CORRESPONDENCE a) City of Brooks Re: Deremiens Light Industrial Outline Plan The County Planner discussed the Light Industrial Outline Plan and stated that there may be issues with setbacks from One Tree Creek and drainage concerns. The County Planner was requested to comment on this application noting the setback and drainage concerns. b) City of Brooks Re: Eastern Irrigation District Industrial Outline Plan The County Planner was directed to provide a response to this application, noting that we have no concerns. ~iV_ August 29, 2006 Municipal Planning Commission Page 3 c) Letter from the City of Brooks Re: Comments on Subdivision Application File No. 2006 LUB 006 The County Planner was directed to provide a response to this application, noting that we have no concerns. 10. DEVELOPMENT PERMITS a) Permit #2961 - NE 19-19-15-W4M John W. Harbinson (Owner/Applicant) New Farm Site P-143/06 MOVED BY COUNCILLOR WUTZKE that the Municipal Planning Commission APPROVE Development Permit # 2961 and that this building and use be classified as a "Dwelling Unit" being a discretionary use within the A -Agricultural District. Approval is being granted for the construction of a 213.67 mZ (2,300 ft.Z) dwelling unit, as described in this application and shown on the site plan submitted July 13, 2006 on the NE 19-19-15 W4M, where the following are required prior to commencement of construction, final approval and issuance of this permit: a) The developer providing the Development Officer with a copy of the house plans for the proposed development. b) The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection agency for the County of Newell. c) The developer providing the Development Officer with a copy of an approved Private Sewage Disposal System (PSDS) permit issued by a licensed, accredited agency for the installation of a private sewage disposal system. d) The developer entering into an agreement with the County of Newell for the installation and/or upgrade of any required road approaches to the parcel. This agreement shall, at the applicant's expense, be registered as a caveat against the lands, if required. and subject to the following conditions: 1) This permit is being granted only for construction of a 213.67 mZ (2,300 ft.z) dwelling unit on the NE 19-19-15 W4M. Any additional development shall require prior approval of a separate permit application. 2) The proposed development complying with: a. all Federal, Provincial and Municipal statutes, regulations, codes and standards. b. the provisions of Section 79 of Land Use Bylaw #1443-03, and amendments thereto, pertaining to the A -Agricultural District. c. the Alberta Building Code where applicable. d. any concerns put for by the County of Newell Public Works Department. 3) The developer obtaining, and complying with, all other required permits including electrical, heating & ventilation, gas and plumbing from an accredited inspection agency and providing copies of the r applicable permits to the Development Officer. (Owner), Randy Hitchcock (Applicant) Temporary Residential Unit -Manufactured Home - 3 Year Renewal P-144/06 MOVED BY B. McKELLAR that the Municipal Planning Commission APPROVE Development Permit # 2962 and that this "Manufactured Home" be classified as a "Temporary Residential Unit" being a discretionary use within the A -Agricultural District. Approval is being granted for the placement of a 1990 moved in 113.78 m2 (1,224 ft.2) manufactured home as described in this application and shown on the site plan submitted July 19, 2006 to be located on Plan 7811389 Block 1 Lot 7 (213 Timko Street), where the following are required prior to commencement of construction, final approval and issuance of this permit: a) The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection agency for the County of Newell. b) The developer entering into an agreement with the County of Newell for the installation and/or upgrade of any required road approaches to the parcel. All this work shall be to the satisfaction of the Scandia Advisory Committee. McKELLAR that the Municipal Planning Commission APPROVE Development Permit # 2964 and that this building and use be classified as a "Manufactured Home" being a discretionary use within the HR -Hamlet Residential District. Approval is being granted for the placement of a 2005 model, 141.2 m2 (1,520 ft.2) manufactured home as described in this application and shown on the site plan submitted July 24, 2006 to be located on Plan 8211670 Block 1 Lot 18 (104 First Avenue). Variance of 20m (65.6 ft.) is being granted to Section 73 of Land Use Bylaw 1443-03 to permit the structure to be located within the 30m setback of a provincial highway, where the following are required prior to commencement of construction, final approval and issuance of this permit: a) The developer paying the appropriate fee for commencing this development without prior approval. b) The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection August 29, 2006 Municipal Planning Commission Page 8 - agency for the County of Newell. . c) The developer entering into an agreement with the County of Newell for the installation and/or upgrade of any required road approaches to the parcel. This agreement shall, at the applicant's expense, be registered as a caveat against the lands, if required. d) The developer entering into a Roadside Development Agreement with Alberta Infrastructure and Transportation, if required by Alberta Infrastructure and Transportation and providing evidence of this agreement. and subject to the following conditions: 1) This permit is being granted only for the development of a 2005 model, 141.2 mZ (1,520 ft.2) manufactured home on Plan 8211670 Block 1, Lot 18 (104 First Avenue). POST AGENDA ITEMS a) Newell Regional Solid Waste Management Authority Ltd. Letter The Newell Regional Solid Waste Management Authority Ltd. Letter noted that a prior application in 2005 was withdrawn and requested if the fees from this application may be used for a future application. It was further clarified that the County did not request that the application be withdrawn, but the County does request a written confirmation that an applicant wishes to withdraw their application. OTHER BUSINESS a) Stop Order -Development Permit #2813 -Tara Baynham The Development Officer informed the Commission that the applicant has not provided the road approach agreement as approved in Development Permit # 2813. Discussion followed about whether there is any confirmation about having drainage issues around the approach and who may be responsible for the corrections to the drainage issues. The Development Officer was informed to ask the Public Works Department for a report on this matter. INFORMATION ITEMS a) Mapping Issues for Planning & Development Applications The County Planner informed the Commission that due to the County currently having a vacancy for the GIS/GPS position, that all the maps that were included in agenda packages will no longer be available. The County Planner proposed to require a survey company to provide a detailed sketch or the applicant to have a fairly detailed map with correct dimensions. It was further noted that in the Land Use Bylaw, a sketch done by a surveyor is required as part of an application for a land use re-designation. "'~ Discussions on the sketches required for development permits was also discussed due to the loss of the Development Officer as of September 1, 2006 and the loss of her as a resource to provide maps.
