Minutes Minutes of the May 26, 1998 meeting was presented to the Commission. Moved by Councillor Baksa that we adopt these minutes as circulated. Carried. 3. Call for Post Agenda Items The Chairman called for post agenda items. 4. Adoption of Agenda Moved by Councillor B. Scheuerman that the agenda be adopted as amended. Carried. June 30, 1998 Page 46 5. Business from Minutes ~' 12-1 Street Signs for Subdivisions This item will be brought back to a future meeting. 8-1 Proposed Amendment to Land Use Bylaw #1004-90 Mobile Homes & Moved-In Buildings in the Hamlet of Scandia Administration presented information on Council's decision with regard to this item. 6. Subdivisions 1. 98 NL 12 - Pt. NW 4-20-14-W4 -Duchess Scheuerman. Bernard Councillor Scheuerman declared a pecuniary interest and excused himself from discussion or voting on this item. He left the Council Chambers at 10:07 a.m. Arrived at Meetine J. Doerksen arrived at the meeting at 10:12 a.m. Moved by Councillor Baksa that we recommend to Council approval of this subdivision subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water; subject to the applicant entering into an agreement with the County of Newell for the widening of the existing approach for joint access by both the proposed and remnant parcels; and subject to the signing of a joint access agreement for use of the single access. Carried. Councillor Scheuerman returned to the Council Chambers and resumed participation in the meeting at 10:28 a.m. .,~' June 30, 1998 Page 47 ~^ 7. Permits 1. Development Permit Application # 1837 -Plan 1872FR, Parcel A (NE 4-1A-14-W4) Art's Pipeline Contracting Inc -Renewal of Permit for Temp rarv Office Steve Schekk, of Art's Pipeline Contracting Inc., was in attendance to present information on this application. Moved by Councillor Baksa that we approve Development Permit Application #1837 of Art's Pipeline Contracting Inc. for the renewal of a permit for a temporary office in Pazcel A, Plan 1872 FR (NE 4-19-14- W4) subject to the following conditions: 1. That this use be classified as a "Temporary Office Complex" being a non- conforming use within the subject property legally described as Plan 1872FR, Pazcel A, (NE 4-19-14-W4M, under the CR -Country Residential District. 2. That this use shall comply with all Federal, Provincial, Municipal, Statutes, Regulations, Codes and Standazds. 3. That this use shall be located as shown in the site plan originally submitted in May 1994 as approved June 21, 1994. Any changes to that location shall void this development permit. ~-- 4. That the temporary office complex may not be enlazged, added to, or structural alterations made to it during the time this development permit is in effect, except for routine maintenance of the building or if the development authority considers it necessary. 5. That if the temporary office complex is damaged or destroyed to the extent that it loses more than 75% of the building, this development permit shall be void. 6. That should Art's Pipeline Contracting Inc. vacate the subject property legally described as Plan 1872FR, Parcel A, the temporary office complex shall be removed and this development permit shall be void. 7. That this development permit is valid for a period of two years from the decision date. The applicant shall submit a development permit application at least one month before the expiry date and the Municipal Planning Commission may determine if development permit #1837 should be renewed. Development Permit Application #1839 -Plan 9611766, Block 3, Lot 1 Navratil, Lamar -Relocation of Mobile Home "` Lamar Navratil was in attendance to present information on this application. Moved by A. Zagorsky that we approve Development Permit Application #1839 of Lamar Navratil for the relocation of a mobile home onto Lot 1, Block 3, Plan 9611766 subject to the following conditions: 1. That this use be classified as a "Mobile Home" being a discretionary use within the CR-Country Residential District. 2. That this use shall comply with all Federal, Provincial, Municipal statutes, regulations, codes and standards. 3. That this use shall comply with the provisions of Section 51 of the Land Use Bylaw #1004-90 pertaining to the Country Residential District. 4. That the development shall be located as shown on the site plan submitted June 16, 1998. Any changes to that plan shall require the written approval of the Development Control Officer. 5. That this permit shall be for the development of a mobile home as shown in the pictures provided by the applicant and forming a part of the development permit application. Any additional development shall require a separate development permit application and approval. 6. That this use shall comply with the Alberta Building Code, where applicable. 7. That the developer shall be responsible for obtaining all required permits (i.e., building, electrical, plumbing, heating and ventilation) from an accredited inspection agency (see attachment for companies). 8. That the developer shall ensure that the proposed development complies with the following minimum setback requirements: Front Side Flankage Rear *7.5m 3m *7.5m 7.5m *Minimum yard distance from subdivision streets or service roads. 9. That the developer shall ensure an adequate supply of water is provided for this use. June 30, 1998 Page 49 ~ 10. That the developer shall ensure proper disposal of sewage and waste from this use. l 1. That the developer shall ensure that the property is maintained to the satisfaction of the Development Control Officer. 12. That the developer shall ensure that construction materials, supplies, equipment are stored on the property. 13. That the developer shall ensure the continuous clean-up of construction debris tracked onto the public roadway where access is provided to the property. 14. That the mobile home shall be skirted to the satisfaction of the Development Control Officer. ' 15. That the mobile home shall be inspected by the Development Control Officer when it is located on Lot 1, Block 3, Plan 9611766, and, if required, the developer shall be responsible for siding the mobile home with new materials to the satisfaction of the Development Control Officer. 16. That no other mobile home shall be permitted on the property except for the one granted approval under development permit application #1837 and as provided ~ for under Section 31 of the County of Newell Land Use By-Law # 1004-90. Carried. Mr. Navratil then asked the procedure for getting a portion of a road allowance closed. 8. Land Use Changes 1. 12-18-15-W4 - McColman /Martin -Agricultural to Resort Re idential 1 Dean Martin, Bill McColman and Ed Sweep were in attendance to present information on this application. Moved by Councillor Scheuennan that we recommend to Council approval of Land Use Amendment A -Agricultural District to RR1 -Resort Residential District for Section 12-18-15-W4M: subject to the amendment only coming into effect upon the approval of an Area Structure Plan for the development as well as registration of the subdivision plan, and other plans as may be required, with the Land Titles Office. Carried. June 30, 1998 Page 50 Subdivisions (cont'd) 2. 98 NL 13 - Pt. SE 18-19-14-W4 -Brooks Christianson. Cam - Reesor, Robert Moved by Councillor Baksa that we recommend to Council approval of this subdivision subject to the applicant entering into a service agreement with the County to install an approach, to be located to the west of the existing undeveloped road allowance at a location to the satisfaction of the Public Works Department, to the subject property with no access to the Trans Canada Highway permitted; subject to a caveat being placed on the title of the proposed parcel that states when it is further subdivided, a 20 m wide service road is constructed along the southerly boundary or to the satisfaction of the County to provide access to the separate parcels; subject to the applicant dedicating a 5-metre road right-of--way along the proposed parcel; subject to the applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water; subject to payment of money in-place-of municipal reserve in the amount of $11,499.00, being 10% of the existing market value of the land. Carried. 9. Development Report The Development Report for May 20, 1998 to June 23, 1998 was presented to the Commission. Moved by J. Doerksen that we approve this report. Carried. 10. Correspondence 1. Town of Brooks - Development Application 98-D-151. Motel & Restaurant Moved by A. Zagorsky that we send a letter to the Town of Brooks advising that we have no objection to the above-noted Development Application. Carried. 2. Gord Shaw Planner - AB Development Officers Association's Annual Conference Moved by Councillor Baksa that County Planner, G. Shaw, be allowed to attend the Alberta Development Officers Association's Annual Conference in Ft. McMurray, Sept. 13 - 15, 1998. Carried. Permit #83 -McCandless, Beth & Fisher, Todd - Breeding Kennel - NE 1 /4-29-19-14-W4 Beth McCandless and Todd Fisher were in attendance to present information on this application. Moved by Councillor Baksa that we approve Home Occupation Permit #83 for a Breeding Kennel on the NE 1/4-29-19-14-W4 subject to the following conditions: 1. That this use is classified as a home occupation being a discretionary use within the A-Agricultural District. 2. That this use shall comply with all Federal, Provincial and Municipal statutes, regulations, codes and standards. ,-- 3. That this use shall not affect the residential use of the property or adjacent properties and area. 4. That the total number of off-site employees, not including the occupants of the residence, involved with the said occupation shall not exceed two. 5. That there shall be no outside storage of goods or materials, excepted as noted in these conditions. 6. That there shall be no noise, vibration, smoke, dust or odours created from this home occupation which may affect adjacent land owners or development. 7. That no more than 10 adult dogs shall be permitted in the breeding kennel at one time and no more than 10 dogs for obedience lessons on the property at one time. 8. That this home occupation permit shall be valid for a time period until December 31, 1999. Renewal of this permit shall be subject to the applicants' performance during that time period. Carried. Permit #82 - Turuk, Rod -Outdoor Power Equipment Servicing & Repairs NE 1/4-3-21-14-W4 -Duchess ~'~ Rod Turuk and Jacquie Eaton were in attendance to present information on this application. Moved by Councillor Scheuerman that we approve Home Occupation Permit #82 of Rod Turuk for Outdoor Power Equipment Servicing & Repairs located at NE 1/4 - 3-21-14-W4 subject to the following conditions: 1. That this use is classified as a home occupation being a discretionary use within the A-Agricultural District. 2. That this use shall comply with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. That this use shall not affect the residential use of the property or adjacent properties and area. 4. That the total number of off-site employees, not including the occupants of the residence, involved with the said occupation shall not exceed two. 5. Subdivision of Farmstead Parcel - SW 16-20-15-W4 -Plan 9710978 Block 1 This item was discussed and direction given to the Planner. 13. Post Agenda Items 1. Change to Subdivision Application 98 NL 11 - Ptn. LSD 4-9-19-14-W4 -Brooks Theatre Holding Moved by Councillor Scheuerman that we recommend to Council approval of this subdivision subject to the following conditions: r 1. The applicant consolidates Block C, Plan 7220GQ with LSD 4-19-14-W4M at the time of registration of the subdivision plan. 2. That a caveat be registered on title by Alberta Transportation & Utilities fora 20 m wide service road along the most southerly property lines of the proposed 6.0 acre parcel and the .66 acre parcel from the western boundary of the residential property to the intersection of 1st Street E and 15th Avenue W. This service road shall be at the developer's expense. 3. That when this service road is constructed, Instrument #841 202 003 be discharged from title and any existing access utilized by the residence be removed at the developer's expense. 4. That the County of Newell waives the .5 ha minimum parcel size requirement from the I -Industrial District for the .267 ha parcel to be subdivided in this subdivision. Carried. 14.
