The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Tuesday, July 31, 2007 commencing at
10:00 a.m.

The County Planner discussed the subdivision that had been tabled at
the last meeting, including the changes made to the parcel size, the
removing of the panhandle, and addressing septic concerns.
P-93/07 MOVED BY COUNCILLOR H. WUTZKE that the Municipal Planning
Commission APPROVE subdivision #2007-0-200, subject to the following
conditions:
1. The 10% reserve requirement be provided as money in place of land on
the 1.85 acres at the market value of $6,500.00 per acre with the actual
acreage and amount to be paid to the County of Newell No. 4 be
determined at the final stage, for Municipal Reserve Purposes. AND
further that, upon receipt of this reserve payment, the existing deferred
reserve caveat (051 458 101) be discharged in its entirity and a new

,.- caveat for the value of 4.748 acres be registered on the residual parcel
for municipal reserve purposes.
2. That all outstanding property taxes shall be paid to the County of

4. That the applicant submit to the Subdivision Authority a copy of a sketch
from an Alberta Land Surveyor that certifies the location and dimensions
of the existing buildings and the exact dimensions of the lot to be
subdivided. In addition, the existing septic field must be located and be
contained on the new lot being created.
5. That an easement for legal access across Block C, Plan 781 1334 in the
SE1/4-6-19-14-W4M shall be provided before final approval of the
subdivision. The Subdivision Authority requires a copy of the signed
easement agreement.
6. That all the residential (ATCO, Fortis, TELUS) services be located on the
parcel to be subdivided and proof submitted to the Subdivision
Authority.

Commission APPROVE subdivision #2007-0-239, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the applicant or owner or both enter into a Development
Agreement with the County of Newell which shall be registered
concurrently with the final plan against the title(s) being created.
3. That the boundary be taken to the western property boundary.
4. That a water use easement for continued collective use of the pond be

To subdivide a 20.19 Hectare (49.49 acres) parcel to create 32 lots of
various sizes for country residential use
The County Planner provided background information for this subdivision
application. Anew map of the proposed subdivision was handed out to
the Commission showing lots with a minimum size of 0.5 Acres. Mr.
Salonka stated that due to the large lot sizes and all of the issues that
go along with the maintenance of green space, that it was not necessary
to adjust the current plans. Ms. Davidson, a landowner in West Land
Acres, stated that green space is nice to have as long as the location is
appropriate and the residents are aware of who is responsible for
maintaining it.
P-96/07 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning
Commission APPROVE subdivision #2007-0-288, subject to the following
conditions:
1. The 10% reserve requirement be provided as money in place of land on
the 20.29 acres at the market value of $5,500.00 per acre with the
actual acreage and amount to be paid to the County of Newell No. 4 be
determined at the final stage, for Municipal Reserve Purposes. AND
further that, upon receipt of this reserve payment, the existing deferred
reserve caveat (951 261 858) be discharged in its entirity and a new
caveat for the value of 3.28 acres be registered on the residual parcel
for municipal reserve purposes.

4. That the easement as required by ATCO Gas shall be established prior to
finalization of the application and is to be registered simultaneously with
the legal plan of the subdivision.
5. That an engineered drainage/storm water management plan, prepared
by a certified engineer, be submitted and deemed acceptable by the
Subdivision Authority, to indicate the drainage patterns, how run-off will
be dealt with, and to account for the i-in-100 year storm.
6. That, the applicant provides a copy of architectural controls, approved
by the municipality, to be registered concurrently on title with the final
plan of subdivision.
7. An approved sewage disposal system is required for any developments
of the residential parcels. To determine the suitability of the site for a
private sewage system a site evaluation should be conducted which
includes, but is not limited to classification and percolation rates of soil
to establish the types and sizes of systems that may be used for
treatment and disposal, and the existence and distance to limiting
barriers in the soil such as an impervious layer or high water table.
8. That a Traffic Impact Assessment (TIA) be prepared by a qualified
transportation professional and reviewed by Alberta Infrastructure and
.-- Transportation and that the westerly most access to Highway 542 be
close and the existing service road extended west.
9. That all lots to be created will be a minimum of 0.20 ha (0.5 acres) in
size.

To subdivide an approximate 21.47 hectare (53.05 acre) parcel from a
titled area of 49.89 hectare (123 acres) to create two parcels for Mobile
Home Park use, two country residential parcels, two public utility lots,
and a residual agricultural parcel
The County Planner provided background information on this subdivision
application. Issues discussed included lots being designated "Public
Utility Lots", what each of the blocks will be designated if the land is
subdivided, who would own the roads, and the land where the utility
services are located being separate from the Mobile Home Park.
Commission postponed their decision in order to allow for further
~ discussion. Ms. Baksa respectively asked for MPC to look at the
subdivision at next month's meeting.

the proposed development permit.
P-97/07 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning
Commission APPROVE Development Permit #3096 and grant approval for
the construction of an 85.3 m2 (918 ft2) accessory building, with variances
of 1.58 m (5.2 ft) to the height and 17.3 m2 (186 ft2) to the maximum
square footage. where the following are required prior to commencement of
construction, final approval and issuance of this permit: -
a) The developer providing the Development Officer with a copy of the __.
building permit issued by a licensed, accredited building inspection
agency for the County of Newell.
And subject to the following conditions:
This permit is being granted only for the construction of an 85.3m2 (918ft2)
accessory building, with variances of 1.58 m (5.2 ft) to the height and 17.3
m2 (186 ft2) to the maximum square footage on lands described as Lots
17, Block 2, Plan 061 3933. Any additional development shall require prior
approval of a separate permit application.

Commission APPROVE Development Permit #3088 and grant approval for
the construction of an addition to an existing dwelling, where the following
are required prior to commencement of construction, final approval and
issuance of this permit:
a) The developer providing the Development Officer with a copy of the
building permit issued by a licensed, accredited building inspection
agency for the County of Newell.
b) The developer entering into a Roadside Development Agreement with
Alberta Infrastructure and Transportation and providing evidence of this
agreement.
And subject to the following conditions:
This permit is being granted only for the construction of a46.4m2 (500 ft2)
addition to an existing dwelling on lands described as Ptn. SW-4-17-13-W4.
Any additional development shall require prior approval of a separate permit
application.

The Development Control Officer provided background information on
the proposed development permit. The distance between the house and
the garage was discussed. The Commission decided that the house and
garage either needed to be the required 6.6ft apart, or they would have
to have no space between them.
P-99/07 MOVED BY COUNCILLOR A.M. PHILIPSEN that the Municipal Planning
Commission APPROVE Development Permit #3092 and grant approval for
the installation of a 141.2 m2 (1520ft2) modular home and the construction
a 46.4m2 (500 ft2) garage, with variances of 2.86 m to the front setback
and 2.43m to the flankage setback. where the following are required prior
to commencement of construction, final approval and issuance of this
permit:

Construction of a canvas structure to contain sandblasting operations
The Development Control Officer provided background information on
the proposed development permit. Ms. Traichel stated that Mr.
Melynchuk has decided to withdraw the Development Permit. She
discussed a few issues that she felt needed attention, specifically
balancing the needs of individual constituents with the needs of the
county in order to build a tax base, and the appeals process being more
solution oriented.
Ms. Traichel left the meeting at 1:54 p.m.
Ms. Snyder asked the Commission to issue a Stop Work Order to Twin
Sandblasting. The Development Control Officer will contact the applicant
to inform him of the decision, and will follow up with site visits to ensure
that sandblasting operations have ceased.

to still be sandblasting that a stop work order will be issued and served
effective from August 1, 2007 at 4:30 p.m.

6. BUSINESS FROM MINUTES CONTD.
c) Draft Land Use Bylaw
The County Planner reviewed comments that she had received back
from the councilors regarding the draft Land Use Bylaw. Topics
discussed included having urban fringes around hamlets, the permitted
maximum age that mobile homes should be within the county, utility
hook ups of new subdivisions near urban areas needing to conform to
urban standards, and having "better than average condition"
development standards. Another issue that was discussed was whether
or not agricultural buildings should need a development permit or not.
The County Planner asked the Commission for the 15C reading to be
postponed until August 23~d in order to allow time for the ORRSC staff
to complete the required maps.

2. That, pursuant to Section 655(1)(b) of the Municipal Government Act,
the applicant or owner or both enter into a Development Agreement with
the County of Newell which shall be registered concurrently with the
final plan against the title(s) being created.
3. That the easement as required by FortisAlberta shall be established prior
to finalization of the application.
4. That the applicant submit to the Subdivision Authority a copy of a
tentative subdivision sketch from an Alberta Land Surveyor that certifies

The Development Officer provided background information about the
proposed development permit. Services do not have to be separate
because the parcel is not being subdivided.
P-103/07 MOVED BY COUNCILLOR H. WUTZKE that the Municipal Planning
Commission APPROVE Development Permit #3095 and grant approval for
the construction of a new 122.6 m2 (1320 ftZ) single family residence,
where the following are required prior to commencement of construction,
final approval and issuance of this permit:
a) The developer providing the Development Officer with a copy of the
building permit issued by a licensed, accredited building inspection
agency for the County of Newell.
b) The developer entering into an agreement with the County of Newell for
the installation and/or upgrade of any required road approaches to the
parcel. This agreement shall, at the applicant's expense, be registered
as a caveat against the lands, if required.
c) The developer providing the Development Officer with a copy of an
~-- approved Private Sewage Disposal System (PSDS) permit issued by a
licensed, accredited agency for the installation of a private sewage
disposal system.
And subject to the following conditions:
This permit is being granted only for the construction of a new 122.6 m2
(1320 ft2) single family residence on lands described NE-1-20-14-W4. Any
additional development shall require prior approval of a separate permit
application.
1) The proposed development complying with:
a. all Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b. the provisions of Section 79 of Land Use Bylaw #1443-03, and
amendments thereto, pertaining to the A -Agricultural District.
c. the Alberta Building Code where applicable.
d. any concerns put forth by the County Of Newell Public Works
Department.
e. any concerns put forth by the Eastern Irrigation District.
f. Any concerns put forth by the various oil & gas companies.
2) The developer ensuring:
a. the following setbacks are maintained for this development:

b. the proposed building is consistent with the purpose of the land use

property and not on the public roadway.
i. continuous clean up of construction debris tracked onto the public
roadway where access is provided to the property.
j. all outdoor garbage containers are stored in weatherproof and animal-
proof containers and are covered and screened from the public
roadways.
k. no contamination of soil, surface water or groundwater from this use.

b) Refund of Subdivision Fees
Cory Baksa, on behalf of Dick Dick, has asked the county for a refund of
subdivision fees. The County Planner stated that the county has done all
of the work to get the subdivision approved, and so now that the
developer has decided not to move forward with the subdivision, no
refund should be given. The CAO will respond with an email to Jamal
Ramjohn.
17. POST AGENDA
a) City Annexation
The County Planner provided information regarding the proposed city -
annexation. The County Planner and the CAO will send a letter to the

City of Brooks Council requesting more information regarding why the
annexation is necessary. Also, the Commission has asked for a
meeting to be scheduled with the City of Brooks' Council to further
discuss the issue.

The EID raw water issue is still being worked on by staff and E.I.D.
MPC requested a tour of Grace Cattle Carrier. The Development Control
