MUNICIPAL PLANNING COMMISSION MEETING
NOVEMBER 28, 2006
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Tuesday, November 28, 2006 commencing
at 10:06 a.m.

Construction of a basement and moved-in dwelling unit
P-208J06 MOVED BY COUNCILLOR WUTZKE that the Municipal Planning
Commission APPROVE Development Permit # 3001 and that the building
be classified as a "Moved-In Building" being a discretionary use within the
HSF -Hamlet Single-Family District. Approval is being granted for the
placement of a 50 year old 91.42 mZ (984 ft.2) moved in building on a
foundation, as described in this application, where the following are required
prior to commencement of construction, final approval and issuance of this
permit:
a) The developer providing the Development Officer with a copy of the
occupancy permit issued by a licensed, accredited building inspection
agency for the County of Newell.
b) The developer entering into an agreement with the County of Newell for
the installation and/or upgrade of any required road approaches to the
parcel. This agreement shall, at the applicant's expense, be registered
as a caveat against the lands, if required.
c) The developer providing the County of Newell with an irrevocable letter of
credit, or other form of security to the satisfaction of the municipality, in
the amount of $2,500.00 to ensure that the requirements of the
following conditions are met:
1. This development is complete as specified, with upgrades and/or
new siding within one year from the date of approval.

1) This permit is being granted only the placement of a 50 year old 91.42
mz (984 ft.2) dwelling unit, and the construction to provide a foundation,
on a Ptn. SE 6-15-13 W4M. Any additional development shall require
prior approval of a separate permit application.
2) The proposed development complying with:
a. all Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b. the provisions of Section 85 of Land Use Bylaw #1443-03, and
amendments thereto, pertaining to the HSF -Hamlet Single-Family
District.
c. the Alberta Building Code where applicable.
d. any concerns put forth by the County Of Newell Public Works
Department.

3} The developer obtaining, and complying with, all other required permits
including electrical, heating & ventilation, gas and plumbing from an
accredited inspection agency and providing copies of the applicable

e. adequate supply of water is provided for potable use.
f. site is graded so that storm water does not drain onto adjoining
properties.
g. there is proper and legal access provided to the property.
h. there is proper disposal of sewage and waste from this use.
i. the property is maintained to the satisfaction of the Development
Officer.
j. construction materials, supplies and equipment are stored on the
property and not on the public roadway.
k. continuous clean up of construction debris tracked onto the public
roadway where access is provided to the property.
I. all outdoor garbage containers are stored in weatherproof and
animal-proof containers and are covered and screened from the
public roadways.

P-209/06 MOVED BY COUNCILLOR SCHROEDER that the Municipal Planning
Commission APPROVE the construction and conversion of the existing dairy
barn to serve as a "Manufacturing and Fabrication Operation" as outlined in
Development Permit #3019, being the construction and conversion of the
building that will facilitate the manufacturing of plastics, on Ptn. NE 21-23-
18 W4M, where the following are required prior to final approval and
issuance of this permit:
a) The developer providing the Development Officer with a copy of the
building permit issued by a licensed, accredited building inspection
agency for the County of Newell.
b) The developer providing the Development Officer with a copy of an _
approved Private Sewage Disposal System (PSDS) permit issued by a
licensed, accredited agency for the installation of a private sewage

including emergency fire plans to the standards required by the County
Of Newell No. 4 and Gem Fire Department.
e) The developer providing a copy of the plans for the conversion of the
building.
and subject to the following conditions:
1) This permit is being granted only for the development of a 1486.45 m2
(16,000 ft.2) plastics manufacturing building, as approved in this
application, on Ptn. NE 21-23-18 W4M. Any additional development
shall require prior approval of a separate permit application.
2} The proposed development complying with:
a. all Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b. the provisions of Section 96 of Land Use Bylaw #1443-03, and
amendments thereto, pertaining to the 1 -Industrial District.
c. the Alberta Building Code where applicable.
d. the Alberta Fire Code where applicable.
e. any concerns put forth by the Eastern Irrigation District.
f. any concerns put forth by the Gem Fire Department.
g. any concerns put forth by the County of Newell Public Works
Department.

3) This developer obtaining, and complying with, all other required permits

use; up to four stalls, within the front yard setback.
g) The applicant ensuring daily business related trips do not exceed
four.
h) This permit being valid for a time period of three years from the date
of approval, at which time it may be either revoked or renewed by
the Development Authority.

a) Site Visits
The Acting Development Control Officer indicated that she has done a few
site visits. However, due to time constraints, she has not been able to do
very many.

a) Municipal Land Use Planning -Discussion Paper
The Administrator informed the commission that this discussion paper was
circulated at the AAMD&C convention. This item was presented to the
Commission as information.
b) Permit #2912
The Commission was informed that only the basement parging and the
installation of shutters are remaining prior to a full release of the letter of
credit.
P-223/06 MOVED BY COUNCILLOR WUTZKE that the Municipal Planning
Commission approve the release of $4,000 from the letter of credit and
continue to hold $1,000 until the basement parging is complete, and the
shutters be removed as a condition of final approval.

The Acting Development Control Officer informed the Commission that a
letter of complaint was submitted to the Planner regarding extra buildings
on this land that do not have permits.
P-225/06 MOVED BY COUNCILLOR WUTZKE that a letter be sent to the landowner
indicating that the two mobile homes have to be removed within 45 days
otherwise a stop orders and/or fines will be issued.
