Minutes of Municipal Planning Commission Meeting
September 24, 1996
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was held in
the County Office at Brooks, AB on Tuesday, September 24, 1996 commencing at 10:00 a.m.

2. Minutes
Minutes of the August 27, 1996 meeting were presented to the Commission. Moved by
Councillor Baksa that we adopt these minutes as circulated. Carried.
3. Call for Post Agenda Items
The Chairman called for post agenda items.
4. Adoption of Agenda
Moved by Councillor Scheuerman that the agenda be adopted as amended. Carried.

Moved by A. Zagorsky that we approve this permit subject to the applicant stonng all matenals
related to the home occupation inside the dwelling unit, subject to the applicant meeting all
regulations of the Palliser Health Authority, and subject to the applicant properly disposing of
carcasses. Carried.
8. Delegation

The delegation was in attendance and presented information on the above-noted Land Use Change
application. Moved by Councillor Baksa that we recommend to Council the approval of this land
use change. Carried.

Country Residential to Light Industrial
The delegation was in attendance and presented information on the above-noted Land Use Change
application and a Development Permit.

Moved by Councillor Scheuerman that we recommend to Council the approval of this land use
change subject to the applicant first providing a detailed map of the area to be redesignated.
Carried.

9. Land Use Changes

~ Moved by Councillor Scheuerman that we recommend to Council the approval of this land use
change subject to the proposed parcel being moved directly west such that it is adjacent to the
existing Country Residential District. Carried.
10. Subdivisions
1. 96 NL 27 - SE 8-20-12.4 -Frank & Jovice Nesbitt
Moved by A. Zagorsky that we recommend to Council the approval of this subdivision subject to
the applicant meeting all requirements of the Eastern Irrigation District with respect to the
conveyance of water. Carried.

1. Albert & Patty Snyders -Town's Authority to Stop Country Residential Subdivisions
A letter will be sent to Albert & Patty Snyders stating that, according to the County of Newell,
the Town of Brooks has no authority to stop Country Residential subdivisions unless they occur
within the Urban Fringe District, and that we are waiting for a legal opinion to confirm our
interpretation.
2. Main Street Realty -Request for Waiver of Set-back for Well
Parcel C Plan 2280 FJ (NE 13-21-16-41
Moved by A. Zagorsky that we relax the set-back of the well at the above-noted location to 75'
from the centre of the road. Carried.

Moved by Councillor Baksa that we approve this permit and relax the north side yard set-back
to 26' from the property line. Carried.

Moved by J. Doerksen that we approve this permit subject to the applicant providing the County
with a 55,000.00 irrevocable letter of credit negotiable until one year after the date of issuance
of the Development Permit. Carried.
3. Permit #1585 -Alberta Wheat Pool -Modular Office - NW 28-18.14-4
Moved by Councillor Scheuerman that we approve this permit. Carried.

16. December Meeting Date
Moved by Councillor Baksa that the December 31, 1996 regular Municipal Planning Commission
Meeting be changed to December 23, 1996 commencing at 10:00 a.m. Carried.

Moved by Councillor Baksa that the meeting adjourn at 2:45 p.m. Carried.
