Minutes of Municipal Planning Commission Meeting
''1 July 29, 1997
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was held in
the County office at Brooks, Alberta on Tuesday, July 29, 1997 commencing at 10:00 a.m.

~ 2. Minutes
Minutes of the June 24, 1997 meeting were presented to the Commission. Moved by Councillor
Baksa that we adopt these minutes as circulated. Carried.
3. Call for Post Agenda Items
The Chairman called for Post Agenda Items.
4. Adoption of the Agenda
Moved by Councillor Stobbs that the agenda be adopted as amended. Carried.
5. Business from Minutes
11.1 Land Use Change -Janice Algra - SW 4-21-14-4 -Urban Fringe to Country Residential
Moved by Councillor Baksa that we lift this item from the table. Carried.

The Development Control Officer was directed to have the applicant contact the adjacent
livestock operation owner to ask that owner to provide their written comments on this proposed land _
use change. These comments will then be reviewed at the next Municipal Planning Commission
meeting. Moved by Councillor Stobhs that this item be tabled for further information. Carried.
15-5 Permit #1685 -Fern Skuban-Smith -Construction of 2 shops -Plan 8211419, Lot 6, Block 1
Moved by Councillor Baksa that we lift this item from the table. Carried.
Vote on the following motion which was tabled at the June 24, 1997 Municipal Planning Commission
Meeting: Moved by Councillor Baksa that we approve this permit and waive the maximum size for
a principle building to 409 square meters. Carried.
6. Permits
1. #1689 -County Homes -Bryan Blanchet -Move-in Single Family Dwelling SE 25-16-13-4 - R. HiNs
Moved by Councillor Baksa that we approve this permit subject to the applicant removing or
destroying the existing dwelling within 90 days. Carried.

Moved by Councillor Baksa that this item be postponed until this afternoon. Carried.
3. #1694 -Bill Kazimir -Move-in Modular -Plan 7910951, Block 1, Lot 5 - NE 22-18-14-4 -Brooks
Moved by J. Doerksen that we approve this permit subject to the applicant removing the existing
dwelling. Carried.
7. Home Occupation Permit
1. #73 -Reg & Chris Olsen -Cat Hotel -Plan 7910951, Lot 2, Block i NE 22-18-14-4 -Brooks.
Moved by A. Zagorsky that we approve this permit subject to the applicant ensuring that this home
occupation be carried out under a controlled environment and that the proposed cat run be enclosed.
Carried.

9. Subdivision
1. 97 NL 27 -Part of SW 13-21-16-4 - JOHNSTON, Robert & Marcie
Moved by Councillor Baksa that we recommend to Council the approval of this subdivision subject
to the applicant meeting all requirements of the Eastern Irrigation District with the respect to the
conveyance of water; subject to the applicant reducing the proposed parcel size to the required 4
hectare maximum; subject to the applicant entering into a development agreement with the County
of Newell to ensure access to the proposed and remnant parcels; and subject to the registration of
a caveat for the dedication of five meters on the south side of the entire length of the current
property for future road widening to be purchased at a rate that is consistent with County policy at
that time. Carried.
10. Delegation -Orin Kenzie -Alberta Food and Rural Development -Manure Management Program
The delegation was in attendance and presented the Commission with information on the contents
and development of a Manure Management Program.

The Development Control Officer was directed to contact Bob Stilborne of Lakeside requesting that
they submit a copy of their Manure Management Program to the County as per the condition in their
development permit. The Development Control Officer will do a written follow up on this phone call.
Subdivision -Continued
2. 97 NL 28 - NW 16-16-16-4 - OVEREEM, John and Judith
Moved by Councillor Stobbs that we recommend to Council the approval of this subdivision subject
to the applicant entering into a development agreement with the County of Newell for the provision
of access to the remnant parcel; and subject to the applicant meeting all requirements of the Eastern
Irrigation District with respect to the conveyance of water. Carried.
As the road adjacent to this proposed subdivision is a local road which dead ends in the south,
dedication of land for future road widening was not required.

11. Development Report
The development report for June 17, 1997 to July 22, 1997 was presented to the Commission. --~
Moved by J. Doerksen that we approve this report. Carried.

The Commission recessed for lunch from 12:00 p.m. to 1:25 p.m.
12. Correspondence
1. Kay, Kay &Riggins • Request to have Deferred Reserve Caveat Discharged -
SE 15 & Pt. SW 15-17.16-4
A letter from Kay, Kay &Riggins requesting that the above noted Deferred Reserve Caveat be
discharged was presented to the Commission. Moved by Councillor Stobbs that as there are no
current requirements to register Deferred Reserve Caveats in such subdivisions and as there is no
apparent reason as to why this Deferred Reserve Caveat was registered, we recommend to Council
that this Deferred Reserve Caveat be discharged. Carried.

2. University of Alberta Faculty of Extension -Enforcing Land Use Bylaws Course
Information on a Land Use Bylaw Enforcement Course received from the University of Alberta was
presented to the Commission. Moved by Councillor Baksa that our Development Control Officer be
authorized to attend this course. Carried.
13. Other Business
There was no other business.
14. Post Agenda Items
1. Permit #1705 - Jo-Ann Trucking -Plan 8911256, Block 1, Lot 3 -Truck Terminal
Moved by A. Zagorsky that we approve this permit subject to the applicant constructing the access
road on the right of way as per their proposed subdivision application. Carried.

A discussion was held on this item which was postponed earlier in the meeting. Moved by Councillor
Stobbs that we approve this permit and inform the applicant that they did not follow the correct
