May 28, 1996
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was held in
the County Office at Brooks, Alberta on Tuesday, May 28, 1996 commencing at i 0:00 a.m.

2. Minutes
Minutes of the April 30, 1996 meeting were presented to the Commission. Moved by Councillor
Baksa that we adopt these minutes as circulated. Carried.
3. Call for Post Agenda Items
The Chairman called for post agenda items.
4. Adoation of Agenda
Moved by Councillor Scheuerman that the agenda be adopted as amended. Carried.

5. Business from Minutes
13-1(c) Moved-in Dwellings as a Discretionary Use
A proposed amendment to the County of Newell Land Use By-law for moved-in buildings and
developments deemed approved was reviewed by the Commission. Moved by Councillor
Scheuerman that we recommend to Council an amendment to the Land Use By-law that would
incorporate this proposal as amended. Carried.
6. Delegations
1. Jay deJong -Permit #1536 -Storage Building -Block 4 Plan 7410106 (SE 3.19-14-4)
Land Use Change -Country Residential to Countrv Residential 2
The delegation was in attendance to discuss the above Development Permit and Land Use Change
Applications.

2. Ted Wald -Land Use Change - SW 3-19-14.4 -Urban Fringe to Countrv Residential
The delegation was m attendance to discuss the above Land Use Change. Moved by Councillor
Baksa that we recommend to Council the approval of this land use change and that this land use
change take effect at the time that the subdivision of the proposed parcel, into lots that conform
with the size requirements of the County of Newell Land Use By-law, is registered. Carried.

Moved by J. Doerksen that we recommend to Council the approval of this land use change.
Carried.
Moved by J. Doerksen that, if and when this land use change is finally approved, the property
owners in Plan 7410106, who still have their property zoned as Country Residential, be asked
whether or not they would like their properties zoned CR2. Carried.

Moved by A. Zagorsky that this item be lifted from the table. Carried.
Moved by Councillor Scheuerman that we recommend to Council that this application be denied
as the proposed parcel is too large and thereby takes excessive productive agricultural land out
of production. Carried.

This permit, which was previously dealt with in Item 6-1, will be processed further when and if
the land use change takes effect.

Moved by Councillor Baksa that we approve this permit. Carried.
8. #1528 -Robert Schmidt • Addition to House
Plan 9310875 Block 1 in NE 9-20-13-4 -Millicent
Moved by Councillor Scheuerman that we deny this permit as the house is anon-conforming u~~
and, as stated in Section 643(3) of the Municipal Government Act, "a non-conforming use of part
of a building may be extended throughout the building but the building, whether or not it is a non-
conforming building, may not be enlarged or added to and no structural alterations may be rriade
to it or on it." Carried.
9. #1526 -Clancy Olivier -Storage Shed
Plan 8811036 Block N Lot 3 in NW 34-19-14-4 -Brooks
Moved by Councillor Baksa that we deny this permit as the building does not conform to the
Land Use By-law's size regulations and also that the building cannot be classified as an accessory
use as no principle use for the property has yet been established. Carried.

There were no Home Occupation Licences.
9. Land Use Changes
There were no Land Use Changes.

10. Subdivisions
1. 96 NL 10 - SW 13-20-15-4 -Ramer Ranches Ltd.
Moved by J. Doerksen that we recommend to Council the approval of this subdivision subject to
the applicant meeting all requirements of the Eastern Irrigation District with respect to the
conveyance of water; subject to the applicant providing a 6-metre easement to Canadian Western
Natural Gas along the front of the proposed westerly parcel for the provision of gas service to
the proposed easterly parcel; subject to the applicant entering into a Development Agreement with
the County of Newell to provide a joint access off S.H. 544 to the proposed parcels; subject to
the applicant dedicating a 20-metre wide service road paralleling S.H. 544; and subject to
payment of money in-place-of reserve in the amount of 560.00 per acre, being 10% of the
market value of the existing parcel of land. Carried.
2. 96 NL 13 - NE 22.21-15-4 - Daryl & Beverly Bunney
Moved by J. Doerksen that we recommend to Council the approval of this subdivision subject to
the applicant meeting all requirements of the Eastern Irrigation District with respect to the
conveyance of water; subject to the applicant entering into a Development Agreement with the
County of Newell to provide access to the remnant parcel; subject to the applicant providing any
required utility easements; and subject to the proposed parcel being extended to the southern
quarter line. Carried.
3. 96 NL 15 - SE 20.14-13-4 - E.I.D.ICordes & Grue
Moved by A. Zagorsky that we recommend to Council the approval of this subdivision subject to
the applicant entering into a Development Agreement with the County of Newell to provide an
access approach to the proposed access right-of-way. Carried.
4. 96 NL 16 - NE 15-21-15-4 - T. Sameshima & K. Yamishiro
Moved by J. Doerksen that we recommend to Council the approval of this subdivision subject to
the applicant meeting all requirements of the Eastern Irrigation District with respect to the
conveyance of water; subject to the canal being surveyed to correctly establish the boundaries
of the proposed parcel; and subject to the proposed parcel being extended to the west to include
the entire portion of the property south of the canal. Carried.

Moved by Councillor Baksa that we accept this report. Carried.

13. Other Business
1. Sign Regulations
The Commission discussed sign regulations and provided the following comments:
• regulations should deal with distance separation from intersections;
• regulations should deal with safety factors and, therefore, signs must be readable and correctly
spaced;
'~I regulations should make a distinction between advertising and directional signs.
2. Belinda Craven -Fence in Patricia
The Development Control Officer presented information on this item which was discussed by the
Commission.
3. Jennifer King -Fence on Golf Course in Rolling Hills
The Development Control Officer presented information on this item.
