Alberta Agriculture -Confined Feeding Operations A memo from Lloyd Healy of Alberta Agriculture, regarding confined feeding operations was presented to the Commission as information. 2. Town of Brooks -Southeast Sector Area Structure Plan & Open House A letter from the Town of Brooks, regarding the Southeast Sector Area Structure Plan and Open House, was presented to the Commission. The Town of Brooks will be informed that the County will require input where their proposed industrial bypass roads connect with County roads. 10. Development Permits 1. Permit #2304 - NW 6-17-12-W4 -Division 2 .-. Wester, Lyndon - 2"d Dwelling and Shop Moved by Councillor Loewen that Development Permit Application #2304 be approved for a second dwelling and shop to be located within the NW 6-17-12-W4 subject to the following conditions: 1. This use being classified as "Dwelling Unit" and "Accessory Building and Uses" being discretionary uses within the A -Agricultural District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the provisions of Section 49 of Land Use Bylaw #1004-90 pertaining to the A -Agricultural District, unless variances are granted by the Municipal Planning Commission. 4. This development shall be located as shown on the site plan submitted on November 30, 2001. Any change to that plan shall require the written approval of the Development Officer. 5. This use complying with the Alberta Building Code, where applicable. 6. The developer obtaining all required permits (i.e. electrical, building, heating, ventilation, gas and plumbing) from an accredited inspection agency. 7. The developer providing, to the Development Officer, a copy of the building permit issued by a licenced, accredited building inspection agency for the County of Newell prior to the commencement of construction. 8. The developer ensuring that the following minimum yard is maintained for the development. The development permit for the second dwelling unit being granted for a temporary period of three years after which time the permit will expire and cease to be valid. The second dwelling unit must be removed from the site three years after the date this permit is granted. Should the grounds for relaxation continue to be valid, a new development permit maybe applied for requesting consideration of approval for another temporary period. 15. The shop being used only for the storage of machines used for agricultural purposes. The shop, at no time, shall be used for any habitation or other residential purpose and shall at no time be used for any commercial purpose. 16. This permit being only for the development of a dwelling unit and a shop at NW 6-17-12- W4. Any additional development shall require a separate development application and approval. Carried. 2. Permit #2317 -Plan 0110100, Block 2 (SW 29-20-13-W4) -Division 3 Torkelson Eugene -Construct Shop Eugene Torkelson was in attendance to present information on this application. Moved by Councillor Musgrove that we approve Development Permit Application #2317 to construct a shop within Plan 0110100, Block 2 (SW 29-20-13-W4) subject to the following conditions: 1. This use being classified as "Similar Use to Farm Subsidiary Occupation" being a discretionary use within the A -Agricultural District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations codes and standards. 3. This use complying with the provisions of the A -Agricultural District of Land Use Bylaw # 1004-90. 4. The development being located as shown on the site plan submitted on January 30, 2002. Any change to that plan shall require the written approval of the Development Officer. 5. This use complying with the Alberta Building Code, where applicable. 6. The developer obtaining all required permits (i.e. electrical, building, heating, ventilation, gas and pluming) from an accredited inspection agency. 7. This permit being for a shop which may be used only for a farm services business related to: 1. baling 2. hauling hay 3. stacking hay 4. storage of equipment related to this business Any additional use or development shall require prior approval by a separate development ~- permit. Permit #2310 - NW 29-17-16-W4 -Division 4 Bow City Community Hall -Cemetery Bow City Community Hall representative, Joyce Calvert, was in attendance to present information on this application. Moved by Councillor Musgrove that we approve Development Permit Application #2310 to develop a cemetery within the NW 29-17-16-W4 subject to all Provincial requirements being met and that we waive the $100.00 permit application fee. Carried. 11. Home Occupation Permits 1. Permit #116 -Lot 10, Block 2, Plan 7410502 (SE 6-15-13-W4) -Division 1 Sawicki, Terry and Gittens, William - Outstanding Debt Collection Service Moved by Councillor Loewen that we grant approval to Home Occupation Permit Application #116 for an Outstanding Debt Collection Service at Lot 10, Block 2, Plan 7410502 (within a portion of SE 6-15-13-W4) subject to the following conditions: ,~~- February 6, 2002 Page 5 G~' 1. This use being classified as a "Home Occupation" being a discretionary use within the HR - Hamlet Residential District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the provisions of Section 57 of Land Use Bylaw #1004-90 pertaining to the HR -Hamlet Residential District. 4. This use not affecting the residential use of the property or adjacent properties and area. 5. The total number of off-site employees, not including the occupants of the residence, involved with the said occupation shall not exceed two. 6. Only one commercial vehicle being allowed in connection with the proposed home occupation and one off-street parking stall being provided for the same. 7. There being no outside storage of goods or materials. 8. There being no noise, vibration, smoke, dust or odours created from this home occupation which may affect adjacent land owners or development. 9. This home occupation permit being valid for a time period until December 31, 2003, at which time it may be either revoked or renewed by the Municipal Planning Commission for another year. Renewal of this permit shall be subject to the applicant's performance during that time period. The applicant shall be responsible for re-applying one month before the expiry date. 10. This home occupation being granted for a debt collection business operated by the applicant at Lot 10, Block 2, Plan 7410502 (within a portion of SE 6-15-13-W4). Any other type of home occupation shall require a separate application and approval. Carved. 12. Subdivisions 1. 02 NL 002 -Lot 1, Block 3, Plan 0010962 (SW 9-19-14-W4) -Division 2 Drayton Valley Stores -Industrial Subdivision Moved by Councillor Loewen that we recommend to Council approval of Subdivision Application 02 NL 002 for an industrial subdivision of Lot 1, Block 3, Plan 0010962 (within a portion of SW 9-19-14-W4) subject to the following conditions: 1. The registration of a deferred municipal reserve caveat against the proposed and remnant parcels. The amount of the municipal reserve required will be calculated at the time the applicant provides a plan of subdivision to the municipality for endorsement. 2. The applicant entering into an agreement with Alberta Transportation for the upgrading or installation of the road approaches to the newly created parcels, as required. 3. All oil and gas company leases, rights-of--way, Board Orders, etc. being carved forward, as required, when the subdivision mylar is registered at Land Titles Office. 4. The applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water as well as easements. 5. The applicant providing easements to franchise utilities for providing services to the proposed and remnant parcels. Permit #2313 & Permit #2314 - SW 10-19-14-W4 -Division 10 Trendsetter Homes (owner -Johnson Farms Ltd.) - 2 Mobile Homes Neil Johnson, of Johnson Farms Ltd. and Janine Schoeff, of Trendsetter Homes, were in attendance to present information on this application. Moved by Councillor Loewen that the MPC grant a waiver to Section3l(1) of Land Use Bylaw 1004-90 and approve Development Permit Applications #2313 and #2314 for the placement of two mobile homes to be located on the SW 10-19-14-W4 subject to the following conditions: 1. This use being classified as a "Mobile Home" being a discretionary use within the CR - Country Residential District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes or standards. 3. This use complying with the provisions of Section 51 of Land Use Bylaw #1004-90 pertaining to the CR -Country Residential District. 4. This development being located as shown on the site plan submitted on January 24, 2002. Any change to that plan shall require the written approval of the Development Officer. 5. This use complying with the Alberta Building Code, where applicable. 6. The developer obtaining all required permits (i.e. electrical, building, heating, ventilation, gas and plumbing) from an accredited inspection agency. 7. The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection agency for the County of Newell prior to the commencement of construction. r-- 8. Legal and direct access to each home being developed to the satisfaction of the County. 16. This permit being null and void if the preceding conditions have not been met prior to June 30, 2002. 17. The developer supplying to the County an irrevocable letter of credit, enforceable until June 30, 2002, to be used to construct the road and accesses if not built as required. The letter of credit shall be provided prior to commencement of development, in an amount suitable to construct the required road accesses as determined by the Superintendent ofPublic Works. The registration of a caveat for the dedication of a 5-metre strip of land along the easterly boundary of the proposed and remnant parcels for future road widening to be purchased at a rate this is consistent with County policy at that time. 2. SE 2-17-13-W4 -Division 2 Wester Arne & Bessie -Farmstead Separation Moved by Councillor Musgrove that we recommend to Council approval of Subdivision Application O1 NL 036 for a Farmstead Separation within a portion of the SE 2-17-13-W4 subject to the following conditions: 1. The applicant providing municipal reserve in the form of cash-in-lieu in an amount to be determined when a plan of subdivision is returned for endorsement. The applicant will need to submit the required amount to the County prior to endorsement. If the applicant and County cannot agree on the required amount, the applicant may provide their own appraisal by an accredited appraiser, prior to endorsement. 2. The applicant meeting all requirements of the Eastern Imgation District with respect to the conveyance of water as well as easements. 3. The applicant entering into a household purposes agreement with the Eastern Irrigation District. 4. The applicant consolidating, by plan, the remnant parcel with their parcel in SW 3-14-13- W4 containing 80 acres of land. 2. SE 10-14-13-W4) -Division 1 Eastern Irrigation District -Agricultural Subdivision Moved by Councillor Loewen that we recommend to Council approval of Subdivision Application 02 NL 004 for an agricultural subdivision within Parcel A, Plan 5409FF (within the SE 10-14-13-W4) subject to the following conditions: 1. The applicant entering into an agreement with the County of Newell for the installation of any required road approaches to the proposed and/or remnant parcels. 2. The registration of a deferred municipal reserve caveat against the remnant parcel. Councillor Musgrove asked for clarification on conflict of interest guidelines. He was informed that it involved immediate family and pecuniary interest and that it was his decision as to whether or not he felt he had a conflict of interest. Moved by Councillor Musgrove that we approve Development Permit Application #2312 for the relocation of a moved-in building onto Plan 7689FG, Parcel A (within a portion of the SW 29- 20-12-W4) subject to the following conditions: 1. This use being classified as a "Moved-in Building" being a discretionary use within the A - Agricultural District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the provisions of Section 49 of Land Use Bylaw #1004-90 pertaining to the A -Agricultural District. 4. The development being located as shown on the site plan submitted on January 14, 2002. Any change to that plan shall require the written approval of the Development Officer. 5. This use complying with the Alberta Building Code. 6. Moved by Councillor Loewen that we recommend to Council that consideration be given to first reading of a bylaw to change the land use for Block A, Plan 6564ET (within a portion ofNW 32-20-14-W4) from A -Agricultural District to I -Industrial District. Carried. 2. Wiens, David - NW 29-20-14-W4 -Division 8 OF -Urban Fringe District to CR - Country Residential District David Wiens was in attendance to present information on this application. Moved by R. Steinbach that we approve Development Permit Application #2307 to locate a mobile home to be used as a gift shop within the NE 30-20-17-W4 subject to the following conditions: 1. This use being classified as a "Farm Subsidiary Occupation", being a discretionary use within the A -Agricultural District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the provisions of Section 49 of Land Use Bylaw #1004-90 pertaining to the A -Agricultural District. 4. The development being located as shown on the site plan submitted on February 4, 2002. Any change to that plan shall require the written approval of the Development Officer. 5. This use complying with the Alberta Building Code, where applicable. 6. The developer providing, to the Development Officer, a copy of the building permit issued by a licensed, accredited building inspection agency for the County of Newell prior to the commencement of construction. 8.
