January 30, 1996 The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was held in the County Office at Brooks, Alberta on Tuesday, January 30, 1996 commencing at 10:00 a.m. Members Present Councillors V. Excused from Meetino All members were in attendance at this meeting. ,~- 1 ~._..,. ... . 2. ,11J~7, Minutes Minutes of the December 19, 1995 meeting were presented to the Commission. Moved by Councillor Baksa that we adopt these minutes as circulated. Carried. 3. Call for Post Agenda Items The Chairman called for post agenda items. 4. Adoption of Agenda Moved by J. Doerksen that the agenda be adopted as amended. Carried. 5. Deleoations 1. James Van Dam- 95 NL 72 - NW 30-17-13-3 -Stove Kendall The delegation was in attendance and presented a revised drawing for the proposed subdivision. January 30, 1996 Page 1 Arrived at Meeting Councillor Scheuerman arrived at the meeting at 10:18 a.m. Moved by Councillor Scheuerman that we recommend to Council the approval of this subdivision subject to the applicant entering into any required water andlor easement agreements with the E.I.D., and subject to a deferred reserve caveat being placed on the subdivided parcel. Carried. 2. Randy Baksa -Permit #1478 -Mobile Home Park - SW 1-19-14-4 Councillor Baksa declared a pecuniary interest in this Permit and excused herself from discussion and voting on this item and left the Council Chambers at 10:48 a.m. The delegation was in attendance and presented information on this Permit. At the next meeting, the delegation will bring information regarding the standards to be used for the construction of the water system, sewer system and internal roads, along with information stating that these standards are sufficient. ~i .... Russ BelancLerlDon Draper • Land Use Change - 2429 GB -Urban Fringe to Country Residential The delegation was in attendance and provided information regarding this proposed Land Use Change. Ray Grimson, from Lakeside, was in attendance and provided information and support for this application. January 30, 1996 Page 2 ~ Dale Nelson, of the Palliser Health Authority, was in attendance and expressed the Health Authority's concerns and opposition to this Permit. Moved by Councillor Baksa that we approve this Permit subject to the applicant adhering to the Code of Practice for the safe and economic handling of animal manures, especially in regard to the following as outlined in a letter dated January 8, 1996 from Alberta Agriculture, Food & Rural Development to County of Newell Development Control Officer, Karen Walde: a) solid manure storage. b) catch basins being designed suitably for the hydrological data of the Brooks area and landscaping to be provided with an acceptable grade such that all surface run-off is directed into these catch basins. c) irrigation and all surface waters are to be protected from any feed lot run-off andlor materials discharged from the catch basins. d) proper nutrient management. Carried. 5. Darren Visser -Land Use Change -Block 6 Plan 7410106 from Countrv Residential to Country Residential 2 Moved by Councillor Baksa that we recommend to Council the approval of this Land Use Change. Carried. 6. Reid Johnson -Area Structure Plan - SW 10.19-14-4 The delegation was in attendance and presented an outline plan for the SW 10-19-14-4. Moved by Councillor Baksa that we recommend to Council the acceptance of this outline plan as sufficient until Phases 1 & 2 of the proposal are complete, at which time any further development of the quarter section would require an Area Structure Plan. Carried. 6. Business from Minutes 14-1 Mobile Home vs Modular Home At this time, no recommendations will be made for changes to the provisions in the Land Use By-law regarding this matter. Permits 1. #1476 -John Straub -Single Family Dwelling - SW 16.17-12-4 - Tilley Moved by Councillor Scheuerman that we approve this Permit and waive the west side-yard requirement to 15 metres. Carried. 2. #1479 -Brooks Windshield Reoair -Plan 3971 Block S in SE 8-19-14-4 -Brooks Moved by A. Zagorsky that we approve this Permit. Carried. 3. #1480 - 616417 Alberta Ltd. -Mobile Home -Plan 9512204 Block 1 Lot 2 ~t1 in SW 10-19-14-4 -Brooks Moved by J. Doerksen that we approve this Permit. Carried. 8. Home Occupation Licences There were no Home Occupation Licences. 9. Land Use Changes 1. Darren Visser -Block 6 Plan 7410106 (SE 3-19.14-41 This item was dealt with under Delegations. 2. Marinus Jacobson - SE 16.20-14-4 -from Agriculture to .Country Residential Moved by J. Doerksen that we recommend to the applicant that he apply for subdivision approval of this parcel and that the Municipal Planning Commission, at that time, will recommend approval of the subdivision and allow the parcel to remain zoned Agriculture by waiving the minimum parcel size provision for an agricultural parcel. Sherryn & Carl Kern - SW 20-20.15-4 -from Agriculture to Country Residential 2 Moved by Councillor Scheuerman that we recommend to the applicant that they apply for subdivision approval of this parcel and that the Municipal Planning Commission, at that time, will recommend approval of this subdivision and allow the new parcel to remain zoned agriculture by waiving the minimum parcel size provision for an agricultural parcel. Carried. 10. Subdivisions 1. 96 NL 01 -Secs. 29, 30, 31 & 32-19-14-4 -Young IrenelE.I.D Moved by A. Zagorsky that we recommend to Council the approval of this subdivision subject to the following conditions: that the applicant enter into a Development Agreement with the County that would provide a road to County standards to access proposed parcel 5 and that would ensure access to all parcels; and that proposed parcel 4 be consolidated with Block 1 Plan 8910626. Carried. 2. 96 NL 02 • NW 36-17-17.4 - 361128 Alberta Ltd. Moved by Councillor Baksa that we recommend to Council the approval of this subdivision subject ~,..., to the applicant entering into a Domestic Water Agreement with the E.I.D. Carried. 11. Development Report There were no development permits for the period December 14, 1995 to January 24, 1996. 12. Correspondence There was no correspondence. 13. Other Business 1. Area Structure Plan - SW 10-19-14-4 -Johnson, Reid -- t ~....' This item was dealt with under delegations. 14. Post Agenda Items 1. 95 SE 28 - SE 25-16.16.4 -Graham, George Moved by J. Doerksen that we recommend to Council the approval of this subdivision subject to the following conditions: only Lot 1 being subdivided; Lot 1 being extended to include the entire dug-out; that the applicant enter into a Domestic Water Agreement with the E.I.D.; and that the applicant enter into a Development Agreement with the County ensuring access to bath the proposed parcel and the remnant parcel. Carried. 2. Permit #1481 -Temporary Placement of Unserviced Mobile Home NW 15.19-14.4 - Yanke Harvey Moved by J. Doerksen that we approve this Permit and that it be valid until April 30, 1996. Carried. 15. Question PeriodlNotice of Motion A question period was held. 16. Adjourn Moved by Councillor Baksa that the meeting adjourn at 5:40 p.m. Carried.
