Minutes of Municipal Planning Commission Meeting '
September 29, l 998
The regular Municipal Planning Commission Meeting of the County of Newell No.4
was held in the County Office at Brooks, AB on Tuesday, September 29, 1998
commencing at 10:00 a.m.

Moved by Councillor Baksa that J. Doerksen be excused from this meeting. Carried.
2. Minutes
Minutes of the August 18, 1998 meeting were presented to the Commission. Moved
by Councillor Baksa that we adopt these minutes as circulated. Carried.
3. Call for Post Agenda Items
The Chairman called for post agenda items.
4. Adoption of A eg_nda
Moved by A. Zagorsky that the agenda be adopted as amended. Carried.

The County Planner presented a Community Identification System Draft Policy to the
Commission. Moved by Councillor Baksa that this item be tabled to the next MPC
meeting and that copies of this report be distributed to Council for discussion at their
November Council meeting. Carried.
13-1 Lake Newell Estate Peninsula Development
The County Planner presented a report on Lake Newell Estate Peninsula Development.
Tllis report will be brought back to the next meeting.
6. Permits
There were no new Permits.
7. Home. Occupation Permits
There were no new Home Occupation Permits.
8. Land Use Changes
1. Text Amendment -Section 39(2)(b) -Jager Developments Inc.
Cow~ty Planner, G. Shaw, presented a proposal with regard to Encroachments onto
Front or Rear Yard Setbacks to the Commission. Moved by Councillor Baksa that we
recommend to Council that the current wording for Section 39(2)(b) be amended from
its current text to the following:
"(h) un unenclosed verunduh, porch, balcony,.~irepluce, chimney or other similur
prgjectivns us determined by the Development Officer, which prgject not
more thun LS metres over or on u minimum front yr rear setback, or, in the
RRI -Resort Residential Distric[ and RR2 -Resort Multi-Fumily Residential
District, 3.0 metres over or on u minimum rear selhuck; or" Carried.

2. SW 1-19-15-W4 -Troidl, Terry
r~ Urban Fringe to Mobile Home Park
Terry Troidl was in attendance to present informatiotl on this proposed Land Use
Change. Moved by Councillor Scheuerman that we recommend to Council approval
of this Land Use Change and that Council waive Section 61.3 of Land Use Bylaw
#1004-90 being the maximum mobile home parks size of 4 ha or 10 ac. Carried.
9. Subdivisions
1. 98 NL 16 - Pt. SE 19-19-15-W4M -Division 5
Harbinson. John -Farmstead Separation
Moved by A. Zagorsky that we recommend to Council approval of this subdivision
subject to the applicant meeting all requirements of the Eastern Irrigation District with
respect to the conveyance of water as well as easements for the drainage work located
in the quarter section; subject to the registration of a caveat for the dedication of 5-
metresalong the easterly boundary of the proposed and remnant parcel for future road
widening to be purchased at a rate that is consistent with County policy at that time;
and subject to the applicant entering into an agreement with the County of Newell for
the installation of any required accesses for the proposed and remnant parcels. Carried.

Moved by Councillor Baksa that we recommend to Council approval of this
subdivision subject to the applicant entering into an agreement with the County of
Newell for the installation of an approach from the proposed parcel to the lane.
Carried.
3. 98 NL 18 -Plan 5436FC, Parcel `A' - NE 6-22-14-W4 -Division 8
Livingston, Thomas - 10 Acre Farmstead Separation
Moved by Councillor Scheuerman that we recommend to Council approval of this
subdivision subject to the applicant meeting all requirements of the Eastern Irrigation
District with respect to the conveyance of water; subject topayment ofmoney in-place-
of municipal reserve in the amount of $220.00 per acre, being 10% of the existing
market value of the land; and subject to the deferred reserve caveat registered against
the title in Instrument #771174344 being adjusted to reflect the amount of Municipal
Reserve to be taken in this application. Carried.

Bell Stewart & .fenny -Title Split -Country Residential Parcel
Stewart & ,fenny Bell were in attendance to present information on this proposed
subdivision. Moved by Councillor Baksa that we recommend to Council approval of
this subdivision subject to the applicant meeting all requirements of the Eastern
Irrigation District with respect to the conveyance of water; subject to the applicant
entering into an agreement with the County of Newell for the installation of an
approach to the proposed parcel and subject to obtaining any required franchise utility
easements for the provisiotl of services to the proposed parcel. Carried.
10. Development Report
The Development Report for August 12`", 1998 to September 22"~, 1998 was
presented to the Commission. Moved by A. Zagorsky that we approve this report.
Carried.
ll. Correspondence
1. Laurel & Frank Wilson -Subdivision Proposal
A letter from Laurel & Frank Wilson, with regard to a Subdivision Proposal, was
presented to the Commission for information.
2. Town of Brooks -Proposed Amendments to
SE Sector Area Structure Plan and Land Use Bylaw
A letter from the Town of Brooks, with regard to a notice of proposed amendments to
SE Sector Area Structure Plan and Land Use Bylaw, was presented to the Commission
as information.

,,._ 3. University of Alberta faculty of Extension -Introduction to Plannin~N,
Course Information, Isom the University of Alberta Faculty of Extension, with regard
to Introduction to Planning Law, was presented to the Commission. Moved by
Councillor Baksa that we approve the attendance of the County Planner at the
Introduction to Planning Law course being given at the University ofAlberta. Carried.
12. Other Business
Moved by Councillor Baksa that we recommend to Council that they look into the
feasibility ofdisbanding the Intermunicipal Planning Commission and that this be done
in consultation with the Intermunicipal Planning Commission members. Carried.

Planning Commission meeting. Carried.

2. Agricultural District -Minimum Area for Agricultural Residence
Moved by Councillor Baksa that the minimum area for Farm Use and the minimum
area for Agricultural Residence be reviewed at an MPC meeting in the new year.
Carried.

1. UMA Engineering Ltd - Westside Park Residential Development
Moved by Councillor Scheuerman that this item be referred to the October 5`~', 1998
Mw~icipal Committee Meeting. Carried.

2. Unit #3, Plan 9411175 -Lake Newell Resort
Variance to Rear Yard Setback Requirements
Moved by Councillor Baksa that we grant a 1.01 m (3.31 ft) variance to permit a deck
to encroach 2.51 m onto the minimum rear yard setback requirement of 7.5 m as
described in the RR 1 -Resort Residential District for Unit #3, Plan 9411176. Carried.
3. Land Use Bylaw Amendment -Mobile Home Park Pads
An amendment to the Land Use Bylaw for Mobile Home Park Pads is to be drafted for
the next meeting of the MPC.
4. Road Approaches
Road approach requirements were discussed.

A question period was held.
