COUNTY OF NEWELL NO. 4 \ MUNICIPAL PLANNING COMMISSION MEETING FEBRUARY 10, 2009 The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was held in the County Office at Brooks, AB on Tuesday, February 10, 2009 commencing at 10:00 a.m. MEMBERS PRESENT: M. EXCUSED FROM MEETING P-11/09 MOVED BY COUNCILLOR ]. HARBINSON that S. Swenson be excused from the meeting. MOTION CARRIED 3. MINUTES a) January 13, 2009 P-12/09 MOVED BY COUNCILLOR S. EVANS that the minutes of the January 13, 2009 Municipal Planning Commission meeting be adopted as presented. /'-^ MOTION CARRIED ~e 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-13/09 MOVED BY COUNCILLOR A. EASTMAN that the agenda be adopted as amended. Arrived at Meeting Councillor Andrews arrived at 10:03 a.m. 6. BUSINESS FROM THE MINUTES b) Update on Development Permit #3109 MOTION CARRIED The Development Control Officer provided an update on the status of Development Permit #3109. She indicated that a letter had been sent by registered mail informing the applicant of what needs to be completed. The deadline for a response from the applicant is February 16, 2009. Arrived at Meeting Tom Parker arrived at 10:06 a.m. a) 2007-0-037, Tammie Cage, Deferred Municipal Reserve Tom Parker made a short presentation outlining his concerns about the deferred reserve requirement. He asked if half of the requirement could be paid half now and half at the end of the year. The County Planner further explained that this was an acceptable way of collecting the municipal reserve. P-14/09 MOVED BY COUNCILLOR H. WUTZKE that we collect half of the municipal reserve payment on or before March 1, 2009 and the second half on or before December 1, 2009 with a caveat being registered against each of the parcels being created by subdivision 2007-0-037 to ensure that the Municipal Reserve is collected as required. MOTION CARRIED Left the Meeting Tom Parker left the meeting at 10:13 a.m. c) Status Report -Development Permits issued from 2007-2008 The Development Control Officer provided an overview of the status reports that can be generated with the Development Permit Database. MPC inquired about including the value of each development in the report, and about adding the name of the applicant since it will only be an internal report. Land location may also be a useful piece of information to include in these reports. MPC would like status reports to be brought to a meeting once a year. P-15/09 MOTION CARRIED 8 P-16/09 The County Planner provided MPC with an update of the outcome of the S.D.A.B. Hearing for the appeal of Development Permit #3247. She informed MPC that their decision had been varied to allow a total of 8 trailers (including both those for work and those for recreational activities) to be parked on the parcel. MOVED BY COUNCILLOR M. DOUGLASS that the Council and S.D.A. B. Report be accepted. DEVELOPMENT REPORT - .7ANUARY 7 -FEBRUARY 4 2009 MOVED BY COUNCILLOR A. EASTMAN that the Development Report be accepted. MOTION CARRIED 11. POST AGENDA a) Subdivision 2008-0-056 -Required Conditions Councillor Harbinson inquired about the required conditions for subdivision 2008-0-056. The County Planner informed MPC some of the larger conditions included completing a Traffic Impact Assessment, creating a storm water management plan and establishing a fire management plan. All of these plans need to be certified be an engineer. The County Planner also indicated that all developers creating multi-lot subdivisions are being required to provide the same information. 9. a) #2009-0-024 -Lot 2, Block 22, Plan 041 0948, Ptn. 29-20-14-W4M David & Elsie Wiens To create a 10.09 acre parcel from a title of 77.66 acres for country residential use. The County Planner provided background information on the proposed subdivision. She drew MPC's attention to an email sent in by an adjacent property owner. P-17/09 February 10, 2009 MOVED BY COUNCILLOR B. de TONG that the Municipal Planning Commission APPROVE subdivision #2009-0-024, subject to the following conditions: 1. That the 10% Municipal Reserve requirement be provided as money in place of land on the 10 acres at the market value of $1900 per acre with the actual acreage and amount to be paid to the County of Newell No. 4 to be determined at the final stage for Municipal Reserve Purposes and further upon receipt of this reserve payment, a deferred reserve caveat for the value of residual acres be registered on the residual parcel for municipal reserve purposes. That the applicant or owner enter into a road approach agreement with ~,r,,J the County of Newell for the installation of any required road approach to the proposed and/or remnant parcels and that any required approach or road upgrades be constructed, inspected and passed prior to finalization. MOTION CARRIED 10. STATUTORY PLANS -NEW S: AMENDMENTS a) Recap of the IMDP Open House The County Planner provided an overview of what occurred at the ]oint IMDP Open House, and asked MPC for any additional comments or concerns that they would like to discuss. Discussion followed regarding proposed uses versus actual zoning as shown on the maps within the draft IMDP, whether or not a zoning map or land use bylaw regulations should be added to the IMDP, and additional ratepayer concerns. Other additional ratepayer concerns included the possibility of enticing industrial development along Highway No. 1, and insufficient County Residential development opportunities of 2+ acres shown in the plan. Urban servicing standards are not feasible for larger country residential. Concerns were also raised about the coloring of the maps not complimenting current ASP's. The County Planner advised this will not affect current zoning for the lands in question and those lands may develop as zoned. MPC inquired about the process that will be followed when a developer brings in an application. The County Planner indicated that this has not been established yet, but will be at a future `~/ meeting. The County Administrator added that the flexibility of the `'••~ plan is beneficial when the County and the City are in agreement about development, but stated that when disagreements arise, then that may have impacts on future developments within the boundaries. The County Planner reminded MPC that the IMDP is supposed to be a guideline of how the 2 municipalities should interact and compromise about development in the fringe area. She also reminded MPC members that planning processes are always changing and that landowners will quite often be involved in more than one planning process. The County Administrator indicated that one of his concerns is that if the IMDP Committee (which is made up of City and County representatives) cannot agree on an application, that development in the fringe area may be sterilized, so he suggested that more specific clauses be considered in the document. The Planner reminded MPC that although there may be times when the IMDP Committee is not in agreement, the County will have the final say with regards to planning and development since the fringe area is within the County. The County Planner also reminded MPC that the IMDP Committee will be a referral/reviewing/recommendation body, not a decision making body, and will be made up of 3 Councillors from each municipality. The County Administrator suggested that the whole issue around "City or Urban Standards" needs to be clarified to what scale in what areas. He stated further that if the document is meant to deal with road widths, densities and sewer servicing standards, that these should be clearly stated.
