Call to Order In the absence of the Chairman, the Vice-Chairman assumed the chair and called the meeting to order at 10:00 a.m. 2. Excused from Meetine ~-- Moved by R. Steinbach that Councillor Baksa be excused from the meeting. Carried. 3. Minutes Minutes of the March 28, 2002 meeting were presented to the Commission. Moved by B. McKellar that we adopt these minutes as presented. Carried. 4. Call for Post Agenda Items The Vice-Chairman called for post agenda items. 5. Adoption of A enda Moved by R. NW & SW 22-18-15-W4 -Division 5 A -Agricultural District to I -Industrial District Arrived at Meeting Councillor Musgrove arrived at the meeting at 10:16 a.m. Moved by B. McKellar that we recommend to Council that consideration be given to first reading ofa bylaw amending the land use for the W 1/2 ofNW & SW 22-18-15-W4 from Agricultural to Industrial. Carried. 3. Moved by Councillor Musgrove that we accept the Development Report. Carried. 9. Correspondence 1. Town of Brooks -Request for Comments -Application 2002 SUB 003 A letter from the Town of Brooks, requesting comments on Application 2002 SUB 003, was presented to the Commission. A letter will be sent to the Town of Brooks indicating that we have no objections to the proposed subdivision. 2. Lakeside Farm Industries Ltd. -Proposed Development - NE 18-19-14-W4 A letter from Lakeside Farm Industries Ltd., in opposition to the proposed development within the NE 18-19-14-W4, was presented to the Commission as information. 3. Town of Brooks -Draft Southeast Sector Area Structure Plan A letter from the Town of Brooks, requesting comments on the Draft Southeast Sector Area Structure Plan, was presented to the Commission. A letter will be sent to the Town of Brooks indicating our concerns with their proposed transportation route; requesting further details on their storm water management plan, in particular for Area 5, and requesting information on the .-- overflow management plan for Meadow Lake. 10. Development Permits There were no Development Permit Applications. 11. Home Occupation Permits 1. Home Occupation Permit #120 -Plan 2819 D.B. Block 9 Lots 7 & 8 (NE 13-20-13-W4) Conrad M. Hollinger -Peak Solutions Business Software -Division 3 Moved by Councillor Musgrove that we approve Home Occupation Permit #120 for a business to customize and sell accounting software to be located on Plan 2819 D.B., Block 9, Lots 7 & 8, (within the NE 13-20-13-W4) subject to the following conditions: 1. This use being classified as a "Home Occupation" being a discretionary use within the HSF - Hamlet Single Family Residential District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the conditions of Section 56 of Land Use Bylaw # 1004-90 pertaining to the HSF -Hamlet Single Family Residential District. 4. This use not affecting the residential use of the property or adjacent properties and area. 5. The total number of off-site employees involved with the said occupation, not including the Apri130, 2002 Page 35 L~ occupants of the residence, not exceeding two. 6. Only one commercial vehicie being allowed in connection with the proposed home occupation and one off-street parking stall being provided for the same. - 7. There being no outside storage of goods or materials. 8. There being no noise, vibration, smoke, dust or odours created from this home occupation which may affect adjacent land owners or development. 9. This home occupation permit being valid for a time period until December 31, 2003, at which time it may be either renewed by the Municipal Planning Commission for another year or revoked. Renewal of this permit shall be subject to the applicant's performance during that time period. The applicant shall be responsible for re-applying one month before the expiry date. 10. This home occupation permit being granted for a computer software customization business operated by the applicant at the existing house at Plan 2819 D.B., Block 9, Lots 7 & 8 (within the NE 13-20-13-W4). Any other type of home occupation shall require prior approval by a separate application. 11. There being no objections from the Patricia Hamlet Advisory Committee with regard to this application or its conditions. 12. No advertising or display ofproduct being permitted on the property except for one indirectly illuminated sign of 1 square metre placed flat against the building or fence. Carried. 2. Home Occupation Permit #121 -Plan 9611766, Block 4, Lot 9 (SW 10-19-14-W4) Errol Renn -Office for a Mobile Mechanic Service -Division 10 Moved by R. Steinbach that we approve Home Occupation Permit # 121 for an office for a mobile mechanic dispatch service to be located on Plan 9611766, Block 4, Lot 9 (within the SW 10-19- 14-W4) subject to the following conditions: 1. This use being classified as a "Home Occupation" being a discretionary use within the CR - Country Residential District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the provisions of Section 51 of Land Use Bylaw #1004-90 pertaining to the CR -Country Residential District. 4. This use not affecting the residential use of the property or adjacent properties and area. 5. The total number of off-site employees involved with the said home occupation, not including the occupants of the residence, not exceeding two. 6. The storage of goods being entirely within the building and there being no fire or health hazards created. 7. The developer minimizing noise, vibration, smoke, dust or odours created from this home occupation which may affect adjacent land owners or development. 8. No advertising or display of product being permitted on the property except for one indirectly illuminated sign of 1 square metre placed flat against the building or fence. 9. Subdivisions 1. 02 NL 007 -Plan 8310314, Block A (N 'h 22-19-14-W4) Votg_Sylvia -Residential Subdivision -Division 10 Sylvia Vogt and Margaret Krueger were in attendance to present information on this application. Moved by Councillor Musgrove that we postpone making a .decision on this application until the property has been viewed. Carried. 2. 02 NL 008 -Plan 9311324, Block 1, Lot 1 & SW 22-20-14-W4 -Division 8 Peeters-Van Triip Farms Ltd. & Karl D. Gongal - Boundary Adjustment Jake Peeters was in attendance to present information on this application. Moved by R. Steinbach that we recommend to Council approval of Subdivision Application 02 NL 008 for a boundary adjustment within Plan 9311324, Block 1, Lot 1 and v~°ithin a portion of SW 22-20-14- W4 subject to the following conditions: 1. The size of the parcel after the boundary adjustment remaining the same as the size of the .- parcel prior to the boundary adjustment (8.08 ha or 19.97 acres). 2. The applicant entering into an agreement with the County of Newell for the construction and/or upgrading of road approaches to the proposed and remnant parcels as required by the Public Works Department. 3. All oil and gas company leases, rights-of--way, Board Orders, etc. being carried forward, as required, when the subdivision mylar is registered at Land Titles Office. 4. The applicant providing easements to franchise utilities for providing services to the proposed and remnant parcels. The applicant may be responsible for the costs associated with the installation, removal or modification of services. 5. The applicant meeting all requirements of the Eastern Irrigation District with respect to the conveyance of water as well as easements. 6. All outstanding municipal taxes being paid prior to the endorsement. 7. The lands within the newly adjusted boundaries being consolidated with the existing parcels. Carried. Milton, Harold & Ward, Linda Lee - SE 28-18-14-W4 -Division 5 OF -Urban Frin~ a District to I -Industrial District Moved by Councillor Musgrove that, due to the proximity of this proposal to the sewage lagoon, we recommend to Council that consideration be given to first reading of a bylaw amending the land use for a portion of SE 28-18-14-W4 from OF -Urban Fringe District to I -Industrial District. Carried. 14. Other Business 1. Zadi Investments Ltd. -Lake Newell Resort Area Structure Plan -Division 5 Moved by Councillor Musgrove that this item be referred to the next meeting. Carried. 15. Post Acenda Items 1. Permit #2351 - SE 20-19-15-W4 -Division 5 Workes. Ford & Ruth -Deck Moved by B. McKellar that we approve Development Permit Application #2351 for a deck to be built within the SE 20-19-15-W4 granting a variance to allow the deck to be built 22 metres (73 feet) from the property line and subject to the following conditions: 1. This use being classified as a "Dwelling Unit" being a permitted use within the A - Agricultural District. 2. The use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. The use complying with the provisions of Section 49 of Land Use Bylaw # 1004-90 pertaining to the A -Agricultural District, except for variances granted by the Municipal Planning Commission. 4. The development being located as shown on the site plan submitted on Apri129, 2002. Any change to the plan shall require the written approval of the Development Officer. 5. This use complying with the Alberta Building Code where applicable. 6. The developer obtaining all required permits (ie: electrical, building, heating, ventilation, gas and plumbing) from an accredited inspection agency. 7. The developer providing the Development Officer with a copy of the building permit issued by a licenced, accredited building inspection agency for the County of Newell prior to the commencement of construction. 8. The developer ensuring that an adequate supply of water is provided for this use. 9. The developer ensuring the proper disposal of sewage and waste from this use. 10. The developer ensuring that the property is maintained to the satisfaction of the Development Officer. 11. The developer ensuring that construction materials, supplies and equipment are stored on the property and not on the public roadway. 12. The developer ensuring the continuous clean-up of construction debris tracked onto the public roadway where access is provided to the property. April 30, 2002 Page 38 13. Svlvia -Residential Subdivision -Division 10 (cont'd) Moved by Councillor Musgrove that we recommend to Council that Subdivision Application 02 NL 007 for a residential subdivision of Plan 8310314, Block A (within the N'/z 22-19-14-W4) be denied as it does not conform with Policy 2.5.3 of our Municipal Development Plan.
