McKellar that the following motion be lifted from the table: Moved by Councillor Musgrove that we classify this as a "Temporary Permit for Home Industry Major" and that approval be granted, under Section 70 of Land Use Bylaw #1443-03, for Home Industry Major Temporary Permit #158 TPfor up to eightseasonal, non resident employees required in conjunction with Home Industry Major Permit Application #158, subject to the following condition: 1. This permit being valid for a time period of May -November, permitting up to eight seasonal employees, at which time it may be either revoked or renewed by the DevelopmentAuthority. The applicant shall be responsible for re-applying during this period, if the number of temporary seasonal non-resident employees increase. Statutory Planning Information was circulated regarding Hamlet & Village Area Structure Plans. The Commission will review this information and provide information to the Planner by April 12, 2004 on Hamlet boundaries and the areas surrounding Hamlets and Villages where they would like to have Area Structure Plans in place. 8. (Applicant) Truckine Service and Oilfield Tank Rental Service Moved by Councillor Moss that the following motion be lifted from the table: Moved by Councillor Musgrove that we classify this as a "Home Industry Major" being a discretionary use within the RUR -Rural Residential District and that approval be granted for Home Industry Permit #156for a Trucking and Tank Rental Service on lands legally described as Pt. SE 6-20-14-W4, subject to the following conditions: 1. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 2. This use not affecting the residential use of the property or adjacent properties and area. 3. The total number of off-site employees, not including the occupants of the residence involved with the said occupation, not exceeding three. 4. The applicant ensuring adequate parking space is available for this use, being a minimum of one parking stall per employee. 5. The applicant ensuring that no more than two commercial vehicles are used in conjunction with this Home Industry Permit. No other commercial vehicles shall be permitted. 6. The developer ensuring there are not more than two tanks located on the property at any given time. The developer ensuring loading and unloading of the tanks is restricted onto the property and not onto the public roadway. 10. The developer entering into a Road Use Agreement with the County of Newell. I1. This permit being valid for a time period of one year from the date of approval, at which time it may be either revoked or renewed by the Development Authority. The applicant shall be responsible for re-applying a minimum of two months before the expiry date. Carried. March 24, 2004 Municipal Planning Commission Page 26 ~~ Moved by Councillor Musgrove that we amend this motion to read that we classify this as a "Home Industry Major" being a discretionary use within the RUR -Rural Residential District and that approval be granted for Home Industry Permit # 156 for a Trucking and Tank Rental Service onlands -- legally described as Pt. SE 6-20-14-W4, subject to the following conditions: 1. This use complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 2. This use not affecting the residential use of the property or adjacent properties and area. 3. The total number ofoff--site employees, not including the occupants of the residence involved with the said industry, not exceeding four. 4. The applicant ensuring adequate parking space is available for this use, being a minimum of one parking stall per two employees. 5. The applicant ensuring that no more than four commercial vehicles are used in conjunction with this Home Industry Permit. No other commercial vehicles shall be permitted. 6. The applicant ensuring no noise, vibration, smoke, dust or odours, which may affect adjacent landowners or development, are created from this Home Industry Major. 7. The developer ensuring there is no contamination of soil, surface water or groundwater from this use. 8. The developer ensuring the tanks maintain the required 30 m (98.4 ft.) setback distance from the public roadway right-of--way. 10. The developer entering into a Road Use Agreement with the County of Newell, if required by the Public Works Department. 11. The applicant shall be responsible for re-applying a minimum of two months before the expiry date. 12. The developer paying the appropriate fee for the Home Industry Major. 13. Correspondence Shergill Consulting Ltd. -Refund Request A letter from Shergill Consulting Ltd. requesting a refund of the application fee paid for Subdivision O l NL 019 was presented to the Committee. SW 13-19-14-W4 -Division 10 Airth Farms Ltd. (Owners) Airth, Jock (Applicant) Variance to Land Use Bylaw 1443-03 Section 55 -Dwelling Units per Parcel For Existing Residences & Proposed New Modular Home Moved by Councillor Musgrove that we classify this "Dwelling Unit" as a "Modular Home" being a discretionary use within the A-Agricultural District and that approval be granted for Development Permit #2592 for the development of a modular home, for agricultural purposes, on Pt. SW 13-19- 14-W4, granting the following variance: i) to Section 55(1) of Land Use Bylaw #1443-03 to permit four additional dwelling units as described in this application, for agricultural purposes, within the SW 13-19-14-W4, where the following are required prior to commencement of construction and issuance of this permit: a) The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection agency for the County of Newell. b) The developer obtaining all other required permits including electrical, heating & ventilation, gas and plumbing from an accredited inspection agency and providing copies of the applicable permits to the Development Officer prior to the commencement of construction. SW 13-19-14-W4. Any additional development shall require prior approval of a separate permit application. 13. The developer ensuring the modular home is skirted with materials the same as or consistent with the remainder of the building. 14. The developer ensuring the design, character and appearance of the proposed building is consistent with other buildings in the vicinity. 15. The developer ensuring the appropriate separation distance between the proposed building and the existing buildings is maintained in accordance with the Alberta Building Code and the County of Newell Land Use Bylaw. 16. The developer ensuring the property is not used for conducting a business or commercial operation. c~ 17. The applicant applying for a subdivision to consolidate this parcel (Pt. Permit #2591 - NW 19-18-14-W4 Plan 0312492 Block 1 Lot 2 -Division 5 Celtic Pride Welding & Fabricating Ltd. (Owners) Gubbins, Martin (Applicant) Construction of Welding and Fabricating Shon with Office Linda & Martin Gubbins and Dean Martin were in attendance at the meeting. Moved by Councillor Moss that we classify this use as a "Welding and Fabricating Operation" being a discretionary use within the I -Industrial District and that approval be granted for Development Permit #2591 for the development of a welding and fabrication shop with office, on Plan 0312492 Block 1 Lot 2 (within NW 19-18-14-W4), where the following are required prior to commencement of construction and issuance of this permit: a) The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection agency for the County of Newell. b) The developer obtaining all other required permits including electrical, heating & ventilation, gas and plumbing from an accredited inspection agency and providing copies of the applicable permits to the Development Officer prior to the commencement of construction. c) The developer entering into a Rural Water Use Purposes Agreement with the Eastern Irrigation District and providing evidence of this agreement. d) The developer providing the Development Officer with a plan indicating proposed landscaping of the site prior to commencement of construction to the satisfaction of the Development Officer. and subject to the following conditions: 1. The proposed development complying with all Federal, Provincial and Municipal statutes, regulations, codes and standards. 2. The developer shall contact Mr. Kevin Swanson, Fire Chief, Brooks Rural Fire Department, 403-362-2331, to ensure compliance with Fire Code Regulations or other matters related to fire protection. A water supply, for fire protection, shall be provided in proximity to the property that is to the satisfaction of the Brooks Rural Fire Department. 6. The developer ensuring access can be provided for Emergency Services vehicles to all sides of the building. 7. The developer ensuring Emergency Services vehicular access can be provided from the proposed building to the proposed water hydrant, or other water source. The Brooks Rural Fire Department shall determine this distance. 8. The developer ensuring an adequate supply of water is provided for this use. 9. The developer being responsible for all costs associated with the modification of water and sewer services and franchise utilities to provide service to the proposed building. 10. The developer ensuring the site is graded so that storm water does not drain onto adjoining properties. 11. The developer ensuring there is proper and legal access provided to the property. 12. The developer ensuring there is proper disposal of sewage and waste from this use. The developer ensuring a pump out tank system is utilized for this development. 13. The developer ensuring the property is maintained to the satisfaction of the Development ~ Officer. 14. The developer ensuring construction materials, supplies and equipment are stored on the property and not on the public roadway. 15. The developer ensuring the continuous clean up of construction debris tracked onto the public roadway where access is provided to the property. 16. The developer ensuring this development is located as shown on the site plan submitted on February 12, 2004. Any changes to that plan shall require the written approval of the Development Officer. 17. This permit is being granted only for the development of a welding and fabricating shop, with office, on Plan 0312492 Block 1 Lot 2 (within the NW 19-18-14-W4). Any additional development shall require prior approval of a separate permit application. 18. The developer ensuring the proposed building is consistent with the purpose of the land use district and that the design, character and appearance of the proposed building is compatible with other buildings in the vicinity. 19. The developer ensuring landscaping of the property is complete within two years from the date of approval. 20. The developer ensuring all hazardous waste materials are properly disposed of in regulated facilities. 21. The developer ensuring there is no contamination of soil, surface water or groundwater from this use. 22. The developer ensuring adequate parking space is available for this use at a rate of 2.7 stalls per 100 m2 of building area. 24. The developer ensuring the proposed development does not encroach onto the Irrigation Pipeline Right-of--Way Plan 981 0471. 25. The developer ensuring that an appropriate form of dust suppression is maintained at this site. 26. The developer providing evidence of a satisfactory road completion inspection from Public Works. Carried. It was recommended that the requirement to install and maintain waterlines in Subdivision 02 NL 29 be deleted as it is an industrial subdivision. 3. (Owners) Schuett, Reinhold Variance to Land Use Bylaw 1443-03 Section 58(1) -Accessory Buildings and Section 83.5 -Rear Yard Setback Requirement To Accommodate aMoved-in Building - Accessory Use Reinhold Schuett was in attendance at the meeting. Moved by B. McKellar that we refuse Development Permit #2593, for the relocation of amoved-in building, for accessory use, on Plan 041 Block 1 Lot 13 (within SE 25-18-15-W4) as this proposal does not meet the accessory building requirements of Land Use Bylaw 1443-03 as no dwelling unit is located on the proposed lot. Carried. Mr. Schuett requested a 6-month Irrevocable Letter of Credit to have the building moved. Moved by Councillor Musgrove that we recommend to Council that we obtain a $4,000.00 Irrevocable Letter of Credit and amend Condition #6 of Subdivision Application 03 NL 017 to read: "Provision of a $4,000.00 Irrevocable Letter of Credit to ensure that the garage on proposed Lot 14 is moved so that it meets the requirements of the County's Land Use Bylaw".
