Excused from Meeting All members were in attendance at this meeting. ~.. ~ .... 2. Minutes Minutes of the March 25, 1997 meeting were presented to the Commission. Moved by Councillor Stobbs that we adopt these minutes as circulated. Carried. 3. Call for Post Agenda Items The Chairman called for post agenda items. 4. Adoption of Agenda Moved by Councillor Baksa that the agenda be adopted as amended. Carried. ~~" April 29, 1997 Page 15 5. Business from Minutes 14-1 Market Values of Land for Payment of Cash in-lieu•of Reserve Purposes The Secretary presented information to the Commission on the Assessor's market values for land in the County of Newell. Moved by Councillor Baksa that we use the Assessor's market values for land when determining the amount to be paid for payment of cash in-lieu-of Municipal Reserve. Carried. 6. Delegations 1. Dale Philpott -Land Use Change • NW 9-20-14.4 -Agriculture to Country Residential Moved by Councillor Baksa that we lift this item from the table. Carried. The delegation was in attendance and presented information on this proposed land use change. Moved by Councillor Baksa that we recorruriend to Council the approval of this land use change and that this land use change take effect on the date that a subdivision for this parcel is registered. Carried. \ ~j --~, V ~~ 2. Norma Schmidt -Permit #1654 -Mobile Horne - NW 9.18-14.4 ,~- The delegation was in attendance and informed the Commission that she is withdrawing her application. A letter in opposition to this development, containing 20 signatures, was also presented to the Commission. 7. Permits 1. x/1638 - Amron Construction -Mobile Home (PIS) - NE 33.18.15-4 - Renke Meadows -Brooks Moved by Councillor Stobbs that we approve this permit. Carried. 2. #1643 -Paul & Marie Hofer -Mobile Home -Block 2 Plan 7710951 (NW 5-19-15-4) -Brooks Moved by J. Doerksen that we refuse this permit as our Land Use By-law does not aNow a second dwelling unit on a Country Residential parcel. Carried. Zagorsky that we approve this permit subject to the applicant removing the existing mobile home on the property prior to the installation of the new double-wide mobile home. Carried. Doug Moss -Prairie Feeders Ltd. -Permit #1625 Feedlot Expansion - SW 17-21-17.4 •Bassano The delegation was in attendance and presented information on this Development Permit application. Moved by A. Zagorsky that we approve this permit and waive the minimum distance separation requirement as the expansion is less than 10% of the current capacity and will not be any closer to residences than the existing silage pit, subject to the applicant adhering to the manure disposal requirements, Beads disposal requirements, and the surface drainage containment requirement for the proposed expansion area as outlined in a letter from Orin Kenzie, of Alberta Agriculture, Food & Rural Development, to Ray Thiessen, Development Control Officer, County of Newell, dated April 24. 1997. Lunch The Commission recessed for lunch from 12:00 noon - 1:20 p.m. Business from Minutes (Cont'd.) 6-1 97 NL 12 - Pt. NW 1-19-14-4 - R.C. Baksa Stores Ltd. Councillor Baksa declared a pecuniary interest in this item and excused herself as a member of the Municipal Planning Commission. She remained in the meeting as a ratepayer. Discussion took place on this subdivision application. April 29, 1997 Page 17 Councillor Baksa left the Council Chambers at 2:47 p.m. Moved by Councillor Stohbs that we recommend to Council the approval of this subdivision subject to the applicant increasing the size of all parcels to a minimum of 1 acre, which would extend the subdivision to the east; subject to the subdivision having a maximum of 14 parcels; subject to dedication of a Municipal Reserve parcel of at least 10% of the area of the subdivision; subject to dedication of a utility lot; subject to the applicant entering into a Development Agreement with the County of Newell far the construction of the roadway, the turn- around bulb, the emergency access lane, the approaches to all parcels, and the building up of all low areas such that adequate drainage is provided for the entire subdivision; subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water; subject to the applicant providing any required utility easements; and subject to the applicant receiving approval from appropriate authorities with respect to any proposed on-site sewage disposal systems. Carried. Councillor Baksa returned to the Council Chambers and resumed participation in the meeting at -(,j 3:37 p.m. 8. Home Occupation Permits There were no home occupation permits. 9. Land Use Chanees There were na land use changes. 10. Subdivisions 1. 97 NL 13 - S'h 34-19.15-4 & SW 35-19.15.4 • E.I.D. Moved by Councillor Stobbs that we recorrxnend to Council the approval of this subdivision. Carried. ~, April 29, 1997 Page 18 r^ 2. 97 NL 14 • E'h 31-15.13.4 -Rick Farms Ltd. Moved by A. Zagorsky that we recommend to Council the approval of this subdivision and waive the minimum size requirement for an agricultural parcel subject to the applicant consolidating the remnant portion of this subdivision with the SE 31.15-13.4; and subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water. Carried. 11. Development Report The Development Report for March 19, 1997 to April 22, 1997 was presented to the Commission. Moved by Councillor Baksa that we approve this report. Carried. 12. Correspondence 1. County of Newell • Criteria used by the M.P.C. to Determine Which Subdivisions require a Sinned Certificate from a Safety Codes Officer Moved by J. Doerksen that we send a letter to County Council stating that the M.P.C. considers the following points in determining whether a signed Certificate from a Safety Codes Officer is required: '^ a) Size of parcel; b1 Nature of the topography and characteristics of the land; c- When it is felt that this additional information is required by the M.P.C. to ensure that any subdivisions to be approved are both feasible and functional; and that it be requested of Council that, if they do not agree with the criteria used by the M.P.C., they provide the Commission with the criteria to be used and that such policy be set through the Municipal Development Plan. Carried. 13. Other Business There was no other business. 14. Post Agenda Items 1. Permit X1533 -Mike & Anna Gross -Single Family Dwelling & Garage Request for Extension • NW 27-20.13.4 Moved by Councillor Stobbs that we grant aone-year extension for this permit. Carried. 3. Country Residential Subdivisions • 'h•acre Lots Moved by J. Doerksen that we recommend to Council that they reconsider the 'h-acre minimum lot size for Country Residential parcels and that the Land Use By-law be amended to increase the minimum size requirement for Country Residential parcels back to 1 acre. Carried. 4. Attendance of Secretary at Council Meetines durine the M.P.C. Resort Moved by J. Doerksen that we recommend to Council that the Municipal Planning Commission Secretary be present at Council Meetings when the Municipal Planning Commission report is given. Carried. 15.
