EXCUSED FROM MEETING All members were present. 3. MINUTES a) March 10, 2009 P-30/09 MOVED BY COUNCILLOR 7. HARBINSON that the minutes of the March 10, 2009 Municipal Planning Commission meeting be adopted as presented. ~ MOTION CARRIED The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P-31/09 MOVED BY COUNCILLOR A. EASTMAN that the agenda be adopted as amended. MOTION CARRIED Arrived at Meeting Jody Bouchard arrived at 10:04 a.m. 6. DEVELOPMENT PERMITS a) DP #3289 -Lot 1, Block 1, Plan 811 1352, Ptn. SE 5-19-15-W4M, Division 5 Kim and Jody Bouchard (Owner /Applicant) Addition to existing dwelling -variance required for setback distance to road The Development Control Clerk provided background information on the proposed development permit. The County Planner directed the Commission to the Country Residential section of Schedule 2, and to Schedule 4, Standards of Development for information regarding setbacks. P-32/09 MOVED BY COUNCILLOR ). HARBINSON that the Municipal Planning Commission APPROVE Development Permit #3289 and grant approval for the construction of an addition to an existing dwelling granting a 23.6 ft (7.18 m) variance to the setback requirement from a County road, subject to the following conditions: This permit is being granted only for the construction of a 1600 ft Z (148.6 mZ) addition to the existing dwelling with a 23.6 ft (7.18 m) variance to the setback requirement from a County road, on lands legally described as Lot 1, Block 1, Plan 811 1352, SE 5-19-15 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. b) The provisions of Land Use Bylaw #1626-07, and amendments thereto, pertaining to the Country Residential District. c) All Alberta Building Codes where applicable. And subject to the following conditions: a) The developer obtaining any required permits, which may include electrical, heating & ventilation, gas and/or plumbing from an accredited inspection agency. April 14, 2009 Municipal Planning Commission Page 2 b) The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection !'` agency for the County of Newell. c) That this development is located as shown on the site plan approved in this application and submitted March 6, 2009. Any changes to that plan shall require the written approval of the Development Of>:ICer. d) That the following setbacks are maintained for this development: Front (east): 100 ft (30 m) Side (south): 74.86 ft (22.82 m) Rear (west): 20 ft (2.1 m) Side (north): 20 ft (2.1 m) e) That the property is not used for conducting a business or commercial operation without first obtaining the required permits. MOTION CARRIED b) DP #3283 -Lot 15, Block 2, Plan 041 1757, NW 20-21-18-W4M, Division 6 Town of Bassano (Owner) / ]im Hrymack (Applicant) Construction of an aircraft hangar The Development Control Clerk provided background information on the proposed development permit. Councillor Eastman inquired about height restrictions at an airport. The Development Control Clerk indicated that there are currently no height restrictions in our Land Use Bylaw. P-33/09 MOVED BY COUNCILLOR S. EVANS that the Municipal Planning Commission approve Development Permit #3283 as a use that meets the provisions of the Public Service District of County of Newell Land Use Bylaw 1626-07, and subject to the following conditions: This permit is being granted only for the construction of a 3600 ftz (1097 mz) aircraft hangar on lands legally described as Lot 15, Block 2, Plan 041 1757, NW 20-21-18 W4. Any additional development shall require prior approval of a separate permit application The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. b) The provisions of Land Use Bylaw #1626-07, and amendments thereto, pertaining to the Public Service District. c) All Alberta Building Codes where applicable. And subject to the following conditions: a) The developer obtaining any required permits, which may include electrical, heating & ventilation, gas and/or plumbing from an accredited inspection agency b) The developer providing the Development Officer with a copy of the building permit issued by a licensed, accredited building inspection agency for the County of Newell. April 14, 2009 Municipal Planning Commission Page 3 c) The developer obtaining and complying with a Private Sewage Disposal System Permit. A copy of this permit must be submitted to the Development Officer. d) That this development is located as shown on the site plan approved in this application and submitted March 10, 2009. Any changes to that plan shall require the written approval of the Development Officer. e) That the following setbacks are maintained for this development: Fr n (East) i e (North & South) Rear (West) 20 ft (6.1 m) 10 ft (3.0 m) 20 ft (6.1 m) f) That the property is not used for conducting a business or commercial operation that is unrelated to aircraft operations, and without obtaining the required permits. f) That the property is not used for residential purposes g) That the property is not used for storage (Town of Bassano condition) h) That the hangar is constructed within 12 months of issuance of this permit (Town of Bassano condition) i) That access can be provided for Emergency Services vehicles to all sides of the building. MOTION CARRIED c) DP #3286 -Block B, Plan 6368 FF, NW 9-23-16-W4M, Division 9 Richard Hiebert (Owner /Applicant) Installation of a 2008 manufactured home The Development Control Clerk provided background information on the proposed development permit. The County Planner suggested that an informative be added advising the developer that Alberta Environment is required to drill a well. P-34/09 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning Commission APPROVE Development Permit #3286 and grant approval for the installation of a 2008 manufactured home, subject to the following conditions: This permit is being granted only for the installation of a 2008, 1200 ft2 (111.5 mZ) manufactured home, on lands legally described as Block B, Plan 6368FF, NW 9-23-16 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. b) The provisions of Land Use Bylaw #1626-07, and amendments thereto, pertaining to the Hamlet Residential District ~ Schedule 8: Development Standards for Mobile Homes within Hamlets c) All Alberta Building Codes where applicable. d) Any other required permits, including electrical, heating & ventilation, gas and/or plumbing. These must be obtained from an accredited inspection agency e) If the applicant intends to provide well water for this dwelling, he is required to obtain Alberta Environment approval for the installation of the well. This development permit approval does not override or April 14, 2009 Municipal Planning Commission Page 4 negate any approvals from Alberta Environment in the provision of a well for this dwelling. And subject to the following conditions: a) That this development is located as shown on the site plan approved in this application and submitted February 25, 2009. Any changes to that plan shall require the written approval of the Development Officer. b) That the developer obtain an building permit issued by a licensed, accredited building inspection agency for the County of Newell. A copy of this permit must be submitted to the Development Officer. c) That the developer obtain a Private Sewage Disposal System Permit, issued by a licensed, accredited building inspection agency for the County of Newell. A copy of this permit must be submitted to the Development Officer. d) That the developer enter into Road Approach Agreement with the County of Newell. This agreement is for the installation and/or upgrade of any required road approaches to the parcel. If required, the agreement shall be registered as a caveat against the lands, at the applicant's expense. e) That the following setbacks are maintained for this development: Front Side Rear ft (6.1 m) 5 ft (1.5 m) 20 ft (6.1 m) MOTION CARRIED ,~-. d) DP #3287 - NE 19-16-14-W4M, Division 2 Eastern Irrigation District (Owner) /Earl Wilson (Applicant) Expansion of the existing Rolling Hills Reservoir Campground The Development Control Clerk provided background information on the proposed development permit. A response has not been received from Alberta Transportation regarding this application. Construction must not occur until approval from Alberta Transportation has been obtained. P-35/09 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning Commission APPROVE Development Permit #3287 as a use that complies with the provisions of the Public Service Land Use District of County of Newell Land Use Bylaw 1626-07, subject to the following conditions: This permit is being granted only for the expansion of the existing Rolling Hills Reservoir campground, from 100 sites to 170 sites, on lands legally described as NE 19-16-14 W4. Any additional development shall require prior approval of a separate permit application The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. ~,.., b) The provisions of Land Use Bylaw #1626-07, and amendments thereto, pertaining to the Public Service District. And subject to the following conditions: April 14, 2009 Municipal Planning Commission Page 5 a) That this development is located as shown on the site plan approved in this application and submitted March 6, 2009. Any ; changes to that plan shall require the written approval of the Development Officer. b) That no construction shall commence until approval from Alberta Transportation has been obtained. MOTION CARRIED 7. BUSINESS FROM MINUTES a) Redelback Update The County Planner provided an update on the Redelback Property. A letter has been received from Strom & Associates providing an update on the status of the lot septic and water system evaluation. The Commission inquired about whether or not there is a moratorium on development on the Redelback Property. The County Planner stated that there is not a moratorium on development, but since the parcel is zoned direct control, any application for new development will be brought to Council. At this point, we are still waiting for a concept plan to be submitted by Strom and Associates Ltd. 8. DEVELOPMENT REPORT -MARCH 3 -APRIL 7. 2009 P-36/09 MOVED BY COUNCILLOR W. DANIELS that the Development Report be accepted. MOTION CARRIED 9. OTHER BUSINESS a) Further discussion about 09 LUA 002 -PAL Developments The Planner provided an update on the file and is looking for comments from the Commission. Councillor Schroeder inquired about how sewage disposal will be addressed. The County Planner indicated that the developer plans to use a communal septic system known as the Orenco System. The system involves a communal septic geld for gray water, and a communal septic tank for solids. Orenco Systems are sanctioned by Alberta Environment, but require maintenance and supervision from a Wastewater Technologist. More specific information is still needed from the developer regarding who will supervise the system. In the future, this type of system could be tied into an urban system as the waste water will be treated prior to entering a different system. S. Swenson inquired about the number of industrial parks already in existence around the City of Brooks with empty lots. She noted that the roads in this area are not great. The County Planner indicated that it is not our place to say whether or not the market for another industrial park is good or not. Any upgrades to existing infrastructure would be dealt with by Alberta Transportation and/or a development agreement with the County. POST AGENDA ~ a) Letter from Alberta Transportation Re: De-Designating SH 542 The County Planner provided an overview of the letter received through the IMDP Referral process. Secondary Highway 542 is a well developed area of the County. This creates a problem for Alberta Transportation and their access management strategy because SH 542 is designated as a future multi-lane highway. Councillor Wutzke indicated that SH 542 may be part of a potential ring road which could require road widening. Councillor Schroeder indicated that he believes that we should lobby for control of SH 542. He also indicated that an extra lane would assist with traffic flow. Councillor Andrews stated that we should wait and see what happens with the request sent to Alberta Transportation about SH 873 before negotiating a deal to de-designate SH 542. M. Harbicht indicated that SH 542 was originally paved because it was the only link between Brooks and Highway 36. The Commission decided to wait and see what Alberta Transportation will give us for taking over the road. Once a response is received regarding SH 873, a response will be sent to Alberta Transportation about the de-designation of SH 542. Left the Meetinca Mark Harbicht left at 10:51 a.m. b) Comments about the Planning and Development Department to add to the CAO Appraisal ~-• Councillor Douglass informed the Commission that the CAO Performance Evaluation Committee is working to complete the CAO's performance appraisal. They are looking for input from the Commission about the Planning and Development Department. More specifically, Councillor Douglass asked the Members at Large for their opinion. The Members at Large agreed that they do not get as much information ahead of time as Council does for Planning and Development issues that go to Council rather than MPC. Currently, the Members at Large have some minor technical issues to work out with their laptops and connecting from home. They are sent copies of all of the Council minutes and also have access to the minutes on the MPC data drive. They feel that although their individual votes count for less, it is better having full Council on MPC. Councillor Douglass also asked for input regarding the contract planning service that we receive from the Oldman River Regional Services Commission. A discussion followed regarding the pros and cons of having a contract planning service versus an in-house planner. The Commission agreed that Diane Horvath is an excellent asset of the planning and development department, although it would be nice if she had a few office days per month here. The County Planner indicated that Lenze Kuiper, Manager of ORRSC, is going to be coming to meet with MPC sometime in the next few months in order to discuss the services provided and any changes that we would like.
