MUNICIPAL PLANNING COMMISSION MEETING

The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Tuesday, June 24, 2008 commencing at
9:57 a.m.

The County Planner provided background information on the proposed
subdivision.
MOVED BY COUNCILLOR H. WUTZKE that the Municipal Planning
Commission APPROVE subdivision #2008-0-167, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the applicant submit to the Subdivision Authority a copy of a sketch
from an Alberta Land Surveyor that certifies the location and dimensions

Renewal of existing home occupation business
The Development Control Officer provided background information on
the proposed home occupation permit renewal.
P-81/08 MOVED BY COUNCILLOR S. EVANS that the Municipal Planning
Commission APPROVE Home Occupation Permit #164 R, granting a 3-year
temporary permit for the renewal of this Oilfield Insulation Service on lands
legally described as the SW 27-21-18, and grant variance to Schedule 13.9
to permit an additional two vehicles, subject to the following conditions:
This permit is being granted only for Home Occupation Permit #164, on
lands legally described as SW 27-21-18-W4. Any additional development
shall require prior approval of a separate permit application
1) The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes
and standards.
b) The provisions of Land Use Bylaw #1626-07, and amendments
thereto, pertaining to the Home Occupation 3 Category (Schedule
13).
.- c) All Alberta Building Codes where applicable.
d) Any concerns put forth by Eastern Irrigation District
e) Any concerns put forth by the County of Newell No. 4 Public
Works Department.
2) The developer ensuring that any required permits, which may include
electrical, heating & ventilation, gas and/or plumbing, are obtained
from an accredited inspection agency, and that these permits are also
up-to-date.
3) The developer ensuring:
a) That this development is located as indicated on the May 27,
2008 application, subsequently approved by MPC. Any changes
shall require the written approval of the Development Officer.
b) That this use does not affect the residential use of the property
or adjacent properties and area.
c) That the total number of non-resident, part time and full time
employees involved with the said occupation, not exceed seven
(7), unless required for safety reasons.
d) That no more than five (5) of the commercial vehicles licensed
under this business are used in conjunction with the home
occupation permit. No other commercial vehicles shall be
permitted.
e) That there is no advertising or display of produce being permitted
on the property.
f) That there is no noise, vibration, smoke, dust or odors derived
from this business, which may negatively affect adjacent
landowners or development.
g) That there are adequate parking spaces available for this use:

1 per commercial vehicle

h) That there is no contamination of soil, surface water or
groundwater from this use.
i) This permit being valid for a time period of three (3) years from
the date of approval, at which time it may be either renewed or
revoked by the Development Authority under the provisions of
Land Use Bylaw #1626-07, and amendments thereto. It is the
responsibility of the applicant to renew a minimum of two (2)
months prior to its expiration.

Councillor Daniels inquired about the lack of specificity in the
conditions regarding "any concerns put forth by the Eastern
Irrigation District" and "any concerns put forth by the County of
Newell Public Works Department". The Board agreed that it would
rather see a specific concern listed if either agency voices one.
12. STATUTORY PLANS -NEW & AMENDMENTS
There were no statutory plans to review at this meeting.

Addition to existing dwelling -variance needed for sideyard
The Development Control Officer provided background information on
the proposed development permit. She indicated that the applicant has
also submitted an application to close the alley bordering the side
yard. The Board decided that the 6 inch setback is too small next to an
alley.
P-82/08 MOVED BY COUNCILLOR R. ANDREWS that the Municipal Planning
Commission APPROVE Development Permit #3215 and grant approval for
a sideyard variance in the construction of an addition to a single unit
dwelling, subject to the following conditions:
This permit is being granted only for a the construction of a 875 ftZ (81.3 mZ)
addition to an existing single unit dwelling, with a variance to the sideyard
requirement, on lands legally described as Lot 12, Block 1, Plan 811 1737, Pt.
NE 19-15-15-W4. Any additional development shall require prior approval of a
separate permit application.
1) The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626-07, and amendments
thereto, pertaining to the Hamlet Residential District.
c) All Alberta Building Codes where applicable.
2) The developer obtaining any required permits, which may include
electrical, heating & ventilation, gas and/or plumbing from an accredited
inspection agency and providing copies of any permits to the
Development Officer
3) The developer providing the Development Officer with a copy of the
building permit issued by a licensed, accredited building inspection
agency for the County of Newell.

a) That this development is located as shown on the site plan
approved in this application and submitted May 29, 2008. Any
changes to that plan shall require the written approval of the
Development Officer.
b) That the following setbacks on all sides are maintained for this
development:
Front: 20 ft (6.1 m)
Side: 6 inches (15.2 cm)
Rear: 20 ft (6.1 m)
c) That the design, character and appearance of the proposed building
and addition are consistent with other buildings in the vicinity.
d) That the property is not used for conducting a business or
commercial operation without first obtaining the required permits.
e) That there is proper and legal access provided to the property.
g) That the site is graded so that storm water does not drain onto
adjoining properties.
h) That all construction materials, supplies and equipment are stored
on the property and not on the public roadway.
i) The continuous clean up of construction debris tracked onto the
public roadway where access is provided to the property.
j) That there is no contamination of soil, surface water or groundwater
from this use.
k) That all hazardous waste materials are properly disposed of in
regulated facilities.
m) That the exterior of the proposed addition is sided with materials
the same as, or consistent with, the exterior of the existing

Washroom building and additional RV sites
The Development Control Officer provided background information on
the proposed development permit.
P-84/08 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning
Commission APPROVE Development Permit #3216, to permit the
construction of a washroom facility and 10 additional RV sites at the EID
Historical Park and Museum in Scandia, subject to the following conditions:
This permit is being granted only for a the construction of a 12x24 ft (3.7x7.3 m)
washroom structure, and SO additional RV sites on lands legally described as Pt.
NE 19-15-15-W4. Any additional development shall require prior approval of a
separate permit application
1) The proposed development complying with:
'~ a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.

thereto, pertaining to the Public Service Land Use District.

2) The developer obtaining any required permits, which may include
electrical, heating & ventilation, gas and/or plumbing from an accredited
inspection agency and providing copies of any permits to the
Development Officer
3) The developer providing the Development Officer with a copy of the
building permit issued by a licensed, accredited building inspection
agency for the County of Newell.
4) The developer ensuring:
a) That this development is located as shown on the site plan
approved in this application and submitted May 30, 2008. Any
changes to that plan shall require the written approval of the
Development Officer.
b) That the design, character and appearance of the proposed building
and addition are consistent with other buildings in the vicinity.
c) That the property is not used for conducting a business or
commercial operation without 1=trst obtaining the required permits.
d) That an adequate supply of water is provided for domestic use.
e) That there is proper and legal access provided to the property.
f) That adequate parking space is available for this use.
g) That the site is graded so that storm water does not drain onto
adjoining properties.
h) That all construction materials, supplies and equipment are stored
on the property and not on the public roadway.
i) The continuous clean up of construction debris tracked onto the
public roadway where access is provided to the property.
j) That there is no contamination of soil, surface water or groundwater
from this use.
k) That all hazardous waste materials are properly disposed of in
regulated facilities.
I) That all outdoor garbage containers are stored in weatherproof and
animal-proof containers and these containers are covered and
screened from the public roadways.
m) That access can be provided for Emergency Services vehicles to all
sides of the building.

Gravel Pit Operation
The Development Control Officer provided background information on
the proposed development permit. The Board inquired about whether
or not there is a setback for gravel pits in the Agricultural District. The
County Planner suggested that the 10 foot setback required for
buildings be used for gravel pits as well. Councillor Wutzke suggested
having a 25 foot setback from all property lines.
P-85/08 MOVED BY COUNCILLOR H. WUTZKE that the Municipal Planning
Commission APPROVE Development Permit #3219 as a resource extraction
operation (gravel pit operation) in the Agricultural Land Use District of
County of Newell Land Use Bylaw 1626-07, subject to the following
conditions:

.- This permit is being granted only for the proposed resource extraction operation
(gravel pit) on lands located at NE 19-23-14-W4. Any additional development
shall require prior approval of a separate permit application
1) The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations,
codes and standards.
b) The provisions of Land Use Bylaw #1626-07, and
amendments thereto, pertaining to the Agricultural Land Use
District.
c) Any concerns put forth by Eastern Irrigation District
d) Any concerns put forth by the County of Newell No. 4 Public
Works Department.
2) The developer entering into an agreement with the County of
Newell for the installation and/or upgrade of any required road
approaches to the parcel. This agreement shall, at the applicant's
expense, be registered as a caveat against the lands, if required.
3) The developer entering into a Road Use Management Agreement
with the County of Newell.
4) The developer registering the operation in accordance with the
guidelines outlined on the website
www.gp.gov.ab.ca/documents/Codes/PITS.cfm and providing proof
of this registration to the Development Officer.
5) The developer ensuring:
a) That this development is located as shown on the site plan
approved in this application and submitted June 11, 2008.
Any changes to that plan shall require the written approval of
the Development Officer.
b) That there is proper and legal access provided to the property.

c) The continuous clean up of construction debris tracked onto
the public roadway where access is provided to the property.
d) That there is no contamination of soil, surface water or
groundwater from this use.
e) That all hazardous waste materials are properly disposed of in

Kevin Stephenson, County Administrator, arrived at 10:35 a.m.
The County Planner presented the background report for the Intermunicipal
Development Plan (IMDP) to the Board. The County Planner explained that the
background report is the first chance for both Councils to see all of the
information that will need to be considered in negotiating this new agreement.
She also indicated that the provincial land-use framework may need to be
taken into consideration before the IMDP is finalized. The County Planner then
went through the report and highlighted specific areas of interest. The report
includes information on the questionnaires returned by residents of the study
area, and numerous maps and air photos that include information on soil types,
zoning, land use, and MDS around feedlots. Other information in the report
includes a summary of subdivisions in the study area, history and background
information about both the County and the City regarding growth patterns, land
use districts, road networks, Area Structure Plans, historical and proposed
annexations, energy and transportation corridors, and agricultural influences.
The last section of the report provides a discussion about issues that need to be
identified in the plan such as goals and objectives, urban fringe policies, a
common vision, implementation of the plan, and ensuring that the IMDP is
relevant and able to be easily used by both parties. The Board believes that it is
important to deal with servicing to ensure that areas of proposed development
will be able to be properly serviced once developed. Councilor Harbinson
inquired about the size of the urban referral area. The County Planner indicated
that she believes that it may be a bit too big, and suggested that a corridor
along the TransCanada Highway east of Brooks be part of the referral area

,.- instead of the land currently included in the area east of Brooks. Kevin
Stephenson feels that the transportation network needs to be established but
most importantly that the process for development in the study area must be
clear. Councilor Wutzke believes that having a servicing agreement in place will
be extremely beneficial for the County to have with the City. Councilor Daniels
noted that the provincial plan currently has city traffic accessing the city via
County roads. Councilor Schroeder feels that if we work through the problem
areas while sticking to a clear process that annexation will fall into place. The
County Planner informed the Board that this background report is for Council to
use in order to establish a position in order to begin negotiations.
Councilor Harbinson inquired about the Butch Martin property in the urban
referral area. He stated that in speaking with the applicant the infrastructure is
already in place to tie into the city services, and feels that because of this he
should be able to tie into the services. The County Planner indicated that even
though the pipes are in the ground, the city does not have to turn on the water
without having an agreement in place. Councilor Daniels asked about approving
applications in the urban referral area with a condition requiring proof of
servicing. The County Planner suggested that it might be better to ask for proof
of servicing at the application stage for development in the urban fringe area.
This topic will be re-visited in an August meeting.
