Minutes of Municipal Planning Commission Meeting
r- August 29, 2000
The regular Municipal Planning Commission Meeting of the County of Newell No.4 was
held in the County Office at Brooks, AB on Tuesday, August 29, 2000 commencing at
10:00 a.m.

Moved by Councillor Douglass that Councillor Steinbach be excused from this meeting.
Carried.
2. Minutes
Minutes of the August 1, 2000 meeting were presented to the Commission. Moved by J.
Doerksen that we adopt these minutes as circulated. Carried.
3. Call for Post Agenda Items
The Chairman called for post agenda items.
4. Adoption of A eg nda
Moved by Councillor Douglass that the agenda be adopted as amended. Carried.
5. Business from Minutes
12-3 Abandoned Rail Rights-of-Way - Storage of Railway Equipment
The Planner gave a verbal update of this item.

There was no new information on this item.
13-1 Timko, George & Vauxhall Co-op Petroleum Ltd. -Division 5
Pt. NW 28-18-14-W4 -Urban Fringe District to Light Industrial District
Miles Longman and Cliff McDonald, of Vauxhall Co-op Petroleum Ltd., were in
attendance to present information on this Land Use Change application. Moved by B.
M`Kellar that we recommend to Council that consideration be given to first reading of a
bylaw to amend the land use district described as Pt. NW 28-18-14-W4 from OF -Urban
Fringe District to LI -Light Industrial District. Carried.
6. Development Permits
There were no Development Permit applications.
7. Home Occupation Permits
There were no Home Occupation Permit applications.
8. Subdivisions
1. 00 NL 025 -Plan 5280 FK, Block 6, Lot 15 -Division 1
Drake, Ella -Residential Subdivision
Moved by Councillor Douglass that we recommend to Council approval of Subdivision
Application 00 NL 025 for the subdivision of Lot 15, Block 6, Plan 5280 FK subject to
the applicant entering into an agreement with the County of Newell for the installation of
an access from the proposed parcel to the lane. Carried.
9. Development Report
The Development Report for July 25, 2000 to August 22, 2000 was presented to the
Commission. Moved by J. Doerksen that we approve this report. Carried.

1. Variance to Land Use Bylaw - Pt. SW 15-21-18-W4 -Division 6
Section 44 -Setback Requirements from Centre of County Road
Moved by B. M`Kellar that we grant approval to vary Section 44 of Land Use Bylaw
# 1004-90 to allow the barn and other structures to remain closer than 40 m to the centre
of the County road for land legally described as the Pt. SW 15-21-18-W4. Carried.
2. Community Development Plan for the Hamlet of Rollin Hgills.
A letter from the University of Calgary, Faculty of Environmental Design, accepting the
Community Development Plan for the Hamlet of Rolling Hills as a project for the Fall
Term 2000, was presented to the Commission. Moved by Councillor Douglass that this
letter be accepted as information and forwarded to Council. Carried.
12. Land Use Changes
Village of Tilley -Plan 9310842, Block 6, Pt. NW 35-17-13-W4 -Division 2
A -Agricultural District to P-WTS -Public Waste Transfer Site District
Proposed Waste Transfer Station (Former Landfill Site)
Moved by J. Doerksen that we recommend to Council that consideration be given to first
` reading of a by-law amending the land use designation for Plan 9310842, Block 1 within
Pt. N W 35-17-13-W4M from A-Agricultural District to P-WTS -Public -Waste Transfer
Site District subject to the approval of a development application for the operation of a
waste transfer site at this site within one year of third reading of this bylaw and that this
amendment does not take affect until such time as a subdivision plan is registered at Land
Titles Office. Carried.
2. Wigemyr, Becky - Pt. NW 31-18-15-W4 -Division 5
A -Agricultural District to CR2 -Country Residential 2 District
To Create Three Country Residential Parcels
Becky Wigemyr was in attendance to present information on this item. Moved by J.
Doerksen that we recommend to Council that consideration be granted to giving first
reading of a bylaw to amend the land use zoning of Pt. NW 31-18-15-W4 from A -
Agricultural District to CR2 -Country Residential 2 District subject to the change not
taking affect until a subdivision plan is registered at the Land Titles Office. Carried.

13. Post Agenda Items
Permit #2132 -Plan 91 10029, Block 8 -Hamlet of Rolling Hills -Division 1
Hirch, Dorothy -Move-in Residence in A -Agricultural District
Moved by B. M°Kellar that we approved Development Application #2132 to relocate a
single family residence as shown in the colour photographs included with the application
onto Plan 91 10029, Block 8 subject to the following conditions:
1. That this use be classified as a "Moved-in Building" to be used as a residence being
a discretionary use within the A -Agricultural District. The Municipal Planning
Commission grants approval to Development Permit #2132 based on the future
zoning of this property being HR -Hamlet Residential District when the land use
amendment and subdivision application have been approved by the municipality.
This approval is also granted through Section 9(4) of Land Use Bylaw # 1004-90.
2. That this use shall comply with all Federal, Provincial and Municipal statutes,
regulations, codes and standards.
3. That this use shall comply with the provisions of Section 57 of Land Use Bylaw
# 1004-90 pertaining to the HR -Hamlet Residential District.
4. That the development shall be located as shown on the site plan submitted August
25, 2000. Any changes to that plan shall require the written approval of the
Development Officer.
5. That this use shall comply with the Alberta Building Code where applicable.
6. That the developer shall obtain all required permits (i.e. electrical, building, heating,
ventilation, gas and plumbing) from an accredited inspection agency.
7. That the developer shall provide to the Development Officer a copy of the building
permit prior to commencement of construction.
8. That the developer shall ensure an adequate supply of water is provided for this use.
9. That the developer shall ensure the proper disposal of sewage and waste from this
use.
10. That the developer shall ensure that the property is maintained to the satisfaction of
the Development Officer.
1 1. That the developer shall ensure that construction materials, supplies and equipment
are stored on the property and not on the public roadway.
12. That the developer shall ensure the continuous clean up of construction debris
tracked onto the public roadway where access is provided to the property.
13. That the developer shall ensure that the following minimum yard set-backs are
maintained for this development:

14. That this approval is granted only for the development of the relocation of a single
family residence as shown in Development Application #2132 to within Plan
91 10029, Block 8. All other development shall require separate applications and
approvals.
15. That the developer shall ensure the moved-in building is placed on a concrete
foundation or basement within 90 days following the date of approval.

16. That the applicant provide to the county an irrevocable letter of credit in the amount
of $15,000.00 so that, in the event the residence is not placed on a concrete
_ foundation or basement within 90 days or has not applied for the rezoning or
subdivision of the property within 30 days, the County may use these funds to
complete these conditions and/or remove the dwelling from the property.
17. That the developer or land owner apply for a land use amendment for Plan 91 10029,
Block 8 from A -Agricultural District to HR -Hamlet Residential District within
30 days of the date of this approval.
18. That the developer or land owner apply within 30 days of the date of this approval
for subdivision of Plan 91 10029, Block 8 to create a single lot for this relocated
residence so that the subject property complies with Land Use Bylaw #1004-90.
19. That this application is subject to a site inspection conducted by the Development
Officer within six months from the date of approval to ensure that all conditions are
satisfactory to the municipality. The developer shall be responsible for arranging
a suitable date and time for this inspection.
20. That the developer shat I be responsible for all costs associated with the modification
of water and sewer services to provide service to the moved-in building. All work
shall be to the satisfaction of the Chairperson, Hamlet Advisory Committee. The
developer shall also be responsible for the restoration of the street when these
services are installed to the satisfaction of the Superintendent of Public Works.
21. That no occupancy of the residence shall be permitted prior to the approval of the
land use amendment and the subdivision.
Carried.
• 2. Dick Dick - Hayshed
The Planner informed the Commission that he inspected the foundation of the hayshed
and found that it was within County setback requirements.
3. Town of Brooks -Municipal Development Plan
Moved by J. Doerksen that a letter be sent to the Mayor and Council of the Town of
Brooks expressing our concern that the MPC were not given sufficient time to review and
respond to their proposed Municipal Development Plan. Carried.
4. A&ERV
A lengthy discussion was held on enforcing non-compliance of the County's Land Use
Bylaw.
