~ Minutes of Municipal Planning Commission Meeting
July 25, 1995
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was held in
the County office at Brooks, Alberta on Tuesday, July 25, 1995 commencing at 10:00 a.m.

2. Minutes
Minutes of the June 27, 1995 meeting were presented to the Commission. Moved by B. Bergen

The Chairman called for Post Agenda Items.
4. Adoption of the Agenda
Moved by L. Buday that the agenda be adopted as amended. Carried.

6.2 Steve Kowal -Lot 2. Block 1, Plan 8211419 NE 35-18.15.4 -Order of Compliance
Moved by Councillor Loewen that we proceed with the enforcement of the above noted Order
of Compliance. Carried.
6. Delegations
1. Carl Fortin -Permit # 1401 -Parcel A. Block 1, Plan 8183 F.G. - SE 1-19.15-4
Mr. Fortin was in attendance and presented information on Permit #1401 which requests the
location of a truck storage yard on Parcel A, Block 1, Plan 8183 F.G. • SE 1-19.15-4 which is
in an Urban Fringe district. His presentation included a letter from adjacent landowners, Blake
and Brenda Miller, who had no objections to his development. Moved by Councillor Loewen that
Permit #1401 be approved subject to the Development Control Officer receiving no adverse
comments from the Town of Brooks. Carried.
2. Harold Torkelson -Permit #1398 -lot 8A Block 6 Plan 1217 B.A., Permit #1399 • Lot 8
Block 6 Plan 1217 B.A., Permit #1400 -Lot 2 Block 7 Plan 1217 B.A.
Mr. Torkelson was in attendance and presented information on the above development permit
applications.
3. Neil & Una Murray -Land Use Change - SW 18-19-15-4 -Agriculture to Country Residence
Mr. & Mrs. Murray were in attendance and presented information to the Commission on the
above Land Use Change application. Moved by B. Bergen that we recommend to Council the
approval of this land use change from agriculture to country residential. Carried.

The Commission recessed for lunch from 12:00 p.m. to 1:15 p.m.

Amendments to Minutes of the July 25, 1995 M.P.C. Meeting

Permit #1398 • Lot 8A Block 6 Plan 1217 B.A. (Patricia)
Moved by B. Bergen that we approve this Permit subject to the fallowing conditions:
1. re-stucco entire exterior,
2. re-roof house,
3. install new windows,
4. build attached garage and entry on north side,
5. provide "Letter of Credit" in the amount of 57,500.00 (seven thousand five hundred dollars),
6. paint all exterior woodwork,
7. install new #ascia and soffits,
8. front set-back of house to be equal to front set-back of adjacent homes, side and rear set-backs
to be minimum of 1.5 metres and 3 metres respectively,
9. re-landscape lot,
10. proper site plan to be provided,
11. interior re-decorating,
12. parge basement.
All of the above listed development improvements are to be completed by November 30, 1995. Carried.
Permit #1399 Lot 2 Block 7 Plan 1217 B.A. (Patricia)
Moved by Councillor Loewen that we approve this Permit subject to the following conditions:
1. re•roof house,
2. parge basement,
3. paint all exterior woodwork,
4. install new fascia and soffits,
5. proper site plan to be provided,
6. minimum set-back requirements to be met,
7. interior re-decorating.
All of the above listed development improvements are to be completed by November 30, 1995. Carried.
Permit X1400 Lot 1 & Pt. Lot 2 Block 9 Plan 2819 D.B. (Patricia)
Moved by Councillor Scheuerman that we approve this Permit subject to the following conditions:
1. basement to be parged,
2. re-roof entire house,
3. install new fireplace where original had been,
4. re-roof existing garage,
5. paint all exterior woodwork on house and garage,
6. install metal fascia and soffits,
7. provide proper site plan,
8. front setback of house to 6e equal to front setback of adjacent homes, side and rear setbacks
to be minimum of 1.5 metres and 3 metres respectively,
9. re-landscape lot,
10. interior redecorating.
All of the above listed development improvements are to be completed by November 30, 1995. Carried.

Mr. Salonka was in attendance and presented information on the above subdivision to the
Commission.

Moved by ergen that we approve this permit and waive the front yard setback which is to
be at least equa o the distance of the front yard setback on the adjacent property subject to
the applicant submi ' g a detailed plot plan; subject to the applicant meeting all other setback
requirements; and subje to the applicant completing the following improvements:

2. install metal fascia and soffits,

Moved by L. Buday that the above orders dated July 10, 1995 be amended such that the land
owner be given the option to fill the excavation and restore the site to its ordinal condition or
fence the entire excavations in such a manner that would cause the excavations to be
inaccessible to the public by August 11, 1995. Carried.

Moved by Councillor Loewen that we approve this permit subject to the applicant providing
pictures of the mobile home, subject to the appearance of the mobile home being acceptable to
the Development Control Officer and subject to the mobile home meeting CSA 2240 Standards.

Moved by Councillor Loewen that this permit be denied as the proposed development does not
meet the characteristics of the surrounding neighbourhood. Carried.

Moved by L. Buday that a letter be sent to Mr. Graham explaining that the Rural Residential By-
law amendment did not proceed, and informing Mr. Graham of his options. Carried.
2. 95 SE 54 -Portion of SW 13-19-14-4 - DOHERTY. Guy W. & Nancy Lee
Moved by B. Bergen that we recommend to Council the denial of this subdivision as the zoning
of the property is not Country Residential. Carried.
3. 95 SE 58 -Lot 2 Plan 8610237 - LUKYE, Edward and Connie
Moved by Councillor Scheuerman that we recommend to Council the denial of this subdivision as
,,, it does not meet the requirements of the Cassils Area Structure Plan, that the minimum lot size
requirements are not met and that the subdivision poses access problems. Carried.
4. 95 SE 59 -Lot 1 and E'/: Lot 2 Block E Plan 8111866 - KAUFMANN, Dominik and Carol
Moved by B. Bergen that we recommend to Council the approval of this subdivision. Carried.
10. Development Resort
• ~ The Development Control Officer presented the report for June 22, 1995 to July 19, 1995.
Moved by Councillor Scheuerman that we accept this report. Carried.
11. Corresaondence
1. Alberta Planning Board -Appeal respecting the Proposed Subdivision of NW 28-19.13.4
A letter regarding noted appeal which is to be held on Thursday, August 10, 1995 was presented
to the Commission as information.

Letter regarding the above was presented to the Commission as information.
12. Other Business

Moved by L. Buday that Mr. Yanke be informed that his above conditionally approved subdivision
application will lapse in the near future and that he be issued an Order to remove the mobile
home from the property or fulfil the conditions of the subdivision approval. Carried.

o ed by B. Bergen that we recommend to Council the approval of this subdiwsion sublect to
the applicant entering into any required water agreements with the E.I.D., subject to any
conditions of other authorities commenting on the subdivision and subject to the applicant
constructing an access off the road allowance to provide access to the remnant parcel. Carried.
4. Municipal Development Plan
r- The Commission was updated on a meeting in which a process to put together a Municipal
Development Plan was opposed.

The Committee toured the site of proposed subdivision 95 SE 15.
Moved by B. Bergen that we recommend to Council the approval of this subdivision subject to:
1. Proposed lots 1 to 7 in Block 3 being increased in depth to 90 meters
2. The avenue north of Spencer Avenue being extended straight west through proposed Lot 1
Block 1 thereby creating a stub street
3. Proposed Lot 1 Block 4 now having its southerly boundary situated exactly as far south as
the south boundary of proposed Lots 1 to 7 in Block 3; and that its northerly boundary be
exactly as far north as the northerly boundary of lots 1 to 7 in Block 3 as per Clause (1)
above, such that the depth of Lot 1 block 4 will also be 90 meters.
4. Proposed Lot 2 Block 4 now having its north boundary situated exactly as far north as the
south boundary of the avenue north of Spencer Avenue as per Clause 121 above.
5. That the street running north and between proposed Lot 1, Block 3 and Lot 1 Block 4 extend
to the north boundary of Lot 1, Block 3 and Lot 1 Block 4 as per Clause 111 and Clause 12)
above.
~ 6. Spencer Avenue being extended straight west to proposed Lot 9 Block 4 as shown on a
revised proposed plan of subdivision, with a turnaround constructed at the new west end of
Spencer Avenue.
7. Lots 9 to 13 Block 4 as shown on a revised plan of subdivision are to be included provided
they are a minimum of 0.20 hectares in area, thereby making this approval for 14 parcels.
8. The applicant providing utility companies with any required easements.
9. All applicable and required water agreements being entered into with the Eastern Irrigation
District.
10. A service agreement being entered into with the County of Newell No. 4
