July 5, 2018 Meeting Minutes MOVED BY COUNCILLOR WAYNE HAMMERGREN that the minutes of the July 5, 2018 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED Municipal Planning Commission July 19, 2018 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-61/18 MOVED BY COUNCILLOR ELLEN UNRUH that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT PERMITS 6.1. DP 2018043 - Lot 8, Block 4, Plan 0512650, NW 19-18-14 W4M, Operation of a Medical Marijuana Production Facility P-62/18 MOVED BY COUNCILLOR ANNE MARIE PHILIPSEN to LIFT item from the table. The Manager of Planning & Development provided background information on the proposed application. She confirmed that no additional submissions have been received since this matter was last dealt with during the July 5, MPC meeting. There were no questions. MOTION CARRIED P-63/18 MOVED BY COUNCILLOR TRACY FYFE That the Municipal Planning Commission APPROVE Development Permit 2018043 for the operation of a medical marijuana production facility and a 614 f12 (57 m2) addition to building 1, on lands legally described as Lot 8, Block 4, Plan 0512650, NW 19-18-14 W4M. This development approval is subject to the conditions outlined below. DP 2018043 is Approved for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Rural Industrial District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw #1892-17. 3. Conditions of Development Approval: a) This approval is effective as of August 9, 2018 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted June 5, 2018. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. c) Any additional development shall require prior approval of a separate permit application. 4 Page 2 of 5 Municipal Planning Commission July 19, 2018 d) That the applicant or owner provide a copy of the current license for all activities associated with the medical marijuana production as issued by Health Canada, prior to production commencing at the facility. e) That there is no outdoor storage of goods, materials or supplies. f) That the applicant provide 34 parking spots. g) That the development must include equipment designed and intended to remove odours and particulates from the air where it is discharged from the building as part of the ventilation system. h) That access can be provided for Emergency Services vehicles to the east, west and south sides of the building. The proposed development must comply with: a) The provisions pertaining to the Rural Industrial District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED 6.2. DP 2018067 - Block 2, Plan 8311087, NW 8-19-14 W4M, Approval of existing structure, construction of additions. Operation of an existing Farm Machinery, Sales, Rental and Service Company The Manager of Planning & Development provided background information on the proposed application. There were no questions. P-64/18 MOVED BY COUNCILLOR ELLEN UNRUH That the Municipal Planning Commission APPROVE Development Permit 2018057 for an as -built 7440 ft2 (691 m2) building and construction of a 4400 ft2 (409 m2) addition and the operation of an existing farm machinery, sales, rental and service company, on lands legally described as Block 2, Plan 8311087, NW 8-19-14 W4M. This development approval is subject to the conditions outlined below. DP 2018057 is Approved for the following reasons: 1. The proposed development complies with both the Municipal Development Plan and the Intermunicipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Rural Business District (Schedule 2), as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of August 9, 2018 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted June 25, 2018. It must be built according to the description provided with this approval. Any changes shall require the written approval of the Development Authority. (P Page 3 of 5 Municipal Planning Commission July 19, 2018 c) Outdoor storage is permitted with this approval. d) The applicant will install one 110 ft2 (10 m2) sign to the building e) There will be a minimum of 19 parking spaces. f) Any additional development shall require prior approval of a separate permit application. g) That the following setbacks on all sides are maintained for this development: Front (south): 35 ft (11 m) variance from 100 ft (30 m) Side (east): 25 ft (7.6 m) Side (west): 80 ft (24 m) variance from 100 ft (30 m) h) The developer must start construction before August 9, 2019. In the event that this date cannot be met, the developer may be required to apply for a new permit. The proposed development must comply with: a) The provisions pertaining to the Rural Business District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED 7. OTHER BUSINESS 7.1. Proposed Amendments to Land Use Bylaw The County Planner provided background information on the proposed amendments. Cannabis MPC inquired how retail cannabis is controlled under Federal and Provincial regulations and what the County is able to regulate. The County Planner responded that Federal regulations require that a Cannabis store must be stand- alone and separate from other businesses. She added that Provincial regulations include setback distances from hospitals, schools and MR parcels. Municipal controls include hours of business and setback requirements from additional land uses like daycare facilities. MPC asked how other municipalities were dealing with cannabis regulations. The County Planner commented that each municipality has the ability to set their own requirements in the land use bylaw, as reflected by the community. Discussion followed regarding hours of operation, signage, store locations and setback waivers. MPC requested that information about cannabis be discussed with the other municipalities in the County and then reviewed at the next Joint Services meeting. Individual Alternative Energy Installations (Solar) The County Planner suggested that the maximum height for a solar array development be changed from 8 ft to 15 ft as per staffs recommendation. 0 Page 4 of 5 Municipal Planning Commission July 19, 2018 Religious Assembly and Schools The County Planner recommended that the definition for "Church" be amended to "Religious assembly" in order to better reflect the variety of religious communities in the County. She added that, as per Council's request, a condition of application would be that this type of development must be located on a paved or hard - surfaced road and must include site suitability information such as soil tests for septic installation. MPC suggested that community halls be included in this type of development and that all 3 be removed as a use from the Agricultural district. The Planner commented that these types of uses could be classified as "Public Gatherings" and that they could be added to the Public Service district so that rezoning would be required prior to submission of a development permit application. 8.
