Call to Order The Chairman called the meeting to order at 10:00 a.m. `'~~ 2. Excused from Meeting All members were in attendance at this meeting. 3. Minutes 1. August 21, 2002 Minutes of the August 21, 2002 meeting were presented to the Commission. Moved by Councillor Loewen that we adopt these minutes as presented. Carried. 4. Baksa, Randy & Cory - NW & SW 1-19-14-W4 -Division 10 A -Agricultural District to CR2 -Country Residential 2 District Councillor Baksa declared a pecuniary interest in this matter and left the Council Chambers. Vice Chairman Loewen assumed the chair. Cory Baksa was in attendance as a delegation to present information on this item. Moved by Councillor Musgrove that we recommend to Council that consideration be given to first reading of a By-law to re-designate a portion of the NW & SW 1-19-14~ (including 120 acres more or less) from A -Agricultural District to CR2 -Country Residential 2 District. Carried. The delegation left the meeting. ~- Chairman Baksa returned to the Council Chambers and resumed participation in the meeting. Council and S.D.A.B. Report The Chairman and the Administrator gave this report. Development Report -August 15, 2002 to September 13, 2002 Moved by B. M`Kellar that we accept the Development Report. Carried. 9. Correspondence 1. Town of Brooks -Request for Comments - 2002 SUB 12 A letter from the Town of Brooks, requesting comments on Subdivision Application 2002 SUB 12, was presented to the Commission. Staff was directed to reply to this letter incorporating the comments of the Superintendent of Public Works. September 24, 2002 Page 91 2. Kav & Riggins -Land Use Amendment - SE 28-18-13-4 A letter from Kay & Riggins, on behalf of 985778 Alberta Ltd. (Dean Bigelow) stating that they would like to proceed with the necessary steps to have the zoning of the property changed from Urban Fringe to Direct Control, was presented to the Commission. Direction was given to the Planner to advise the writer of the process. 10. Development Permits 1. Permit #2398 - NW 4-20-14-4 (Plan 0011702 Block 8) -Division 8 Paddock Wayne & Reita -Existing Moved-in Buildin¢ Discussion took place on this item. 11. Post Agenda Items 1. Retreat - Provosed Dates Administration was directed to tentatively book for January 13 & 14, 2003 for the retreat for members of the Municipal Planning Commission and to contact a facilitator for this retreat. Development Permits (Cont'd.) 1. Permit #2398 - NW 4-20-14-4 (Plan 0011702 Block 8) -Division 8 Paddock. Wayne & Reita -Existing Moved-in Building (Cont'd.) After further discussion, this item was deferred until later in the meeting after further information is obtained. 2. Permit #2407 - SW 5-18-14-4 Bantry Bay Cottage Area -Division 5 Applicant: Martel, Bob & Gwen (Owner: Redelback, Elizabeth & Redelback, Ronald & Mapes, Janet Replacement of Porch Moved by Councillor Loewen that we approve Development Permit #2407 for replacement of a porch subject to the following conditions: 1. This use being classified as a "Mobile Home" being a permitted use within the A - Agricultural District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the provisions of Section 49 of Land Use By-law #1004-90 pertaining to the A -Agricultural District. 4. This use complying with the Alberta Building Code, where applicable. The developer ensuring the proposed moved-in building is placed on a concrete foundation or preserved wood or concrete basement within six months from the date of approval. 14. This penmit being only for the development of a moved-in building as described on the attached site plan on Plan 0212021 Block 1 Lot 6, within the NW33-19-14-4. Any additional development shall require prior approval of a separate permit application. 15. The developer ensuring that this development does not encroach onto Utility Right-of--Way Plan 8910772 and Canal Right-of--Way Plan 7810983. 16. The developer entering into a road approach agreement with the County of Newell for the installation of an approach to Plan 0212021 Block 1 Lot 6, within the NW 33-19-14-4 to the satisfaction of the Public Works Department. The developer shall contact Mr. Earl Somerville, Superintendent of Public Works, 362-3266, to determine the most suitable location for an approach to this development, if required. 17. The developer providing a copy of the Alberta Transportation Roadside Development Permit. Carried. Direction was given to the Development Control Officer to obtain a letter of credit for all applications for moved-in buildings in the future. 4. Development Permit #2417 - Pt. (Randy & Shannon Miller) Owner: Ferguson, Gordon Eugene Temporary Storage of Well Site Trailers & Employee Parkins Moved by Councillor Loewen that we refuse Development Permit #2417 for the temporary storage of well site trailers and employee parking as this is not a use prescribed in the A - Agricultural District. Carried. 5. Development Permit #2419 -Plan 8010339 Block 1 Lot 1 (NW 24-17-14-4) -Division 2 Elder Allan & Inez -Moved-in Buildin¢ Moved by R. Steinbach that we refuse Development Permit #2419 for amoved-in building as it does not meet the requirements of Land Use By-law #1004-90 which states: "A Development Permit for amoved-in building shall only be approved if the standard of construction of the building is at least equal to or better than the average condition of other buildings in the immediate vicinity". This use complying with the provisions of Section 53 of Land Use By-law #1004-90 pertaining to the HWY C -Highway Commercial District. 4. This use complying with the Alberta Building Code. 5. This use being classified as a "Home Occupation " being a discretionary use within the A - Agricultural District. 2. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 3. This use complying with the provisions of Schedule B of Land Use By-law #1004-90 pertaining to Home Occupations. 4. The developer ensuring this use shall not affect the residential use of the property or adjacent properties in the area. 5.
