~ Minutes of Municipal Planning Commission Meeting
November 26, 1996
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was held in
the County Office at Brooks, AB on Tuesday, November 26, 1996 commencing at 10:00 a.m.

All members were in attendance at this meeting.
2. Minutes
Minutes of the October 29, 1996 meeting were presented to the Commission. Moved by
Councillor Stobbs that we adopt these minutes as circulated. Carried.
3. Call for Post Agenda Items
The Chairman calved for post agenda items.
4. Adoation of Agenda
Moved by Councillor Baksa that the agenda be adopted as amended. Carried.

14.1 Re-zoning Remainder of Lots in Plan 7410106 from CR to CR2
Moved by Councillor Baksa that we recommend to Council that the Land Use By-law be amended
by re-zoning the following parcels from Country Residential to Country Residential 2: Lot 1 Block
1 Plan 8810971; Lot 2 Block 1 Plan 8810971; Block 2 Plan 7410106; Block 3 Plan 7410106;
Block 5 Plan 7410106; and a portion of SE 3-19-14.4. Carried.

This item will be discussed later in the agenda when further information is available.
6. Delegation
1. Karen Rose -Land Use Change -Block 1 Plan 9611587 (NE 8-18-14-4-
Agricultural to Country Residential
The delegation was in attendance and provided information on the above•noted land use change.
Moved by Councillor Stobbs that we recommend to Council the approval of this land use change
and that the land use change take effect on the date that a subdivision for this parcel is
registered. Carried.

8-2 Proposed Area Structure Plan - Pt. E'/Z 36-20-15.4 - VeenlBenci
The Commission was informed of amendments made to this proposed Area Structure Plan.
16-1 Multi-family Residential Complexes in Rural Areas
Direction was given to the Planner to prepare a proposal for incorporating multi-family residential
complexes within the Country Residential zoning section of our Land Use By-law. This proposal
will be presented at a future Municipal Planning Commission meeting.

Information will be obtained as to the amount of abandoned railway right-of-way that is still
available and what the price is to purchase this right-of-way.

9. Land Use Changes
There were no Land Use Changes.
10. Subdivisions

Moved by Councillor Baksa that we recommend to Council the approval of this subdivision subject
to the applicant consolidating the Title of the remnant parcel with that of LSD 9; subject to the
applicant meeting all requirements of the Eastern Irrigation District with respect to the
conveyance of water; subject to the applicant entering into a Development Agreement with the
County of Newell for the provision of access to all proposed parcels; and that we waive the
minimum size requirements for Agricultural parcels for proposed~-Le~'~ and the proposed
consolidated parcel consisting of the remnant parcel and LSD 9. Carried^ ~C",T' ~~'"`

Commission. Moved by A. Zagorsky that we approve this report. Carried.

Other Business
1. Permit #1448 -Request for Extension - Pt. 34.19.15-4 -Regional Landfill Site
Moved by Councillor Baksa that the validity of this Development Permit be extended to November
26, 1997. Carried.
2. Proposed Land Use By-law Amendment -Section 44 -Minimum Setback Requirements
The minimum set-back requirements, as per Section 44 of the Land Use By-law, were amended
by By-law 1129-95.

Moved by J. Doerksen that we recommend to Council the approval of this subdivision subject to
the applicant meeting all requirements of the Eastern Irrigation District with respect to the
conveyance of water; subject to the applicant ~~arA~into a Deve~gpm~r Agreement with the
County of Newell providing for the removal o i ~ existing approa~KO proposed '~ and the
provision of a joint approach for proposed and proposed 2; subject to payment of
money in-place-of Municipal reserve in the amount of 5120.00 per acre, being 10% of the market
value of the existing parcel of land; and that we waive the minimum size requirement for an
Agricultural parcel for proposed Block 2. Carried.
2. 96 NL 35 - SW 10.19-14.4 -Johnson Farms Ltd.
Moved by J. Doerksen that we recommend to Council the approval of this subdivision subject to
the applicant meeting all requirements of the Eastern Irrigation District with respect to the
conveyance of water; subject to the applicant entering into a Development Agreement with the
County of Newell for the provision of roads, approaches and utility services; subject to deferral
of Municipal reserve onto the .remnant parcel; and that we waive the minimum lot area
requirement for Country Residential parcels. Carried.

Moved by A. Zagorsky that we recommend to Council the approval of this subdivision subject to
the applicant meeting all requirements of the Eastern Irrigation District with respect to the
conveyance of water; subject to the applicant entering into a Development Agreement with the
county of Newell for the construction of roads and drainage, the removal of the existing approach
north of Lot 1, and the provision of utility services; subject to the applicant dedicating Lot 3 as
a utility lot; subject to the applicant placing the proposed drain and proposed water line on
easements excepting where they must cross the road; subject to payment of money in-place-of
Municipal reserve in the amount of 5200.00 per acre, being 1096 of the market value of the
existing parcel of land; and subject to the applicant meeting any requirements of the Eastern
Irrigation District with respect to the relocation of the Eastern Irrigation District's drain. Carried.
