MUNICIPAL PLANNING COMMISSION MEETING
May 12, 2009
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Tuesday, May 12, 2009 commencing at
10:00 a.m.

6. DEVELOPMENT PERMITS
a) Permit #3302 & HO #243 -Lot 6, Block 1, Plan 021 2021, NW 33-
19-14-W4M, Division 10
Kory & Debbie Schottenbauer (Owner /Applicant)
Construction of a shop for a home occupation 2 business
The Development Control Officer provided background information on
the proposed development permit and associated home occupation
permit. The applicant D. Schottenbauer indicated that her husband
currently owns Lot 7 to the South, and have a purchase agreement in
place for Lot 6, pending the approval of this permit. One issue with
this permit is that the road that will give access to the proposed shop
is on Lot 7. The applicant indicated that if Lot 7 was ever sold, an
agreement would need to be in place allowing access to the shop using
the approach on Lot 7. The County Planner asked if the house on Lot 6
would be rented out. The applicant indicated that the house would
probably be rented to an employee. The County Planner stated that
this permit cannot be classified as a home occupation permit unless
the applicant resides in a residence on the same property. S. Swenson
asked if there was enough room for large trucks to turn around. D.
Schottenbauer indicated that the existing accessory building on Lot 6
would be removed allowing for more than adequate turning room.
P-41/09 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning
Commission TABLE Development Permit #3302 and Home Occupation
Permit #242, granting a permanent permit to construct a 3000 ftz (287.7
m2) shop and operate a Home Occupation 2 business, "Kory's Vacuum
Truck Service on Lot 6, Block 1, Plan 021 2021, NW 33-19-14 W4M.

The Development Control Officer provided background information on
the proposed development permit.
P-42/09 MOVED BY COUNCILLOR 7. HARBINSON that the Municipal Planning
Commission APPROVE Development Permit #3304 and grant approval for the
installation of a 1995 moved-in manufactured home as a 2"d dwelling, subject
to the following conditions:
This permit is being granted only for the installation of a 1995, 1216 ftz
(112.9 mz) manufactured home, on lands legally described as NW 19-
17-14 W4M. Any additional development shall require prior approval of a
separate permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626-07, and amendments
thereto, pertaining to the Agricultural District and Schedule 9:
Development Standards for Manufactured, Mobile, Modular and
Ready-to-Move (RTM) Homes.
c) All Alberta Building Codes where applicable.
d) Any other required permits, including electrical, heating &
ventilation, gas and/or plumbing. These must be obtained from an
accredited inspection agency
e) That this development is located as shown on the site plan approved
in this application and submitted April 23, 2009. Any changes to
that plan shall require the written approval of the Development
Officer.
f) That the developer obtain an building permit issued by a licensed,
accredited building inspection agency for the County of Newell. A
copy of this permit must be submitted to the Development Officer.
g) That the developer obtain a Private Sewage Disposal System Permit,
issued by a licensed, accredited building inspection agency for the
County of Newell. A copy of this permit must be submitted to the
Development Officer.
h) That the developer obtain a Roadside Development Permit from
Alberta Infrastructure and Transportation. A copy of this permit must
be submitted to the Development Officer.
i) That the following setbacks are maintained for this development:
Front (south) 20 ft (6.1 m)
Side (west -County road) 100 ft (30 m)
Side (east) 20 ft (6.1 m)
Rear (north) 20 ft (6.1 m)
j) That the manufactured home is skirted with materials the same as or
consistent with the remainder of the building.

7. AGRICULTURAL SUPPORT SERVICE & HOME OCCUPATION PERMITS

Renewal of an existing home occupation permit for a carpet and
upholstery cleaning company
The Development Control Officer provided background information on
the proposed development permit.
P-43/09 MOVED BY COUNCILLOR H. WUTZKE that the Municipal Planning
Commission APPROVE Home Occupation Permit #183, granting a permanent
permit to operate a Home Occupation 2 business on the property named on the
application, under the provisions of the Country Residential Land Use District
and the Home Occupation Schedule of the County of Newell Land Use Bylaw
1626-07, subject to the following conditions:
This permit is being granted as a permanent permit for the use of the
existing garage and dwelling for the carpet and upholstery cleaning
service, ]ardel Carpet Cleaning, on lands legally described as Lot 4,
Block 1, Plan 901 1761, SW 10-19-14 W4M. Any additional development
shall require prior approval of a separate permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626-07, and amendments
thereto, pertaining to the Country Residential District and the Home
Occupation requirements (Schedule 13).
c) All Alberta Building Codes where applicable.
d) Any other required permits, including electrical, heating &
ventilation, gas and/or plumbing. These must be obtained from an
accredited inspection agency.
e) That this development is located as shown on the site plan approved
in this application and submitted March 26, 2009. Any changes to
that plan shall require the written approval of the Development
Officer.
f) That no signage is placed to advertise the business, unless written
approval is obtained from the Development Officer.
g) That no non-resident employees are used in the operation of the
business.

Commission APPROVE Home Occupation Permit #241, granting a permanent
permit to operate a Home Occupation 3 business on the property named on the
application, under the provisions of the Agricultural Land Use District and the

Home Occupation Schedule of the County of Newell Land Use Bylaw 1626-07,
subject to the following conditions:
This permit is being granted as a permanent permit only for the
operation of a ceramics business to provide classes and a retail outlet
on lands legally described as Block 1, Plan 011 1231, NW 28-14-13
W4M. Any additional development shall require prior approval of a
separate permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes
and standards.
b) The provisions of Land Use Bylaw #1626-07, and amendments
thereto, pertaining to the Agricultural District and the Home
Occupation requirements (Schedule 13).
c) All Alberta Building Codes where applicable.
d) Any other required permits, including electrical, heating &
ventilation, gas and/or plumbing. These must be obtained from an
accredited inspection agency.
The developer ensuring:
e) That this development is located as shown on the site plan
approved in this application and submitted April 9, 2009. Any
changes to that plan shall require the written approval of the
Development Officer.
f) That the signage advertising the business is in accordance with
Schedule 13.4 of the Land Use Bylaw:
No advertising shall be permitted on the property except for
one indirect/y illuminated sign of 4 ftZ (0.4 mZ) placed flat
against the building or fence.
g) That there is adequate parking space for this use, in this instance,
8 parking stalls for employee and customer use.

The Development Control Officer provided background information on
the proposed development permit.
P-45/09 MOVED BY COUNCILLOR B. DE 70NG that the Municipal Planning
Commission APPROVE Home Occupation Permit #242, granting a permanent
permit to operate the Home Occupation 2 business, "The Water Truck", on the
property named on the application, under the provisions of the Agricultural
Land Use District and the Home Occupation Schedule of the County of Newell
Land Use Bylaw 1626-07. This permit will be subject to the following conditions:
a) This permit is being granted only for the use of an existing shop
and yard for the water hauling service, The Water Truck, on lands
legally described as Block 1, Plan 851 0297, NE 8-20-12 W4M. Any
additional development shall require prior approval of a separate
permit application.

c) The provisions of Land Use Bylaw #1626-07, and amendments

9. SUBDIVISIONS

a) #2009-0-075 -Block 1, Plan 411 EA, NE 19-15-15-W4M
Scandia Honey Corporation (Owner) /Cameron Christianson (Applicant)
To subdivide an approximate 0.655 acre parcel from an existing lot to
separate the existing residence from the commercial enterprise.
The County Planner provided background information on the proposed
subdivision.
P-47/09 MOVED BY COUNCILLOR R. ANDREWS that the Municipal Planning
Commission APPROVE subdivision #2009-0-075, subject to the following
conditions:
1. That the 10% reserve requirement be provided as money in place of
land on the 2.27 acres at the market value of $10,330 per acre with the
actual acreage and amount to be paid to the County of Newell be
determined at the final stage, for Municipal Reserve purposes.
2. That all outstanding property taxes shall be paid to the County of
Newell.

-- 10. OTHER BUSINESS
a) Review of Services provided by ORRSC
Lenze Kuiper provided a power point presentation regarding an overview
of the Oldman River Regional Services Commission, the services they
provide and the direction they plan to go. Highlights included an
overview of why we plan, background about ORRSC and the services
that it provides and is considering providing in the future. L. Kuiper also
indicated that to better utilize the services that ORRSC provides to us, it
is imperative that ORRSC be integrated as much as possible into our
Public Works, GIS and Assessment departments. Benefits of using
ORRSC includes having educated staff with a variety of experience in
both rural and urban settings available, and not having the inconsistency
of having in-house planners leave with no one to pick up where they left
off. An additional benefit is that ORRSC's fee is much lower than the
salary of an in-house planner. L. Kuiper explained the current fee
structure and indicated that ORRSC is looking at moving towards a
stable fee structure whereby municipalities would pay a higher base fee
that covers other services provided by ORRSC such as the writing of
statutory plans and other services that have been previously charged for
on a project specific basis. In order for ORRSC to remain stable and
viable for the years to come, they need a commitment from the
municipalities they serve, stable funding, and additional staff. A question
period followed. Topics included whether video conferencing could assist
ORRSC staff by reducing travel time, and whether the current
arrangement is addressing our planning and development needs. D.
Horvath feels that enquiries are being adequately answered by A.
Wickert and D. Lester. Further discussion included the possibility of D.
Horvath spending specific office hours here in an effort to increase
accessibility for our ratepayers. D. Horvath and L. Kuiper indicated that
this is definitely a possibility but would be dependent on the schedule for
other meetings that D. Horvath needs to attend.
b) Discussion regarding Granny Suites
Councillor B. De Jong provided an overview of a question received
regarding "granny suites". The County Planner indicated that other
municipalities are also currently dealing with this issue. She suggested
that she bring back a policy to the Commission for consideration at an
upcoming meeting. Potential concerns with granny suites include what
happens with the suite after the original resident ceases to reside in the
unit.
