Minutes of Municipal Planning Commission Meeting
'^ February 26, 2002
The regular Municipal Planning Commission Meeting of the County of Newell No.4 was
held in the County Office at Brooks, AB on Tuesday, February 26, 2002 commencing at
10:00 a.m.

1. Call to Order
The Chairman called the meeting to order at 10:00 a.m.
2. Excused from Meeting
All members were in attendance at this meeting.
3. Minutes
Minutes of the February 6, 2002 meeting were presented to the Commission. Moved by
Councillor Musgrove that we adopt these minutes as circulated. Carried.
4. Call for Post Agenda Items
The Chairman called for post agenda items.
5. Adoption of Agenda
Moved by Councillor Loewen that the agenda be adopted as amended. Carried.

the Commission to review for the next meeting.

Moved by Councillor Musgrove that the following motion be lifted from the table: "Moved by
Councillor Loewen that we recommend to Council approval of Subdivision Application 02 NL
002 for an industrial subdivision of Lot 1, Block 3, Plan 0010962 (within a portion of SW 9-19-
14-W4) subject to the following conditions:
1. The registration of a deferred municipal reserve caveat against the proposed and remnant
parcels. The amount of the municipal reserve required will be calculated at the time the
applicant provides a plan of subdivision to the municipality for endorsement.
2. The applicant entering into an agreement with Alberta Transportation for the upgrading or
installation of the road approaches to the newly created parcels, as required.
3. All oil and gas company leases, rights-of--way, Board Orders, etc. being carried forward,
as required, when the subdivision mylar is registered at Land Titles Office.
4. The applicant meeting all requirements of the Eastern Irrigation District with respect to the
conveyance of water as well as easements.
S. The applicant providing easements to franchise utilities for providing services to the
proposed and remnant parcels. The applicant may be responsible for the costs associated
with the installation, removal or modification of services. "
Carried. Moved by R. Steinbach that we amend this motion by deleting condition 1 and revising
condition 2 to add "and the applicant construct the balance of the service road" as requested by
Alberta Transportation. Vote on amendment. Carried. Vote on amended motion. Carried.

Moved by Councillor Loewen that we accept the Development Report. Carried.
Direction was given to refund the application fee for Randy & Carolea Renard as this application
was for a farm building and no permit fee was required.

A letter from the Town of Brooks, requesting comments on Subdivision Application 2002 SUB
O1, was presented to the Commission. Administration was directed to respond that we have no
objections to this subdivision application.
10. Development Permits
1. Permit #2321 -Plan 8310857, Lot 1 (SW 5-18-14-W4) -Division 5
Klymochko Al & Sharon -Sin leg_ Family Dwelling with Decks, Garage & Shop
The Planner was directed to get more information on this application.

Edward Piper was in attendance to present information on this application. Moved by B.
McKellar that we recommend to Council that consideration be given to first reading of a bylaw
to change the land use for Lot 1, Plan 9410869 (within a portion ofNE 16-17-16-W4) from A -
Agricultural District to DC -Direct Control District. Carried.

15. Post Agenda Items
1. Permit #2319 - NW 28-18-14-W4 -Division 5
Vauxhall Co-op Petroleum Ltd. -Move In Portable Chemical Shed
Moved by R. Steinbach that we approve Development Permit Application #2319 for a portable
chemical shed to be located in a portion of the NW 28-18-14-W4 subject to the following
conditions:
1. This use being classified as "Accessory Buildings & Uses" being a discretionary use within
the LI-Light Industrial District.
2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes
and standards.
3. This use complying with the provisions of Section 55 of Land Use Bylaw #1004-90
pertaining to the LI-Light Industrial District.
4. The development being located as shown on the site plan submitted on February 07, 2002.
Any change to that plan shall require the written approval of the Development Officer.
5. This use complying with the Alberta Building Code, where applicable.
6. The Developer obtaining all required permits (electrical, building, heating, ventilation, gas
and plumbing) from an accredited inspection agency.
7. The developer providing the Development Officer with a copy of the building permit issued
by a licensed, accredited building inspection agency for the County of Newell prior to the
commencement of construction.
8. The developer ensuring that an adequate supply of water is provided for this use.
9. The developer ensuring the proper disposal of sewage and waste from this use.

16. The enclosed storage being secured and solidly fenced or screened from view so as not to
visually detract from surrounding areas.
17. The developer ensuring that no contamination of ground water or surface water occurs as
a result of the development.
18. This permit only being for the development of a storage building for chemical products at
NW 28-18-14-W4. Any additional development shall require prior approval by a separate
development permit.

Moved by Councillor Loewen that we refuse Development Permit Application #2323 for the
location of three single wide mobile homes onto Lot 28, Block 3 and Lots 25 & 26, Block 7,
Plan 0210404 as this is not a permitted or discretionary use within the Hamlet Single Family
Residential District. Carried.
3. Home Occupation Permit #118 -Plan 8183 FG, Parcel A (SE 1-19-15-W4)

Moved by Councillor Loewen that we approve Home Occupation Permit #118 for an Energy
Therapy business to operate at Parcel A, Plan8183 FG (within the SE of 1-19-15-W4) subject
to the following conditions:
1. This use being classified as a "Home Occupation" being a discretionary use within the UF-
Urban Fringe District.
2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes
and standards.
3. This use complying with the provisions of Section 50 of Land Use Bylaw #1004-90
pertaining to the OF-Urban Fringe District.
4. This use not affecting the residential use of the property or adjacent properties and area.
5. The total number ofoff--site employees involved with the said occupation (not including the
occupants of the residence), not exceeding two.
6. There being no outside storage of goods or materials. -
7. There being no noise, vibration, smoke, dust or odours created from this home occupation
which may affect adjacent land owners or development.
8. The operator contacting the Palliser Regional Health Authority and meeting the
requirements of this Authority.
9. This home occupation permit being valid for a time period until December 31, 2003, at
which time it may be either revoked or renewed by the Municipal Planning Commission for
another year. Renewal of this permit shall be subject to the applicant's performance during
that time period. The applicant shall be responsible for re-applying one month before the
expiry date.
10. This home occupation permit being granted for an energy therapy business operated by the
applicant at Plan 8183 FG, Parcel A (within the SE 1-19-1~-W4). Any other type of home
occupation shall require prior approval by a separate permit.
11. There being no objections from the Town of Brooks.

Moved by Councillor Loewen that we refuse Development Permit Application #2324 for the
location of a single wide mobile home onto Lot 2, Block 7, Plan 1217 B.A. as it is not a
permitted or discretionary use within the Hamlet Single Family Residential District. Carried.

Moved by Councillor Musgrove that we approve Development Permit Application #2325 for an
addition to the mobile home located on Lot 2, Block 1, Plan 9011761 subject to the following
conditions:
1. This use being classified as an "Addition to Mobile Home" being a discretionary use within
the CR-Country Residential District.
2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes
and standards.
3. This use complying with the provisions of Section 51 of Land Use Bylaw #1004-90
pertaining to the CR-Country Residential District.
4. The development being located as shown on the site plan. Any change to that plan shall
require the written approval of the Development Officer.
5. This use complying with the Alberta Building Code, where applicable.
6. The Developer obtaining all required permits (electrical, building, heating, ventilation, gas
and plumbing) from an accredited inspection agency.

6. Town of Brooks -Subdivision 2002 SUB 002
A letter from the Town of Brooks, regarding Subdivision Application 2002 SUB 002, was
presented to the Commission. Administration was directed to reply that development of this
area was premature until the intersection of Joanne Trucking Road and 3'd Street has been
completed; that although the requirements of their area structure plan are met, this development
is incompatible with the adjacent feedlot and Bow Slope Shipping; that if they continue with the
development, they should install bamcades to prohibit unauthorized access to County roads; and
that the outside boundary of the development be bermed and treed to help mitigate things such
as odour and noise from existing incompatible developments.
7. Town of Brooks -Land Use Amendment - 2002 LUB 001
A letter from the Town of Brooks, regarding Land Use Amendment Application 2002 LUB 001,
was presented to the Commission. Administration was directed to respond that we have no
objections to this application.
16. Question Period/Notice of Motion
A question period was held.
Moved by R. Steinbach that an application must be received at least one week prior to the date
of the Municipal Planning Commission meeting to be placed on the agenda for that meeting.
Carried.
