COUNCIL & S.D.A.B. REPORT The Chairman provided this report to the Commission. The Chief Administrative Officer informed MPC that a training session on the S.D.A.B. hearing process is being looked into, with potential dates of April 16tn~ 17tH or 18tH P-21/07 MOVED BY COUNCILLOR SCHROEDER that the Municipal Planning Commission reviews the 4 current Area Structure Plans and whether the County should continue on with them. OTHER BUSINESS a) Fee for IMDP Amendment MOTION CARRIED The Planner presented information regarding a recommendation for an IMDP Amendment fee. P-26/07 MOVED BY B. McKELLAR that the Municipal Planning Commission recommends to County Council that a fee of $800.00 be set for each amendment to the Municipal Development Plan, Intermunicipal Development Plan or Area Structure Plan. (Applicant) Subdivision Block 8 -Lake Newell Resort The delegation provided the Commission with a PowerPoint presentation on this subdivision. P-27/07 MOVED BY COUNCILLOR SCHROEDER that the Municipal Planning Commission recommend to County Council APPROVAL of Subdivision #20 07-0-039, subject to the following conditions: 1. Any outstanding property taxes shall be paid to the County of Newell. 2. The applicant enter into a Development Agreement with the County of Newell. 3. Consideration of adjacent landowners and referral agencies comments. 4. The applicant provide an irrevocable letter of credit for the gross construction costs including engineering design. 5. The applicant meet all requirements of the Eastern Irrigation District. 6. The creation of a homeowners association to be responsible for the municipal reserve areas. 7. The applicant entering into an agreement with the existing Lake Newell Resort Condominium Association to deal with solid waste management. 8. Payment of 10% municipal reserve. 9. That any conditions of Alberta Infrastructure and Transportation shall be established prior to finalization of the application. 10. OTHER BUSINESS -Continued d) City of Brooks Arena The Development Control Officer indicated that both himself and the County Planner have been contacted about the new proposed arena in the Pt. NW 20-18-14-W4M. The Development Control Officer and County Planner have been discussing this new arena and are in agreement with the way they will deal with the application. 17. POST AGENDA a) Notification to adjacent property owners The County Planner informed MPC that she would like to have some clarification regarding who is considered adjacent property owners for circulation purposes for subdivisions and land use amendments. In the Land Use Bylaw, section 43 it states that written notice shall be sent to each owner of adjacent land at the name and address shown on the assessment roll. P-28/07 MOVED BY COUNCILLOR WUTZKE that the Municipal Planning Commission requests from County Council clarification on Section 43 of the Land Use Bylaw, regarding notification to adjacent landowners. MOTION CARRIED The Committee RECESSED for lunch at 11:58 a.m. and RECONVENED at 1:02 p.m. 17. POST AGENDA -Continued c) Letters from the City of Brooks The County Planner presented three letters from the City of Brooks regarding their concerns over Land Use Amendments 06 LUA 028, 07 LUA 001 and 07 LUA 002, and request to meet with the Shared Services/Urban Fringe Committee. The County Planner indicated that due to the request from the City the public hearings on the land use amendments .can go ahead, however second and third readings cannot proceed. These letters will be brought forward to the next Council meeting, where Administration will set a meeting date for the Shared Services/ Urban Fringe Committee. DEVELOPMENT PERMITS d) Permit #3038 -Plan 5164 FD Block B (Pt. N 11-21-16-W4M) - Division 7 Richard & Esther Wiens (Owner/Applicant) Dwelling on Agricultural Parcel P-29/07 MOVED BY B. McKELLAR that the Municipal Planning Commission APPROVE Development Permit # 3038 and grant a variance to Section 55 of Land Use Bylaw #1443-03 to permit the second dwelling, being a 1989 model 16' by 76' (112 m2) manufactured home on the lands described as Block B, Plan 5614 FD, for a time period of three years from the date of approval, where the following are required prior to commencement of construction, final approval and issuance of this permit: a) The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection agency for the County of Newell. b) The developer providing the Development Officer with a copy of an approved Private Sewage Disposal System (PSDS) permit issued by a licensed, accredited agency for the installation of a private sewage disposal system. _ c) The developer entering into an agreement with the County of Newell for the installation and/or upgrade of any required road approaches to the - parcel. NW 15-19-15-W4M) - ~ Division 5 Michael & Tracey Materi (Owner) /Lloyd Lutic (Applicant) Approval of existing shed, horse shelter and garage P-30/07 MOVED BY COUNCILLOR WUTZKE that the Municipal Planning Commission APPROVE Development Permit # 3034 and grant a permit for the existing construction of the shed, horse shelter and garage, and grant a variance of 1.09 m for the rear setback for the horse shelter, where the following are required prior to commencement of construction, final approval and issuance of this permit: a) The developer entering into an agreement with the County of Newell for the installation and/or upgrade of any required road approaches to the parcel. NW 7-21-17-W4M -Division 6 Robert & Linda Hale (Owner) / Duane Hale (Applicant) Gravel hauling and steam truck operation P-35/07 MOVED BY COUNCILLOR SCHROEDER that the Municipal Planning Commission APPROVE Home Occupation Major # 224 and that this "Home Occupation Major" be classified as a "Gravel Hauling and Steam Truck Contractor" being a discretionary use within the A -Agricultural District to be conducted on lands legally described as Pt. NW-7-21-17-W4M, and subject to the following conditions: 1) This permit is being granted only for a Contractor Operation as described in this application lands on lands legally described as Pt. NW-7-21-17- W4M. Any additional development, or change in use, shall require prior approval of a separate permit application. 2) This permit being valid for a time period of three years from the date of approval, at which time it may be either renewed or revoked by the Development Authority under the provisions of the land use bylaw. Schedule E of the Land Use Bylaw #1443-03 pertaining to Home Industry Major. b. Section 79 of the Land Use Bylaw #1443-03 pertaining to the A - Agricultural District. 4) Th e applicant ensuring: a. this use shall not affect the residential use of the property or adjacent properties in the area. b. the total number of off-site full-time or part-time employees, not including the occupants of the residence involved with the said occupation, does not exceed five. c. the total number of commercial vehicles, using in conjunction with this home occupation shall not exceed five. d. no noise, vibration, smoke, dust or odors, which may affect adjacent landowners or development, are created from this home occupation major. e. adequate parking is available for this use, as per Schedule E of the Land Use Bylaw #1443-03. f. there is no advertising or display of produce being permitted on the property except for one indirectly illuminated sign of 1 m2 placed flat against the building or fence. g. all outdoor garbage containers are stored in weatherproof and animal proof containers and are covered and screened for the public roadways. h. there is no contamination of surface or ground water from this use. i. ,~- that all hazardous materials are properly disposed of in regulated facilities. MOTION CARRIED 12. AGRICULTURAL SUPPORT SERVICE PERMITS There were no new Agricultural Support Service Permits to review. 13. STATUTORY PLANS -NEW & AMENDMENTS There were no Statutory Plans to review. 17. POST AGENDA -Continued b) Letter from Lake Newell Resort requesting a change to the County's approval process This letter was presented to MPC and taken as information. The Administrator indicated that the issue within the letter will be taken to a future planning retreat. The Development Control Officer was directed to ,-~ write a letter of response to Mr. Cromwell indicating that the matter is being looked into.
