Zagorsky be excused from this meeting. Carried. 2. Minutes Minutes of the March 26, 1996 meeting were presented to the Commission. Moved by Councillor Scheuerman that we adopt these minutes as amended. Carried. 3. Call for Post Agenda Items The Chairman called for post agenda items. 4. Adoption of Agenda Moved by J. Doerksen that the agenda be adopted as amended. Carried. April 30, 1996 Page 21 5. Business from Minutes 5-3 Russ BelangerlDon Draper -Land Use Change - 2429 GB Urban Fringe to Country Residential This item remained tabled. 7-2 Permit #1488 -River Bow Ranch Barry Fleming) Feedlot Renovation - NE 32-16.16-4 -Rainier Moved by Councillor Baksa that this item be lifted from the table. Carried. Moved by Councillor Scheuerman that we approve this permit subject to the applicant complying with the Code of Practice for the safe and economic handling of animal manures and, more specifically, with the following conditions as recommended by Alberta Agriculture, Food & Rural Development personnel: 1) All surface drainage from the 2 east pens be contained in the immediate area of the pens. 21 The 4 west pens may comprise a total area of 60 • 80 acres. They will ~I de a feedbunk, a feeding containment area to handle animals, and access to the rem~ining grassed area, which could be extended to the river. The areas are presumably to be enclosed with barb wire fences. a) The pens should not extend to the river. It is recommended they terminate on the NE'A of 32. b) A berm of 1 %:-2' height be placed between the feeding confinement fence and the irrigation delivery ditch to contain run-off andlor manure solids, from the feeding area. c) The applicant must address the accumulation of manure in the lower part of these pens. Either removal or harrowing the pens to utilize the manure as fertilizer in the grassed areas. d) A natural waterway at the bottom of the pens drains into a slough on the NE 32. The slough can drain to an E.I.D. ditch and subsequently to the river. It is recommended all manure contaminated run-off water from the slough be contained or pumped on the owners land. It must not have access to the river. April 30, 1996 Page 22 6. 3) Cleaning of manure from the east pens and west pen feeding areas be completed on a regular basis. 4) Prompt and acceptable disposal of all Beads. Carried. Delegations 1. Block A Plan 7711364 (Pheasant Hatchery) -Urban Fringe to Agricultural This item remained tabled. 13-11b) Agricultural Residence Parcels aer Quarter Proposed amendments to the County of Newell Land Use By-law related to residential subdivisions in agricultural districts was presented to, and reviewed by, the Commission. Moved by Councillor Baksa that we recommend to Council an amendment to the Land Use By-law that would incorporate this proposal and the changes made by the Commission. Carried. 13-11c- Moved-in Dwelling as a Discretionary Use Proposed amendments to the County of Newell Land Use By-law for moved-in buildings was presented to, and reviewed by, the Commission. Moved by Councillor Baksa that we recommend to Council an amendment to the Land Use By-law that would incorporate this proposal and the changes made by the Commission.. Carried. ,~- April 30, 1996 Page 23 Concern was expressed that a double standard may exist in that agricultural operators are not required to obtain permits for farm buildings, whereas other individuals require permits to construct buildings for their purposes. Council will be asked their opinion on this matter. 13.1 Richard Benci - Dua-out - SE 19-17-13-4 The Development Control Officer presented further information on this item. Moved by Councillor Scheuerman that a letter be sent to Mr. Benci indicating that the dug-out appears to be within the required set-back distance from the centre of the road allowance and, thereby asking Mr. Benci to verify the distance from the centre of the road allowance and indicate whether or not the dug-out is lined. Carried. 7. Permits 1. #1523 -Dan & Sally Gartman -Addition to House - Pt. NE 32.19-14-4 -Brooks Moved by Councillor Baksa that we approve this permit and relax the front yard set-back requirement to 120'. Carried. 3. #1520 -Shane Grove -Water Trucking - NW 31-20-14-4 • Duchess Moved by Councillor Scheuerman that we approve this permit. Carried. 4. #1517 • Sylvia Vogt -Mobile Home -Plan 8310314 Block A in NW 22.19.14-4 -Brooks Moved by Councillor Baksa that we approve this permit. Carried. 5. #1513 -Bill & Anne Jackson -Single Family Dwelling - NW 22-19-14-4 • Brooks Moved by Councillor Baksa that we approve this permit. Carried. Carried. Lunch The Commission recessed for lunch from 1:00 • 2:15 p.m. 7. #1405 • Belinda Craven -Renovations to Mobile Home Plan 7910924 Block 15 Lot 13 -Patricia Moved by J. Doerksen that Permit #1405 be amended to allow the applicant to install a wall nearer to the front of the building than originally proposed. Carried. Home Occupation Licences There were no Nome Occu ation Licences. P Land Use Changes There were no Land Use Changes. Subdivisions 1. 96 NL 07 - SW 28-20-14-4 -Ramer Ranches Ltd. Moved by Councillor Baksa that we recommend to Council the approval of this subdivision subject to the applicant entering into a Domestic Water Agreement with the E.I.D.; subject to the applicant providing any required easements to the E.I.D. for the conveyance of water; subject to the applicant providing any required utility easements; and subject to payment of money in-place- of reserve in the amount of S 120.00 per acre, being 1096 of the market value of the existing parcel of land. Carried. April 30, 1996 Page 25 2. 96 NL 09 • NE 8.18.14-4 -Robert Brodie Moved by Councillor Scheuerman that we recommend to Council the approval of this subdivision subject to the applicant entering into a Domestic Water Agreement with the E.I.D. and subject to the applicant entering into a Development Agreement with the County of Newell to provide access to the proposed parcel from the road allowance on the north side of the proposed parcel. Carried. 4. 96 NL 12 -Block 15 Plan 8111857 (Patricia) -County of Newell Moved by Councillor Scheuerman that we recommend to Council the approval of this subdivision. Carried. 11. Development Resort The Development Control Officer presented her report for March 21, 1996 to April 24, 1996. Moved by Councillor Baksa that we accept this report. Carried. 12. Corresaondence 1.
