EXCUSED FROM MEETING P-65/18 MOVED BY COUNCILLOR TRACY FYFE that Councillors Anne Marie Philipsen and Wayne Hammergren be excused from the meeting. MOTION CARRIED 3. MINUTES 3.1 July 19, 2018 Meeting Minutes P - /18 MOVED BY REEVE MOLLY DOUGLASS that the Council Meeting minutes be adopted as presented. MOTION CARRIED Municipal Planning Commission August 9, 2018 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-67/18 MOVED BY COUNCILLOR HUBY KALLEN that the agenda be adopted as presented. MOTION CARRIED 6. DEVELOPMENT REPORT The Development Clerk was available to respond to any questions. 7. SUBDIVISIONS 7.1 2018-0-106 - NE1/417-15-13-W4M, To create one new parcel approximately 4.84 acres (1.96 ha) in size, containing an existing residence and improvements, from a previously unsubdivided quarter section for residential use. The County Planner provided background information on the proposed application. MPC asked if the balance of the property was sold, would the new landowners have to access it through the subdivided parcel. The County Planner replied that access would be provided to the remnant parcel along the County road allowance to the east of the property. P-68/18 MOVED BY COUNCILLOR BRIAN DE JONG THAT the County Residential subdivision of NE1/4.17-15-13-W4M (Certificate of Title 181 053 200+1) to create one new parcel approximately 4.84 acres (1.96 ha) in size BE APPROVED subject to the following: CONDITIONS: 1. That, pursuant to Section 654(1)(d) of the Municipal Government Act, all outstanding property taxes shall be paid to the County of Newell. MOTION CARRIED 8. DEVELOPMENT PERMITS 8.1 DP 2018051 (A) - Lot 1, Block X, Plan 7811556, NW 17-20-14 W4M, Approval for existing ftm elt�r, variance to side yard setback The Development Clerk provided background information on the proposed application. There were no questions. P-69118 MOVED BY REEVE MOLLY DOUGLASS That the Municipal Planning Commission APPROVE Development Permit 2018051 (A), for the approval of an as -built 170 ft2 (15.8 C_ �5 Page 2 of 6 Municipal Planning Commission August 9, 2018 m2) accessory building, on lands legally described as Lot 1, Block X, Plan 7811556, NW 17-20-14 W4M. This development approval is subject to the conditions outlined below. DP 2018051 (A) is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential District (Schedule 2) and Standards of Development (Schedule 4) as specified in the County of Newell Land Use Bylaw 1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval: a) This approval is effective as of August 30, 2018 (21-day appeal period) The development must be located as shown on the site plan approved with the application and submitted June 20, 2018. Any additional development shall require prior approval of a separate permit application. b) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. c) That the following setbacks are maintained for this development: Front (west): 100 ft (30 m) Side (north): 12.6 ft (3.8 m); variance from 25 ft (7.6 m) Side(south): 25 ft (7.6 m) The proposed development must comply with: a) The provisions pertaining to the Acreage Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable. MOTION CARRIED 8.2 DP 2018052 (A), - Lot 2, Block X, Plan 7811566, SW 17-20-14 W4M, Approval of as -built with variance to side yard setback The Development Clerk provided background information on the proposed application. There were no questions. P-70/18 MOVED BY COUNCILLOR HUBY KALLEN That the Municipal Planning Commission APPROVE Development Permit 2018052 (A), for the approval of an as -built 1270 ft2 (118 m2) shop, on lands legally described as Lot 2, Block X, Plan 7811556, SW 17-20-14 W4M. This development approval is subject to the conditions outlined below. DP 2018052 (A) is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Acreage Residential District (Schedule r l 2) and Standards of Development (Schedule 4) as specified in the County of Newell \J Land Use Bylaw 1892-17. MOTION CARRIED 8.3 DP 2018061 - Lot 7 & 8, Block 12, Plan 6819ER, Tilley, Approval for as -built 0dwelling, construction of an addition The Development Clerk provided background information on the proposed application. There were no questions. P-71118 MOVED BY COUNCILLOR ELLEN UNRUH That the Municipal Planning Commission APPROVE Development Permit 2018061 for approval of a 468 ft2 (43 m2) as -built dwelling and the construction of a 1490 ft2 (138 m2) addition on lands legally described as Lot 7 & 8, Block 12, Plan 6819ER, Tilley. This development approval is subject to the conditions outlined below. DP 2018061 is Approved for the following reasons: 1. The proposed development complies with the Municipal Development Plan. 2. The Development Authority is satisfied that the proposed development is suitable for the purpose for which it is intended under the Hamlet Residential District (Schedule 2) as specified in the County of Newell Land Use Bylaw #1892-17. 3. No objections have been received from adjacent landowners or referral agencies with respect to the proposed development. Conditions of Development Approval a) This approval is effective as of August 30, 2018 (21-day appeal period). b) The development must be located as shown on the site plan approved with the application and submitted July 10, 2018. It must be built according to the description �\ 1 provided with this approval. Any changes shall require the written approval of the Development Authority. Page 4 of 6 Municipal Planning Commission August 9, 2018 c) Any additional development shall require prior approval of a separate permit application. d) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. e) That the following setbacks on all sides are maintained for this development: Front (southeast): 10 ft (3 m); variance from 20 ft (10 m) Side (north & south): 5 ft (1.5 m) Rear (west): 20 ft (10 m) f) That the developer must start construction before August 30, 2019. In the event that this date cannot be met, the developer must apply for an extension and may be required to apply for a new permit. The proposed development must comply with: a) The provisions pertaining to the Hamlet Residential District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw 1892-17. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes and Safety Codes, where applicable.
