The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was held in
the County Office at Brooks, Alberta on Tuesday, March 26, 1996 commencing at 10:00 a.m.

Councillor Baksa that we adopt these minutes as amended. Carried.

The Chairman called for post agenda items.

Moved by A. Zagorsky that the agenda be adopted as amended. Carried.

6. Delegations

V Pt. E 36-20-15-4 • Agricultural to Countrv Residential
Richard & Marylou Veen were in attendance and presented information on the above land use
change application. Moved by Councillor Scheuerman that we recommend to Council the approval
of this land use change and that the By-law effecting the land use change take effect on the
date of registration of the proposed subdivision for this area. Carried.
2. Gail Mulhall -Permit #1503 • Request for Waiver of Set-back
Lot 9 Block 1 Plan 9010982 ISW 9.19-14-4)
Gail Mulhall was in attendance and presented information on the above permit application and
waiver request. Moved by Councillor Baksa that we approve this permit and relax the flankage
set-back requirement on the north side of the property to 3 metres. Carried.

3. Town of Brooks re: Alberta Pig Company -Land Use Change
''` Pt. Block A Plan 7711364 (Pheasant Hatchery) -Urban Fringe to Agricultural
Town of Brooks Mayor Bob Breakell, Town Manager Kevin Bridges, and Town Planner Marga
Betz were in attendance to discuss this land use change. Moved by Councillor Scheuerman that
we recommend to Council that this land use change be denied. Moved by Councillor Baksa that
this item be tabled. Carried.

The Commission recessed for lunch from 12:00 noon - 1:10 p.m.
4. Kathy Ramer -Land Use Change - SW 13-20.15-4
Agricultural to Country Residential
Kathy Ramer was in attendance and presented information on this proposed land use change.
Moved by Councillor Baksa that we recommend to Council the approval of this land use change.
Carried.
5. Neil Johnson -Subdivision 96 NL 04 - SW 10-19-14-4 & NW 3-19-14.4
~'' Johnson Farms (Brooks) Ltd.
Neil Johnson was in attendance and presented information on this proposed subdivision. Moved
by Councillor Baksa that we recommend to Council the approval of this subdivision subject to the
applicant entering into a Domestic Water Agreement with the E.I.D.; subject to the applicant
providing easements for the conveyance of water from the public utility lot to each proposed
parcel in the SW 10-19-14-4; subject to the applicant entering into a Development Agreement
with the County of Newell for the construction of the proposed road and accesses to all
proposed parcels in -the SW 10-19-14-4 and for the construction of a joint access to the two
proposed parcels in the NW 3.19.14-4; and subject to payment of money in place of reserve in
the amount of 5250.00 per acre, being 10% of the market value, of the existing parcel of land.

13-1 Proposed Land Use Bylaw Amendments '-'
a) Dwelling Units Per Parcel
Planner, S. Welling's, proposed amendment to the Land Use By-law, dated January 30, 1996,
was reviewed by the Commission. Moved by Councillor Baksa that we recommend to Council
an amendment to the Land Use By-law as per Option #1 of the Planner's proposal, with the
addition of an exception clause. Carried.
b1 Agricultural Residence Parcels Per Quarter
This item will be brought back to the next Municipal Planning Commission meeting.
c) Moved-in Dwelling as a Discretionary Use
This item will be brought back to the next Municipal Planning Commission meeting.
d) Code of Practice for the Safe & Economic Handling of Animal Manures
A proposed Land Use By-law amendment, prepared by the Planner, which would incorporate the
Code of Practice for the Safe & Economic Handling of Animal Manures into our Land Use By-
Law, was presented and reviewed by the Commission. Moved by Councillor Scheuerman that we
recommend to Council an amendment to the Land Use By-law that would incorporate the Code
of Practice for the Safe & Economic Handling of Animal Manures into the Land Use By-law as
presented by Planner, S. Welling, with the exception of proposed Section 5 which is to be
deleted. Carried.

Moved by A. Zagorsky that we approve this permit. Carried.

Moved by Councillor Scheuerman that we approve this permit. Carried.
4. #1496 - Narm Berg • Butcher Shop -.8'dP 36-22-17-4 -Gem
Councillor Baksa declared a pecuniary interest in this permit and excused herself from discussion
and voting on this item and left the Council Chambers at 4:15 p.m.
Moved by A. Zagorsky that we approve this permit subject to the applicant meeting all applicable
regulations of the Palliser Health Authority. Carried.
Councillor Baksa returned to the Council Chambers and resumed participation in the meeting at
4:18 p.m.

Moved by Councillor Baksa that we approve this permit. Carried.
6. #1502 -Greg & Doreen Brewer -Moved-in House -Plan 8311138 Block 1 N%: Lat 3
INW 9-18.14.4) -Brooks
Moved by Councillor Scheuerman that we approve this permit subject to the applicant making the
following improvements by December 31, 1996:
• changing all windows and doors on the proposed front, leaving just one door in the centre
and eliminating the other two doors;
• adding a porch or veranda with pillars to the front of the building;
• replacing unmatched shingles;
• cleaning the entire building exterior;

subject to the applicant providing an irrevocable letter of credit in the amount of S 15,000.00 to
ensure that the above improvements are completed; subject to the applicant changing the
remainder of the windows and doors in 1997; and subject to this dwelling being used as a single
family residence. Carried.

There were no Home Occupation Licences.
9. Land Use Chanoes

Moved by Councillor Baksa that the applicant amend his application to correspond with, the
Municipal Planning Commission's previous recommendation which would include an .area of
' ~j approximately two acres, including the quonset; that the amended application include a scaled
v drawing; that the amended application be received by the County of Newell no later than Aprii
23, 1996; and that, if the amended application is not received by April 23, 1996, the
Development Control Officer proceed with the issuance of a Stop Order regarding the sale of
equipment on the property. Carried.
10. Subdivisions
1. 96 NL 04 - SW 10-19-14-4 & NW 3-19-14-4 -Johnson Farms (Brooks) Ltd.
This subdivision was previously dealt with under Item #5.5.
2. 96 NL 05 -Lots 15 & 16 Block 3 Plan 2123 FB -Rolling Hills Church of God
Moved by A. Zagorsky that we recommend to Council the approval of this subdivision subject to
the applicant providing any required utility easements. Carried.
3. 96 NL 06 -Lot 5 Block 1 Plan 8011346 ISE 25-18-15-41 -Roland & Ann Gauthier
Moved by Councillor Scheuerman that we recommend to Council the approval of this subdivision
and relax the minimum lot area for a Country Residential lot to .31 hectares, subject to the
applicant entering into a Domestic Water Agreement with the E.I.D.; and subject to the applicant
entering into a Service Agreement with the County of Newell to provide access to the proposed
and remnant parcels. Carried.

The Development Control Officer presented her report for February 22, 1996 to March 20, 1996.
Moved by Councillor Baksa that we accept this report. Carried.

presented to the Commission as information.
