The regular Municipal Planning Commission Meeting of the County of Newell No.4 was held in the
County Office at Brooks, AB on Tuesday, June 24, 2003 commencing at 10:00 a.m.

A Circulation Notice from BSEI, for the above-noted subdivision in Duchess, was presented to the
Commission for comment. The Planner was directed to reply to this notice indicating that we have
no objections to the proposed subdivision.

Farm Subsidiary Occupation
Applicants Ralph and Lorraine Siemens, of RKL Enterprises Inc. and their Legal Counsel, Ken
Lutes, were in attendance to present information on this application. Moved by R. Steinbach that we
classify this use as a "Farm Subsidiary Occupation" being a discretionary use within the OF -Urban
Fringe District and that we approve Development Permit Application #2532 and. issue a temporary
permit for a Farm Subsidiary Occupation to be operated from the NW 21-20-14-W4 subject to the
following conditions:
1. The proposed development complying with all Federal, Provincial and Municipal statutes,
regulations, codes and standards.
2. The proposed development complying with the provisions of Section 50 of Land Use Bylaw
#1004-90 pertaining to the OF -Urban Fringe District.
3. The developer ensuring the following setbacks are maintained for the proposed development:

10. This permit is being granted only for a Farm Subsidiary Occupation Permit, for the operation of
one livestock trailer with tractor unit, one hay trailer with tractor unit, one water truck, and two
employees on NW 21-20-14-W4, any additional development shall require prior approval of a
separate permit application.
11. The developer providing the County of Newell with a copy of an approved Roadside
Development Permit issued by Alberta Transportation, if required.
12. The developer ensuring the Farm Subsidiary Occupation is operated in accordance with the letter
received by the County of Newell, dated June 11, 2003. No additional trailers, tractor units,
water trucks or employees being permitted in this approval.
13. The developer ensuring all hazardous waste materials are properly disposed of in regulated
facilities.
14. The developer ensuring all outdoor garbage containers are covered and screened from the public
roadways.
15. This development permit being valid for a period of one year from the date of approval, at which
time it may be reviewed under the provisions of the amended Land Use Bylaw. The applicant
shall be responsible for re-applying one month before the expiry date.
16. The applicants becoming the registered owners of the subject land.

2. Permit #2514 - SW 1-18-13-W4 -Division 2
Van Wert. Jeffrey -Moved-In Residence and Construct Accessorv Building
Moved by Councillor Moss that we classify these uses as a "Moved-In Building" being a
discretionary use and an "Accessory Building" being a permitted use within the A -Agricultural
District and that we approve Development Permit Application #2514 for the placement of amoved-in
building, for the purposes of a dwelling, and an accessory building on the SW 1-18-13-W4, where
the following are required prior to commencement of construction and issuance of this permit:
a) The developer providing the Development Officer with a copy of the building permit issued by
a licensed, accredited building inspection agency for the County of Newell prior to the
commencement of construction.
b) The applicant entering into a Rural Water Use Purposes Agreement with the Eastern Irrigation
District and providing evidence of this agreement.
c) The applicant providing the County of Newell with an irrevocable letter of credit, or other form
of security to the satisfaction of the municipality, in the amount of $3,00.00 to ensure that the
requirements of the following conditions are met:
i) This development is complete, as specified, with new windows throughout within one
year from the date of approval.
ii) ,This development is placed on a concrete basement or preserved wood or concrete
foundation within six months from the date of approval.
d) The developer entering into an agreement with the County of Newell for the installation and/or
upgrade of any required road approaches to the parcel.

e) The developer providing the County of Newell with a copy of an approved Roadside

additional development shall require prior approval of a separate permit application. __
13. The developer ensuring the exterior of the proposed accessory building is sided with materials
the same as, or better than, the exterior finish of the moved-in building.
14. The developer ensuring the proposed accessory building is not used for living purposes.
15. The developer ensuring there is a 1.5 m separation distance between the proposed accessory
building and the moved-in building.
16. The developer ensuring the proposed buildings are not used for conducting a business or
commercial operation.

Moved by Councillor Moss that we classify this use as an "Office" being a permitted use within the
I -Industrial District and that we approve Development Permit Application #2515 for the temporary
placement of an office, for a period of three years, granting a 2 m variance to the rear setback
requirements for the existing, non-conforming building and where the following are required prior
to commencement of construction and issuance of this permit:
a) The developer providing the Development Officer with a copy of the building permit issued by
a licensed, accredited building inspection agency for the County of Newell prior to the
commencement of construction.

Fire Regulations.

Moved by R. Steinbach that we classify this use as a "Dwelling" being a discretionary use within the
A -Agricultural District and that we approve Development Permit Application #2518 for amoved-in
1975 mobile home, for the purposes of an additional agricultural residence on the SW 17-23-16-W4,
where the following are required prior to commencement of construction and issuance ofthis permit:

Moved by Councillor Moss that we classify these uses as "Dwelling Units" being discretionary uses
within the A -Agricultural District, that we grant a variance to Section 31(a) of Land Use Bylaw
#1004-90 to allow the additional dwelling, and that we approve Development Permit Applications
#2519 and #2520 for the existing dwellings within Plan 6658 FE Parcel A (within a portion of NE
31-19-14-W4) subject to the following conditions:
1. The proposed development complying with all Federal, Provincial and Municipal statutes,
regulations, codes and standards.

construction of a dwelling on Ptn. SW 33-20-15-W4 where the following are required prior to
commencement of construction and issuance of this permit:
a) The developer providing the Development Officer with a copy of the building permit issued by
a licensed, accredited building inspection agency for the County of Newell prior to the
commencement of construction.
b) The applicant entering into a Rural Water Use Purposes Agreement with the Eastern Irrigation
District and providing evidence of this agreement.
