Carried. 2. Minutes Minutes of the July 30, 1996 meeting were presented to the Commission. Moved by Councillor Scheuerman that we adopt these minutes as amended. Carried. 3. Call for Post Agenda Items The Chairman called for post agenda items. 4. Adoption of Agenda Moved by Councillor Baksa that the agenda be adopted as amended. Carried. August 27, 1996 Page 45 5. Delegation 1. D.J. Haverlock -Lakeside Packers -Permit #1570 Temporary Lodging Camp - SW 19-19-14-4 The delegation was in attendance and presented information on the above-noted permit application. Moved by Councillor Baksa that this permit be approved on a temporary basis until December 31, 1998, subject to the lodging camp being operated as per the Operational Guidelines outlined in Lakeside Packers' July 31, 1996 letter to the County of Newell. 6. Business from Minutes 12-1 Proposed Area Structure Plan - Pt. E'/: 36.20.15.4 - VeenlBenci No further information has been received on this item. 7. Permits 1. #1569 -Elmer Lohmann -Moved-in Dwelling ~~ Plan 8211419 Block 1 Lot 3 in NE 35-18.15-4 -Brooks Moved by J. Doerksen that we approve this permit subject to the applicant providing the County ..,.~ with a letter from the owner of the gas pipeline, which indicates that the owner of the gas pipeline consents to the location of this development; subject to the dwelling being placed, and all required work being completed, within one year of the date of issuance of the Development Permit; and subject to the applicant providing the County with a S 15,000.00 irrevocable letter of credit negotiable until ane year after the date of issuance of the Development Permit to ensure that this development is completed. He abstained from discussion and voting on this item and left the Council Chambers at 10:35 a.m. Moved by Councillor Baksa that, in the absence of the Chairman, J. Doerksen assume the chair. Carried. Moved by Councillor Baksa that we approve this permit. Carried. Chairman Fabian returned to the Council Chambers at 10:40 a.m., resumed participation in the meeting and assumed the chair. NW 9.18.14.4 -Brooks 9 Moved by Councillor ~Scheuerman that we deny this permit as it does not comply with the parcel ~, size and dwelling use requirements of our Land Use By-law's "dwelling units per parcel" provisions. Land Use Changes There were no land use changes. 11. Subdivisions 1. 96 NL 24 • Pt. SE 36-15-16-4 - Dijk, Harry Moved by Councillor Baksa that we recommend to Council the approval of this subdivision subject to the applicant meeting all requirements of the Eastern Irrigation District. with respect to the conveyance of water; subject to the applicant entering into a Service Agreement with the County of Newell to provide access to the remnant parcel; and subject to payment of money in place \J~ of municipal reserve in the amount of $120.00 per acre, being 10% of the market value of the existing parcel of land. Carried. 2. 96 NL 25 - Pt. NW 31-18-15.4 • Anderson, W.J.M. Moved by Councillor Scheuerman that we recommend to Council the approval of this subdivision subject to the applicant relocating the mobile home onto the proposed parcel prior to registration of the subdivision; subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water; subject to payment of money in place of municipal reserve in the amount of S 150.00 per acre, being 10% of the market value of the existing parcel of land; and subject to the applicant entering into a Service Agreement with the County of Newell to provide access to the proposed parcel. Carried. 12. Development Report The Development Control Officer presented her report far July 25, 1996 to August 21, 1996. Moved by J. Doerksen that we accept this report. Carried. Rezoning Remainder of Lots in Plan 7410106 from CR1 to CR2 Moved by Councillor Baksa that a letter be sent to landowners with a CR1 designation within Plan 7410106, outlining the implication of re-zoning these parcels from CR1 to CR2 and requesting their comments on such a change. Permit #1580 • Robert McKean • Moved-in Atco Trailer for Operation of Convenience Store - Pt. NW 9-23.16-4 Moved by J. Doerksen that we approve this application subject to the applicant providing the County with a letter from the landowner, indicating the landowner's consent to the location of this development; that we relax the front yard setback to 108' from the centre of the road; and that we relax the flankage set-back requirement to 10' from the property line. Carried. 11. 96 NL 26 - NE 21-19-14-4 - Lais & Victor Valli Moved by Councillor Baksa that we recommend to Council the approval of this subdivision subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water; subject to the applicant entering into a Service Agreement with the County of Newell to provide access to both the proposed and remnant parcels on the east side of these parcels; and that we waive the minimum size requirement for an agricultural parcel on the proposed lot to 53.52 acres.
