County of Newell No. 4 Minutes of Municipal Planning Commission Meeting November 25,1997 The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was held in the County Office at Brooks, AB on Tuesday, November 25,1997 commencing at 10:00 a.m. Members Present Chairman V. Excused from Meeting All members were in attendance at this meeting. .•- ~ .... 2. Minutes Minutes of the October 28,1997 meeting were presented to the Commission. Moved by Councillor Baksa that we adopt these minutes as amended. Carried. 3. Call for Post Agenda Items The Chairman called for post agenda items. 4. Adoption of Agenda Moved by J. Business from Minutes 15-1 PlanWell Consulting - Proposed Land Use District Amendments This item is to be dealt with at the next meeting. 17-5 Alberta Agriculture Food & Rural Development -Intensive Livestock Operations Seminar Councillors Fabian and Scheuerman, Member J. Doerksen and Planner S. Welling will attend the above noted meeting on December 3, 1997. 6. Permits \ tjr There were no permits. 7. Home Occupation Permits _ There were no Home Occupation Permits. 8. Land Use Changes 1. Arno Hultman • Plan 9212705 Block 1 (SE 15-20-14-41-Agricultural to Country Residential Moved by Councillor Baksa that we recommend to Council the approval of this land use change subject to the entire parcel being rezoned to Country Residential. Carried. November 25, 1997 Page 55 T 9. Subdivisions 1. 97 NL 44 - Ptn. NE 35.21-18-4 -G.W.K. Farms Ltd. Moved by J. Doerksen that we recommend to Council the approval of this subdivision subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water; subject to the applicant entering into an agreement with the County of Newell for the installation of an access to the remnant parcel; and that the minimum size requirement for an Agricultural,Parcel be waived to 32 acres. Carried. 2. 97 NL 45 - Ptn. SW 6.21-15-4 -Dyck Dietrich P & Agatha Moved by Councillor Baksa that we recommend to Council the approval of this subdivision subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water; subject to the applicant dedicating a 5-metre road right-of-way along the proposed parcel and subject to the registration of a caveat for the dedication of 5 metres on both the west and south sides of the balance of the parcel for future road widening to be purchased at a rate that is consistent with County policy at that time. Carried. As access to both the new and remnant parcels are adequate, no service agreement is required. 3. 97 NL 46 - NE 18-19-14-4 - E.I.D Moved by A. Zagorsky that we recommend to Council the approval of this subdivision subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water; subject to the applicant entering into an agreement with the County of Newell for the installation of an access to the proposed parcel; subject to payment of money in-place-of municipal reserve in the amount of 59,200.00, being 1096 of the existing market value of the land and subject to the registration of an easement granting access through proposed Block 3 to the remnant parcel unless an access easement is already in place through Block 1, Plan 9710617. Carried. 4. 97 NL 47 -Lot 16. Block 1 Plan 2123 F B IRolling Hillsl • Schneider Garry & Delores Moved by A. Zagorsky that we recommend to Council the approval of this subdivision subject to the applicant entering into an agreement with the County of Newell for the installation of any required accesses to the proposed and remnant parcels. Delegation Bert and Jason Van Oirschot -Subdivision - NE 1-20-14-4 The delegation was in attendance and discussed a proposed subdivision at the above noted location. Moved by A. Zagorsky that we obtain direction from Council on the issue of subdividing out an agricultural residence from an Agricultural parcel prior to the residence being in place. Carried. 11. Development Report The Development Report for October 22, 1997 to November 19, 1997 was presented to the Commission. Moved by Councillor Baksa that we approve this report. Carried. 12. Correspondence 1. Scandia Hamlet Advisory Board -Limitations on Buildings _ A letter from the Scandia Hamlet Advisory Board requesting that a bylaw be put in place regarding the minimum square footage for single family dwellings in Scandia was presented to the Commission. Moved by Councillor Scheuerman that this letter be referred to Council. Defeated. Moved by Councillor Baksa that we recommend to Council that the Land Use Bylaw be amended for all Hamlet Residential areas such that all dwellings, including mobile homes, be a minimum of 800 sq. ft. Moved by Councillor Baksa that this item be tabled. Carried. Administration will obtain further information. 2. A.A.M.D.&C. -Alberta Department of Agriculture Livestock Expansion & Development Team A letter from the A.A.M.D.&C. with regard to the Alberta Department of Agriculture Livestock Expansion & Development Team was presented to the Commission. 13. Bob Moved by Councillor Scheuerman that we recommend to Council the reaffirmation of the recommended condition placed on this subdivision in July 29,1997 stating "subject to the applicant reducing the proposed parcel size to the required 4 hectare maximum".
