Call to Order The Chairman called the meeting to order at 10:00 a.m. 2. Excused from Meeting All members were in attendance at this meeting. 3. Minutes Minutes of the May 28, 2002 meeting were presented to the Commission. Moved by R. Steinbach that we adopt these minutes as presented. Carried. 4. Call for Post Agenda Items The Chairman called for post agenda items. 5. Adoption of Agenda Moved by Councillor Musgrove that the agenda be adopted as amended. Carried. June 25, 2002 Page 54 6. Business from Minutes 1. O1 NL 021 - Pt. NW 6-18-14-W4 -Division 5 Eastern Irrigation District -Commercial Subdivision There was no further information on this item. 2. O1 NL 034 - Pt. NE 1-18-15-W4 -Division 5 Zadi Investment Ltd. -Create 26 Lots for Multiple Unit Housing There was no further information on this item. 3. Town of Brooks -Draft Southeast Sector Area Structure Plan The Planner presented information on changes the Town of Brooks made to their Southeast Sector Area Structure Plan. As the County's concerns have now been addressed, Administration was directed to send a letter to the Town of Brooks indicating that the County has no objections to this Plan. 4. Zadi Investments Ltd. -Lake Newell Resort Area Structure Plan -Division 5 There was no further information on this item. 7. Council Report The Chairman and the Administrator gave this report. 8. Development Report May 22, 2002 -June 19.2002 Moved by Councillor Loewen that we accept the Development Report. Carried. 9. Correspondence 1. Special Areas Board -Land Use Order A letter and a draft Land Use Order from Special Areas Board was presented to the Commission. Administration was directed to send a letter to Special Areas Board indicating that we have no concerns with their proposed Land Use Order but requesting that we be circulated land use bylaw changes, subdivision applications, statutory plan adoptions and discretionary use development permit applications adjacent to our municipality for our comments. Brisbin &Sentis Engineering Inc. -Town of Bassano Application for Subdivision -Block 50, Plan 001 0884 (NW 17-21-18-W4~ r A letter from Brisbin &Sentis Engineering Inc., regarding an application for the subdivision of Block 50, Plan 001 0884 within the Town of Bassano, was presented to the Commission. Administration was directed to send a letter to Brisbin &Sentis Engineering Inc. indicating that we have no objections to the proposed subdivision. 3. Town of Brooks - 2002 LUB 006.2002 MDP O 1 and 2002 ASP 02 A letter from the Town of Brooks, regarding applications for amendments to the Land Use Bylaw, the Municipal Development Plan and the Northeast Sector Area Structure Plan, was presented to the Commission. Administration was directed to send a letter to the Town of Brooks indicating that we have no objections to the proposed amendments. 10. Development Permits 1. Permit #2375 -Plan 0211723, Block 7, Lot 8 (SW 10-19-14-W4) -Division 10 Trendsetter Homes -Applicant (Johnson Farms - Owners -Mobile Home with Garage Moved by Councillor Loewen that we approve Development Permit Application #2375 fora 20' wide mobile home with detached garage to be located onto Plan 0211723, Block 7, Lot 8 (within .-- the SW 10-19-14-W4) subject to the following conditions: 1. This use being classified as a "Mobile Home" being a discretionary use within the CR- Country Residential District. 2. This development complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This development complying with the provisions of Section 51 of Land Use Bylaw #1004-90 pertaining to the CR-Country Residential District. 4. Steinbach that we approve Development Permit Application #2376 for a moved in building on skids to be located upon Plan 2123 FB, Block 1, Lot 14 (within the SE 6-15-13- W4) subject to the following conditions: 1. This use being classified as a "Moved in Building" being a discretionary use within the HR - Hamlet Residential District. 2. This use complying comply with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the provision of Section 57 of Land Use Bylaw #1004-90 pertaining to the HR -Hamlet Residential District. 4. This use being classified as a "Moved In Building" being a discretionary use within the HSF -Hamlet Single Family District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the provisions of Section 56 of Land Use Bylaw #1004-90 pertaining to the HSF -Hamlet Single Family District. 4. The development being located as shown on the site plan submitted June 18, 2002. Any changes to that plan shall require the written approval of the Development Officer. 5. This permit being only for the development of the relocation of asingle-family residence, with porch, as shown in Development Permit Application #2379 and as described on the site plan submitted on June 18, 2002. Any additional development shall require prior approval of a separate permit application. 15. The developer ensuring the moved in building is placed on a concrete foundation or preserved wood basement within one year following the date of approval. June 2~, 2002 Page 59 C~ 16. The applicant providing to the County an irrevocable letter of credit, or other form of security to the satisfaction of the municipality, in the amount of $2,500.00 to ensure that the requirements of the following conditions are met: a) this development being placed on a concrete foundation or preserved wood or concrete basement; b) the house and addition being repainted; c) the awnings be repainted and then reattached; and d) the shingles being replaced. 17. The developer being responsible for all costs associated with the modifications of water and sewer services to provide service to the moved in building. All this work shall be to the satisfaction of the Hamlet Advisory Committee. The developer shall also be responsible for the restoration of the street, to the satisfaction of the Superintendent of Public Works, when these services are installed. 18. The developer ensuring that the siding is painted on the addition (porch) as well as the remainder of the residence. 19. The developer ensuring that new shingles, and other improvements made to the awnings as required, are completed to ensure the building is habitable. 20. The developer ensuring the relocation of the building and proposed renovations are completed within one year of approval date. Moved by Councillor Musgrove that the motion be amended by adding condition: " 21. There being no objections from the Hamlet Advisory Committee prior to the circulation date deadline of June 26, 2002." Vote on amendment. Carried. Vote on motion as amended. Carried. 11. Home Occupation Permits 1. Home Occupation Permit #105 -Renewal -Plan 8910353, Block 3, Lot 3 (SW 2-19-14-W4) Marg Baksa, Marg's Country Cuts -Hairstyling & Cosmetology, Sale of Vitamins, Plants & Garden Accessories -Division 10 Moved by Councillor Musgrove that we approve the renewal of Home Occupation Permit # 105 for the purposes of the operation of a hairstyling and cosmetology salon, mobile hairstyling, sale of vitamins, sale of plants & garden accessories to be located on Plan 8910353, Block 3, Lot 3 (within the SW 2-19-14-W4) subject to the following conditions: 1. This use being classified as a "Home Occupation" being a discretionary use within the CR - Country Residential District. 2. The use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use not affecting the residential use of the property or adjacent properties and area. 4. The total number ofoff--site employees involved with the said occupation (not including the occupants of the residence) not exceeding two. 5. The developer ensuring that there is no outside storage of goods or materials except as noted in these conditions. The sale of plants and garden accessories shall not include the development of an accessory building for this use. There being no noise, vibration, smoke, dust or odours created from this home occupation which may affect adjacent land owners or development. 7. This home occupation permit being valid for a time period until December 31, 2003 at which time it may be either revoked or renewed by the Municipal Planning Commission for another year. Renewal of this permit shall be subject to the applicant's performance during that time. The applicant shall be responsible for re-applying one month prior to the expiry date. 8. This home occupation permit being granted for a hairstyling and cosmetology salon, mobile hairstyling and the sale ofvitamins, plants and garden accessories from Plan 8910353, Block 3, Lot 3 (within the SW 2-19-14-W4). Any other type of home occupation shall require a separate application and approval. 9. The applicant paying the appropriate fee for applying for the home occupation permit renewal after the expiry date. Carried. 2. Home Occupation Permit #123 -Plan 1774 LK, Block A, Lot 1 (SE 6-19-14-W4) Rennie Arndt, Schooner Horticultural Services -Turf Maintenance Operation and Installation of Residential Sprinkler stems -Division 10 Moved by B. M°Kellar that we approve Home Occupation Permit #123 for a turf maintenance operation and the installation of residential sprinkler systems to be located on Plan 1774 LK, Block A, Lot 1 (within the SE 6-19-14-W4) subject to the following conditions: 1. This use being classified as a "Home Occupation " being a discretionary use within the CR- Country Residential District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. Home Occupation Permit #124 -Plan 7410106, Block 3 (SE 3-19-14-W4) Robert Moore, Skv-Line Picker Services Ltd. -Picker Truck Service -Division 10 Applicant Robert Moore was in attendance to present information on this application. Moved by R. Steinbach that we approve Home Occupation Permit #124 for a picker truck service to be located at Plan 7410106, Block 3 (within the SE 3-19-14-W4) subject to the following conditions: 1. This use being classified as a "Home Occupation" being a discretionary use within the CR2- Country Residential 2 District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the provisions of Section 52 of Land Use Bylaw #1004-90 pertaining to the CR2-Country Residential 2 District. 4. The developer ensuring this use shall not affect the residential use ofthe property or adjacent properties and area. 5. The developer complying with condition #18, with regard to the construction of a fence, of Development Permit #2032, by July 31, 2002. 17. All oil and gas company leases, rights-of--way, Board Orders, etc. being carried forward, as required, when the subdivision mylar is registered at Land Titles Office. 2. The applicant providing easements to franchise utilities for providing services to the proposed and remnant parcels. The applicant maybe responsible for the costs associated with the installation, removal or modification of services. 3. Irrevocable Letters of Credit A discussion took place on the fees charged by the banks for irrevocable letters of credit and alternatives to irrevocable letters of credit. 15. Post Agenda Items Moved by Councillor Loewen that the subdivision application and land use amendment application of the Eastern Irrigation District for a portion of the SW 22-20-13-W4 be added to Post Agenda. Greenhouses Councillor Musgrove informed the Commission of a proposal to erect a greenhouse on a ,^-- residential lot in the Hamlet of Patricia. 2. Letter from Dean Martin A letter from Dean Martin, regarding a land use change to Light Industrial for the NW 19-18-14- W4, was presented to the Commission. Moved by Councillor Loewen that we recommend to Council that the NW 19-18-14-W4 be re-zoned, at the County's expense, from Light Industrial to Industrial. Carried. 3. Bylaw Enforcement The Development Control Officer circulated a map showing locations within the County where businesses are operating without the proper zoning in place. June 25, 2002 Page 66 16. Question Period/Notice of Motion A question period was held. Councillor Loewen indicated that a bulletin circulated stated that the subdivision approving authority has to give reasons for all decisions. The Bantry Bay delegation to Council was discussed. The Administrator noted that the AAMD&C has a pilot proj ect for private sewage disposal. Moved by R. Steinbach that we recommend to Council that a letter be sent to AAMD&C stating that we don't have the resources to undertake the pilot project but we would like to participate in the development process. Carried. The Chairman reminded the Commission that the next meeting is set for August 21, 2002. 17. Information Items There were no information items. 18.
