Development (Schedule 3) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of June 28, 2018 (21-day appeal period). to] Page 2 of 6 Municipal Planning Commission June 7, 2018 b) The development must be located as shown on the site plan approved with the application and submitted May 11, 2018. It must be built according to the description provided with this approval. Any changes shall require the written approval of the - Development Authority. c) Any additional development shall require prior approval of a separate permit application. d) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. e) That there is a 10 ft (3 m) separation distance between the new dwelling and any other buildings or structures on the site. f) That the developer shall provide a $5000.00 security deposit for each building, as the minimum required amount under County Land Use Bylaw 1892-17. Once the development has passed inspection by the County Safety Codes Officer (SCO), the security deposit will be refunded. g) The developer must start construction before June 28, 2019. In the event that this date cannot be met, the developer may be required to apply for a new permit. h) That the following setbacks on all sides are maintained for this development: Front (west): 100 ft (30 m) Side (north and south): 100 ft (30 m) Rear (east): 25 ft (7.6 m) The proposed development must comply with: a) The provisions pertaining to the Agriculture District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. C" b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED 7.2. DP 2018031 - Lot 42, Plan 9411176, Lake Newell Resort, Esthetics Business The Development Clerk provided background information on the proposed permit application. MPC inquired about the hours of operation for the business. Staff indicated that the business hours provided in the permit were at the request of the applicant. P-46/18 MOVED BY COUNCILLOR TRACY FYFE That the Municipal Planning Commission APPROVE the Home Occupation Permit 2018031 to establish an Esthetics business, on lands legally described as Lot 42, Plan 9411176, Lake Newell Resort. This development approval is subject to the conditions outlined below. DP 2018031 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Hamlet Residential District (Schedule 2), Standards of Development (Schedule 3) and Home Occupations (Schedule 4 �) Section 9), as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Page 3 of 6 Municipal Planning Commission June 7, 2018 Conditions of Development Approval a) This approval is effective as of June 28, 2018 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted May 10, 2018. Any changes shall require the written approval of the Development Authority. c) Any additional or intensification of this development shall require prior approval of a separate permit application. d) That there are no more than 1 resident employees involved in the operation of this business. The proposed development must comply with: a) The provisions pertaining to the Hamlet Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED 7.3. DP 2018032 - Lot 1, Block 2, Plan 1310356, NW 16-19-15 W4M, Operation of an Animal Attraction business (White Barn Fun Farm), installation of a shed to be used for the business The Development Clerk provided background information on the proposed permit application. MPC asked the applicant about the adjacent landowner's concern regarding cattle. The applicant indicated that the area of concern is in the southeast corner of the property, where no petting animals would be allowed. MPC asked for clarification regarding the permit being issued for only one (1) year. Staff indicated that, through discussions with Municipal Services regarding concerns about traffic and dust control, and after additional discussion with the applicants regarding how the business might change or grow through the 1st year of operation, it was decided that a one-year permit would best suit the applicants' needs. Any adjustments to the operation required by the applicant after the 1 sr year would be included in the new permit application. Staff advised MPC that Council could waive the permit fee for the new permit. There was further discussion regarding increased traffic, dust abatement, hours of operation, and the benefits of a 1-year vs 3-year vs permanent development permit. The applicant was requested to record the number of visitors that attended their business over the course of the year, so that staff could ensure the future permit would meet their needs. P-47/18 MOVED BY COUNCILLOR KELLY CHRISTMAN That the Municipal Planning Commission APPROVE the 1-year Home Occupation Permit 2018032 to operate an animal attraction business, on lands legally described as Lot 1, Block 2, Plan 1310356, NW 16-19-15 W4M. This development approval is subject to the conditions outlined below. Page 4 of 6 Municipal Planning Commission June 7, 2018 DP 2018032 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Agricultural District (Schedule 2), Standards of Development (Schedule 3) and Home Occupations (Schedule 4 Section 9), as specified in the County of Newell Land Use Bylaw 1892-17. Conditions of Development Approval a) This approval is effective as of June 28, 2018 (21-day appeal period). This permit is in effect for one year, expiry June 28, 2019. b) The development must be located as shown on the site plan approved with the application and submitted May 11, 2018. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) Any additional development shall require prior approval of a separate permit application. d) That there are no more than 2 resident employees involved in the operation of this business. e) That the only advertising being permitted on the property be limited to one freestanding sign of 6 ft2 (.06 ml) to be installed 10 ft (3 m) from the property line. f) That the shed must follow these setbacks: Front (west): 100 ft (30 m) Sides (north & south): 25 ft (7.5 m) Rear (east): 25 ft (7.5 m) g) That all buildings/structures must have a separation distance of 10 ft (3 m) h) That the business operates only between 10 a.m. and 7 p.m. i) That the business adhere to the guidelines set out by Alberta Health Services animal attraction operations. The proposed development must comply with: a) The provisions pertaining to the Agriculture District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable.
