OTHER BUSINESS a) Delegation -Cory Baksa Re: Direction on the Butch Martin Application Cory Baksa indicated that she would like some direction from Commission on the Butch Martin application. The Planner is to discuss a proper direction with Council, and further discuss with the applicant. Cory Baksa left the meeting at 11:23 a.m. 11. SUBDIVISIONS b) #2007-0-095 - Pt. DEVELOPMENT PERMITS a) Permit #3044 -Plan 0411757 Block 2 Lot 21 (Bassano Airport) - Division 6 Site Support Services Ltd. (Owner) /Lawrence Evasiuk (Applicant) Construct an airplane hanger P-49/07 MOVED BY S. SWENSON that the Municipal Planning Commission APPROVE Development Permit # 3044 and grant a 4.5 m variance to the front (south) setback and a 1.54 m variance to the east setback, where the following are required prior to commencement of construction, final approval and issuance of this permit: a) The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection agency for the County of Newell. b) The developer entering into an agreement with the County of Newell for the installation and/or upgrade of any required road approaches to the parcel. This agreement shall, at the applicant's expense, be registered as a caveat against the lands, if required. c) That the applicant submit a construction plan demonstrating that no construction vehicles shall use the paved tarmac. and subject to the following conditions: 1) This permit is being granted only for the construction of a 390 m2 (4,200 ft.z) airplane hangar on land described as Lot 21, Block 2, Plan 0411757. Any additional development shall require prior approval of a separate permit application. _. 2) The proposed development complying with: a. all Federal, Provincial and Municipal statutes, regulations, codes and ~~~ standards. b. The provisions of Section 74 of Land Use Bylaw #1443-03, and amendments thereto, pertaining to the Development Near Established Airports. c. the provisions of Section 99 of Land Use Bylaw #1443-03, and amendments thereto, pertaining to the PS -Public Service District. d. the Alberta Building Code where applicable. e. any concerns put forth by the County Of Newell Public Works Department. f. Setbacks from local roads shall be in compliance with those in the General Land Use Regulations (Section 73). b. the proposed building is consistent with the purpose of the land use district and that the design, character and appearance of the proposed building is compatible with, or exceed the standard of, other buildings in the vicinity. ~- March 27, 2007 Municipal Planning Commission Page 6 ,,.._ c. site is graded so that storm water does not drain onto adjoining properties. d. the property is not used for conducting a business or commercial operation. e. adequate supply of water is provided for potable use. f. there is proper and legal access provided to the property. g. the property is maintained to the satisfaction of the Development Officer. h. construction materials, supplies and equipment are stored on the property and not on the public roadway. i. continuous clean up of construction debris tracked onto the public roadway where access is provided to the property. j. all outdoor garbage containers are stored in weatherproof and animal-proof containers and are covered and screened from the public roadways. k. no contamination of soil, surface water or groundwater from this use. I. that the property be used exclusively for airport and aviation related purposes. m. that the existing storage container be removed within 60 days of the construction of the hanger. NE 10-20-14 aAFM'j - Division 8 Tom and Claudia Declercq (Owner/Applicant) Addition to existing garage P-50/07 MOVED BY COUNCILLOR WUTZKE that the Municipal Planning Commission APPROVE Development Permit # 3048 and that the use be classified as an addition to an existing "Accessory Building" being a permitted use within the A -Agricultural District and a 13.5 m variance being granted for the front (north) setback. Despite falling within the north setback, the structure is 36m away from Highway 544, which is a safe distance. Approval is being granted for the construction of a 29.5 m2 (318 ft.2) addition to an existing garage and a variance of 13.5 m to the north setback, where the following are required prior to commencement of construction, final approval and issuance of this permit: a) The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection agency for the County of Newell. b) The developer entering into an agreement with the County of Newell for the installation and/or upgrade of any required road approaches to the parcel. This agreement shall, at the applicant's expense, be registered as a caveat against the lands, if required. c) The developer entering into a Roadside Development Agreement with Alberta Infrastructure and Transportation, if required by Alberta Infrastructure and Transportation and providing evidence of this ~''" agreement. The Development Control Officer will get in contact with the applicant's agent. 15. HOME OCCUPATION/HOME INDUSTRY PERMITS There were no new Home Occupation/Home Industry Permits to review. 17. POST AGENDA a) Planning Retreat The Administrator informed the Commission that a Planning Retreat has been scheduled for April 25tH, 26tH, and 27tH from 8:30 a.m. to 4:30 p.m. Diane Horvath with Oldman River Regional Services Commission will .- facilitate this retreat. A discussion followed on topics that need should be discussed at the retreat. b) Dick Dick Subdivision Extension Fee P-51/07 MOVED BY COUNCILLOR WUTZKE that the Municipal Planning Commission recommend to County Council that the subdivision extension fee of $500.00 not be waived for subdivision 06 NL 002. MOTION CARRIED c) SDH Oilfield Appeal The Planner informed the Commission that an appeal has been submitted by Alberta Infrastructure and Transportation to the Municipal Government Board on Subdivision #2007-0-057, SDH Oilfield / Sheldon Houseman. The Planner will inform the Commission on a hearing date. d) Cassils Area Structure Plan The Chairman wanted to determine who will be in attendance.
