Minutes of Municipal Planning Commission Meeting
December 19, 2001
The regular Municipal Planning Commission Meeting ofthe County ofNewell No.4 was held
in the County Office at Brooks, AB on Wednesday, December 19, 2001 commencing at 10:00
a.m.

1. Call to Order
The Chairman called the meeting to order.
2. Excused from Meeting
All members were in attendance at this meeting.
3. Minutes
Minutes of the November 28, 2001 meeting were presented to the Commission. Moved by
R. Steinbach that we adopt these minutes as circulated. Carried.
4. Call for Post Agenda Items
The Chairman called for post agenda items.
5. Adoption of Agenda
Moved by Councillor Musgrove that the agenda be adopted as amended. Carried.

Correspondence
1. Town of Brooks - 2001 LUB 015 -Eastern Irrigation District
A letter from the Town of Brooks, regarding Land Use Bylaw Amendment Application 2001
LUB 015 for the Eastern Irrigation District, was presented to the Commission. Direction was
given that we inform the Town of Brooks that we have no objections to this application.
2. Town of Brooks - 2001 SUB 15 -Martin Enterprises Ltd.
A letter from the Town of Brooks, regarding Subdivision Application 2001 SUB 15 for
Martin Enterprises Ltd., was presented to the Commission. Direction was given that we
inform the Town of Brooks that we have no objections to this application.
10. Development Permits
1. Permit #2303 - NW 17-20-13-W4 -Division 3
Shannon Terry & Barb (Low Land Construction -Owner) -Mobile Home
Moved by Councillor Musgrove that we approve Development Permit Application #2303 to
locate a mobile home onto the NW 17-20-13-W4 subject to the following conditions:
1. This use being classified as a "Mobile Home" being a permitted use within the A -
Agricultural District.
,... 2. This use complying with all Federal, Provincial and Municipal statutes, regulations,
codes and standards.
3. This use complying with the provisions of Section 49 of Land Use Bylaw #1004-90
pertaining to the A -Agricultural District.
4. The development being located as shown on the site plan submitted on November 26,
2001. Any change to that plan shall require the written approval of the Development
Officer.
5. This use complying with the Alberta Building Code where applicable.
6. The developer obtaining all required permits (i.e. electrical, building, heating,
ventilation, gas and plumbing) from an accredited inspection agency.
7. The developer providing to the Development Officer a copy of the building permit
issued by a licensed, accredited building inspection agency for the County of Newell
prior to the commencement of construction.
8. The developer ensuring that an adequate supply of water is provided for this use.
9. The developer ensuring proper disposal of sewage and waste from this use.
10. The developer ensuring that the property is maintained to the satisfaction of the
Development Officer.
11. The developer ensuring that construction materials, supplies and equipment are stored
on the property and not on the public roadway.
12. The developer ensuring the continuous clean-up of construction debris tracked onto the
public roadway where access is provided to the property.
13. The developer ensuring that the following minimum yard setbacks are maintained for
the development:

14. This permit only being for the development of a Mobile Home as required as part of the
agricultural operation at NW 17-20-13-W4. Any additional development shall require
approval by a separate development permit.
Carried.
2. Permit #2306 - SE 16-17-12-W4 -Division 2
Grant Thompson (Imperial Oil -Owner) -Replace Existing Office Trailer
Grant Thompson was in attendance to present information on this application. Moved by
Councillor Loewen that we approve Development Permit Application #2306 to replace an
existing office trailer within the SE 16-17-12-W4 granting a setback waiver to allow the
building to be placed 30 metre from the centre line of the public road subject to the following
conditions:
1. This use being classified as "Oil & Gas Facilities" being a discretionary use within the
A -Agricultural District.
2. This use complying with all Federal, Provincial and Municipal statutes, regulations,
codes and standards.
3. This use complying with the provisions of Section 49 of Land Use Bylaw #1004-90
pertaining to the A -Agricultural District.
4. The development being located as shown on the site plan prepared on November 26,
2001. Any change to that plan shall require the written approval of the Development
Officer.
5. This use complying with the Alberta Building Code where applicable.
6. The developer obtaining all required permits (ie: electrical, building, heating,

requirement of front yard from 40 metres to 30 metres.

15. This permit being for a trailer which may be used only for:
a) The storage of documents that are directly related to the operational requirements of
~' the oil and gas facility located on the same property at SE 16-17-12-W4, and
b) For a lunch/shelter facility for employees who are exclusively engaged in operational
and maintenance duties associated with the oil and gas facilities located on the same
property at SE 16-17-12-W4.
16. Any additional use of the trailer or any additional development shall require prior to
approval by a separate development permit.
Carried.

There were no Home Occupation Permit applications.
12. Subdivisions
1. O1 NL 035 - Pt. NW 14-17-13-W4 -Division 2
Onda, George -Agricultural Subdivision
George Onda was in attendance to present information on this item. Moved by Councillor
Loewen that we recommend to Council approval of Subdivision Application O1 NL 035 for
an agricultural subdivision in a Portion of the NW 14-17-13-W4 subject to the following
conditions:
1. The registration of a deferred municipal reserve caveat against the southerly parcel of
.-. NW 14-17-13-W4 containing 7.8 acres of land. The amount of the municipal reserve
required will be calculated at the time the applicant provides a plan of subdivision to the
municipality for endorsement.
2. The registration of a caveat for the dedication of a 5-metre strip of land along the
westerly boundary of the proposed and remnant parcels for future road widening to be
purchased at a rate that is consistent with County policy at that time
3. All oil and gas company leases, rights-of--way, Board Orders, etc. being carried forward,
as required, when the subdivision mylar is registered at Land Titles Office.
4. The applicant meeting the following Eastern Irrigation District requirements:
a) All "irrigation acres" within the proposed lot containing 10 acres (more or less)
shall be removed from the water roll of the District.
b) The applicant entering into a household purposes agreement with the District, for
this 10 acre lot. The water shall be used for household purposes only as defined in
the Irrigation Districts Act.
c) The applicant providing a registrable easement for the District's drain and canal
which physically divides this quarter into three distinct areas. The rights of way for
these District's works will most likely be the boundaries for the proposed parcels.
5. The applicant providing easements to franchise utilities for providing services to the
proposed and remnant parcels. The applicant may be responsible for the costs
associated with the installation, removal or modification of services.

13. Land Use Changes
1. Bill & Cliff Sewell - Pt. SE 30-18-14-W4 -Division 5
OF -Urban Fringe District to DC -Direct Control District
Bill Sewell was in attendance to present information on this application. Moved by R.
Steinbach that we recommend to Council that consideration be given for a land use change
in a portion of the SE 30-18-14-W4 from OF -Urban Fringe District to DC Direct Control
District. Carried.

15. Post Agenda Items
1. Benci Area Structure Plan Amendment
This item will be dealt with later in the meeting.
2. Meeting Date Changes
Moved by R. Steinbach that the January 28`x, 2002 meeting be moved to February 6~, 2002. _
Carried. Moved by Councillor Loewen that the March 26th, 2002 meeting be held on March
28`x, 2002. Carried.
Lunch
The Commission recessed for lunch from 11:47 a.m. to 1:20 p.m.
Pat Maloney, of EBA Engineering Consultants Ltd., was in attendance for the remainder of
the meeting.

Post Agenda Items (cont'd)
,,,, 1. Benci Area Structure Plan Amendment (cont'd)
The Planner reviewed the proposed amendments to the Benci Area Structure Plan. Ben
Plumer was in attendance to present information on this proposal. Moved by Councillor
Loewen that we recommend to Council that they deny the Benci Area Structure Plan
Amendment. Carried. The Commission felt that the increased density of the proposal
changes the whole concept of the original Area Structure Plan. There was concern expressed
regarding the low lying area, the changing of the green area as well as the close proximity to
the gas well.
