Minutes of Municipal Planning Commission Meeting
~ January 27, 2003
The regular Municipal Planning Commission Meeting of the County of Newell No.4 was held
in the County Office at Brooks, AB on Monday, January 27, 2003 commencing at 10:00 a.m.

1. Call to Order
The Chairman called the meeting to order at 10:00 a.m.

3. Minutes
1. January 8, 2003
Minutes of the January 8, 2003 meeting were presented to the Commission. Moved by R.
Steinbach that we adopt these minutes as presented. Carried.
4. Call for Post Agenda Items
The Chairman called for post agenda items.
5. Adoption of Agenda
Moved by B. M`Kellar that the agenda be adopted as amended. Carried.

1. O 1 NL 034 - Pt. NE 1- l 8-15-W4 -Division 5
Zadi Investment Ltd. -Create 26 Lots for Multiple Unit Housing
The Interim Planner reported that Developer Jeet Shergill requested permission to proceed with
the development of Block 3 prior to adoption of the Lake Newell Resort Area Structure Plan as
this subdivision had been approved in 1993 but the subdivision process had not been completed.
Moved by Councillor Moss that we recommend to Council that they not grant a time extension
to the 1993 subdivision application. Carried. This item will be dealt with further after the Area
Structure Plan has been discussed.
2. A & E Sales & Service Ltd. - Pt. SE 3-19-14-4 -Division 10
CR2 -Country Residential 2 District to LI -Light Industrial District
There was no further information on this item.

Pierson Dwight -Farmstead Separation with Relaxation of Parcel Size
Applicant Dwight Pierson and adjacent landowner Wendell Rommens were in attendance to
present information on this application. Moved by Councillor Moss that we postpone making
a decision on this application until the next Municipal Planning Commission meeting to allow
ASB to perform a review of this site. Carried.

11. Development Permits
1. Permit #2470 - NW 21-20-14-W4 -Division 8
Torkelson, Allen -Temporary Storage of Mobile Home
Moved by Councillor Musgrove that we approve Development Permit #2470 for the temporary
storage of a mobile home on the NW 21-20-14-W4 subject to the following conditions:
1. The developer ensuring the moved-in building is not used for living purposes.
2. The appropriate permits being obtained prior to removal.
3. This building being removed one year from the date of approval, with no further extensions
being granted.

2. Permit #2471 - SW 10-19-14-W4 (Johnson Estates) -Division 10
Steele, Jeffrey & Kelly -Existing Moved-In Building
Moved by B. M`Kellar that we classify this use as a "moved-in building" which is a discretionary
use within the CR -Country Residential District and that we approve Development Permit #2471
for an existing moved-in building located on Plan 0011770, Block 6, Lot 19 (within the SW 10-
19-14-W4) subject to the following conditions:
1. This development complying with all Federal, Provincial and Municipal statutes, regulations,
codes and standards.
2. This development complying with the provisions of Section 51 of Land Use Bylaw # 1004-90
pertaining to the CR-Country Residential District.
3. This development being located as shown on the site plan submitted January 20, 2003. Any
changes to that plan shall require the written approval of the Development Officer.
4. This permit being only for the development of a mobile home on Plan 0011770, Block 6, Lot
19 within the SW 10-19-14-W4. Any additional development shall require a separate
development permit application.
5. This use complying with the Alberta Building Code where applicable.
6. The developer being responsible for obtaining all required permits (i.e., building, electrical,
plumbing, heating & ventilation and gas) from an accredited inspection agency.
7. The developer ensuring the proposed development complies with the following minimum
setback requirements:

Officer.
11. The developer ensuring that the construction material, supplies and equipment are stored on
the property.
12. The developer ensuring the continuous clean up of construction debris tracked onto the
public roadway where access is provided to the property.
Carried.
12. Home Occupation Permits
There were no Home Occupation Permit applications.

2. 03 NL 001 - NW 15-15-13-W4 -Division 1
Kern, Frank & Margarete -Farmstead Separation
Moved by R. Steinbach that we postpone making a decision on this application until the next
Municipal Planning Commission meeting to allow ASB to perform a review of this site. Carried.
3. 03 NL 003 - SW 28-20-14-W4 -Division 8
Ramer Kathy -Country Residential Subdivision
Moved by R. Steinbach that we recommend to Council that Subdivision Application 03 NL 003
for a country residential subdivision within the SW 28-20-14-W4 be approved subject to the
following conditions:
1. The registration of a caveat for the dedication of a 5-metre strip of land along the westerly
boundary of the proposed and remnant parcels for future road widening to be purchased at
a rate that29 January 2003 is consistent with County policy at that time.
2. The applicant entering into an agreement with the County of Newell for the installation of
any required road approaches to the proposed and/or remnant parcels.
3. All oil and gas company leases, rights-of--way and Board Orders be carried forward, when
the subdivision mylar is registered at Land Titles Office.
4. The applicant providing easements to franchise utilities for services to the proposed and
remnant parcel. The applicant may be responsible for the costs associated with the
installation, removal or modification of services.
5. The applicant meeting all the requirements of the Eastern Irrigation District with respect to
the conveyance of water as well as easements.
6. All outstanding municipal taxes being paid prior to the endorsement.

13. Land Use Chances
1. Applicant: David Wiens - SW 32-20-14-W4 -Division 8
From OF -Urban Fringe to CR -Country Residential
Moved by Councillor Moss that we recommend to Council that consideration be given to a bylaw
to redesignate a portion of the SW 32-20-14-W4 from OF -Urban Fringe District to CR -
Country Residential District. Carried.
14. Other Business
1. Lake Newell Resort Area Structure Plan
The Interim Planner informed the Commission that, after a cursory review of this Area Structure
Plan, this plan should not have been brought forward to this meeting. Once the applicant has
addressed planning concerns, it will again be brought forward to a meeting. Moved by
Councillor Musgrove that, henceforth, the Municipal Planning Commission refers to Lake
Newell as Lake Newell Irrigation Reservoir (The Reservoir) and recommend to Council to adopt
the same terminology in all written and oral references to The Reservoir. Carried.

Other Business (cont'd)
2. General Discussion -Buhler - SW 32-18-16-W4
The Interim Planner reported that Mr. Buhler had asked for direction as to what type of
subdivision he could apply for that would be approved to subdivide his house from the remainder
of the property. A discussion on this request took place.

15. Post Agenda Items
1. MPC Bvlaw
Moved by Councillor Musgrove that Administration review the Municipal Planning Commission
Bylaw and bring it back to the MPC with proposed changes. Carried.
2. Cliff Sewall -Development on Young Road
A discussion was held on whether or not an area structure plan would be required for the
development of one commercial business within the Cliff Sewall commercial property located
adjacent to Young Road. The Commission felt that a concept plan would be sufficient for one
commercial development, any additional commercial development would require a subdivision
and, therefore, an area structure plan.
