Minutes of Municipal Planning Commission Meeting
February 27, 1996
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was held in
the County Office at Brooks, Alberta on Tuesday, February 27, 1996 commencing at 10:00 a.m.

All members were in attendance at this meeting.
2. Minutes
Minutes of the January 30, 1996 meeting were presented to the Commission. Moved by J.
Doerksen that we adopt these minutes as amended. Carried.
3. Call for Post Agenda Items
The Chairman called for post agenda items.
4. Adoation of Agenda
Moved by Councillor Scheuerman that the agenda be adopted as amended. Carried.

5. Delegations
1. Keith CrowderlHarvey Jager - Jager Develoaments & Craig Lynch - R.C.M.P.
a) Permit #1483 - Countrv Music Jamboree • NE 6-18-14-4
The above-noted delegation was in attendance to discuss Jager Development's proposed Country
Music Jamboree to be held June 28 • July 1, 1996.
The Commission feels a Development Permit is not the correct document for a proposed Country
Music Jamboree and the following motion was made: Moved by Councillor Baksa that we
recommend to Council the approval of this event subject to the applicant ensuring that all
required emergency personnel, including police and ambulance, will be available; subject to the
applicant providing proper sanitation systems; subject to the applicant ensuring that the
transportation systems into the concert site will be adequate and maintained as required; subject
to the applicant constructing the road into the concert site to County standards as this road will
form part of the Lake Newell Resort infrastructure; and subject to any other conditions to be set
by County Council and the County of Newell. Carried.

b) Land Use Change •Twp. 18 Rge. 14 &Twp. 18 Rge. 15
Agricultural to Resort Multi-Family and Resort Commercial
The delegation provided information on this proposed land use change. Moved by Councillor
Baksa that we recommend to Council the approval of this land use change. Carried.
c) Permit #1482 -North American Gem Corporation -Ammonite Mine - NW 13-18-i8-4
Keith Crowder presented information, on behalf of the North American Gem Corporation, regarding
the above-noted permit. Moved by Councillor Scheuerman that we approve this permit subject
to the applicant receiving any required approvals, permits, or certificates from applicable
regulatory bodies, including reclamation certificates. Carried.

2. Randy Baksa -Permit #1478 -Mobile Home Park - SW 1.19-14-4
Councillor Baksa declared a pecuniary interest in this permit and excused herself from discussion
and voting on this item and left the Council Chambers at 11:45 a.m.
The delegation was in attendance and present further information on this permit.
Moved by A. Zagorsky that we approve this permit subject to the applicant's water and sewer
systems meeting the standards as set out in letters received from Crawling Valley Contractors
Ltd. and UMA Engineering Ltd., respectively. Carried.
Councillor Baksa returned to the Council Chambers and resumed participation in the meeting at
11:55 a.m.

The Commission recessed for lunch from 11:55 a.m. - 1:15 p.m.

3. Jim Gowans -Alberta Pig Company -Permit I~~4~8'
Intensive Livestock Operation - Parcel A Plan 7711364 (Secs. 13,18 & 24-18.13-4)
The delegation was in attendance and presented information on this permit, which includes a
6300 feeder pig operation. Moved by Councillor Scheuerman that we approve this permit subject
to the applicant receiving a Certificate of Compliance from Alberta Agriculture, and subject to the
applicant obtaining a land use change that would change the zoning of the Urban Fringe portion
of the proposed parcel to Agricultural. Carried.
6. Business from Minutes

This item remained tabled.
13-1 Home Occupation Licence Renewals
Moved by J. Doerksen that we continue to obtain licence renewals. Carried.

Moved by Councillor Baksa that we approve this Permit. Carried.

Moved by J. Doerksen that we table this item for further information. Carried.
8. Home Occupation Licences
There were no Home Occupation Licences.
9. Land Use Changes

1. Ramer Ranches Ltd. - SW 28-20-14-4 -Urban Fringe to Country Residential
Moved by Councillor Scheuerman that we recommend to Council the approval of this land use
change. Carried.
10. Subdivisions
There were no Subdivision Applications.
11. Development Reuort
The Development Control Officer presented her report for January 25, 1996 to February 21,
1996. Moved by Councillor Baksa that we accept this report. Carried.
12. Correspondence
1. Manufactured Housing Association -Manufactured Housing
Letter from the Manufactured Housing Association regarding information on manufactured housing
was presented to the Committee as information.

`~ 2. M.D. of Willow Creek - Requirement of Subdivision in Place of Irrigation Easements
Copy of a letter from the M.D. of Willow Creek, to the Honourable Tom Thurber, Minister of
Municipal A#fairs, expressing concern over a recent ruling in the County of Lethbridge that
required a subdivision to achieve access to an irrigation system instead of an easement, was
presented to the Committee as information.
3. Minister of Municipal Affairs -Draft #2 Land Use Policies
This item will be brought back to the next Municipal Planning Commission meeting.
13. Other Business
1. Proposed Land Use By-law Amendments
a) Dwelling Units Per Parcel
This item will be reviewed again at the next Municipal Planning Commission meeting.
~^ b) Agricultural Residence Parcels Per Quarter
The Planner will draft a proposal for the next meeting.
c) Moved•in Dwelling as a Discretionary Use
A proposal will be drafted for the next meeting.
2. Intensive Livestock Operations -Code of Practice
A proposed By-law, which would incorporate the Code of Practice into the County of Newell Land
Use By-law, will be brought to the next meeting.

3. Permit #1475 -Lakeside Feedlot Expansion Appeal "'

The Commission was informed that an appeal has been received against Permit #1475 and that
the appeal will be heard on March 14, 1996 at 1:30 p.m.
14. Post Agenda Items
1. 96 NL 03 - SW 20.20.15-4 -Kern, Carl & Sherryn
Moved by A. Zagorsky that we recommend to Council the approval of this subdivision and leave
the proposed parcel zoned as agriculture by waiving the minimum agricultural parcel size
requirement of the Land Use By-law, subject to the applicant entering into a Service Agreement
with the County of Newell, ensuring access to both the proposed and remnant parcels; subject
to the applicant entering into a Domestic Water Agreement with the E.I.D.; and subject to
payment of money in place of reserve in the amount of 5478.00. Carried.
