MUNICIPAL PLANNING COMMISSION MEETING
August 11, 2009
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Tuesday, August 11, 2009 commencing at
10:00 a.m.

Installation of a manufactured home with additions and an attached
shop /garage
The Development Control Officer provided background information on
the proposed development permit. Emphasis was given on whether or
not the breezeway is an adequate attachment to the dwelling. The
applicant indicated that several factors influenced the proposed
configuration of the manufactured home and shop including the slope
of the lot and allowing access to emergency vehicles on all sides of the
building. The applicant also indicated that many shops are in front of
the house and shop. Councillor Andrews stated that the configuration
fits in well with the surrounding area. He suggested only approving the
house now and waiving the fee for the attached shop later. The County
Planner suggested that the location approved for the manufactured
home now influences the options of where the shop could be placed
later. She recommended that this permit either be approved in its
entirety now, or that an informative be added indicating that the
manufactured home was placed in such a manner to accommodate the
shop being placed in the front yard. The County Planner would also
like a condition to be added ensuring that the manufactured home and
shop will be aesthetically compatible with one another.
P -75/09 MOVED BY COUNCILLOR R. ANDREWS that the Municipal Planning
Commission APPROVE Development Permit #3334 and grant permission to
install a 1994 manufactured home, with additions and a covered deck, and also
permission to construct the attached accessory building (shop /garage) by
December 31, 2014, and subject to the conditions outlined below:
This permit is being granted only for the installation of a 960 ft (89.1
m manufactured home, with a 144 ft (13.3 m addition, a 252 ft
(23.4 m addition, a covered 120 ft (11 m deck, and an attached
2912 ft (270.5 m shop /garage on lands legally described as Lot 16,
Block 1, Plan 841 0810, SW 13 -17 -17 W4M. Any additional development
shall require prior approval of a separate permit application.

The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Light Industrial District.
c) All Alberta Building Codes where applicable.
d) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. These must be obtained from an
accredited inspection agency
e) That this development is located as shown on the site plan approved
in this application and submitted July 13, 2009. Any changes to that
plan shall require the written approval of the Development Officer.
f) Development Notification: the developer shall notify the
Development Officer:
i) when the actual development commences, and
ii) upon completion of the development
g) The developer providing the Development Officer with a copy of the
building permit issued by a licensed, accredited building inspection
agency for the County of Newell.
h) That the developer obtain a Private Sewage Disposal System Permit,
issued by a licensed, accredited building inspection agency for the
County of Newell. A copy of this permit must be submitted to the
Development Officer.
i) That the developer obtain a Roadside Development Permit from
Alberta Infrastructure and Transportation. A copy of this permit must
be submitted to the Development Officer.
j) That the property is not used for conducting a business or
commercial operation without first obtaining the required permits.
k) That the manufactured home is skirted with materials the same as or
consistent with the remainder of the building.
I) That the following setbacks are maintained for this development:
Front (southwest) and Rear (north) Yard 20 ft (6.1 m)
Side Yard (west, southeast, east) 5 ft (1.5 m)
m) That the manufactured home and shop be aesthetically compatible
and finished with the same exterior materials.

The Development Control Officer provided background information on
the proposed development permit.
P -76/09 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning
Commission APPROVE Development Permit #3336, and grant approval for the
installation of a manufactured home as a 2 dwelling, subject to the following
conditions:
This permit is being granted only for the installation of a 1216 ft (113 m
manufactured dwelling as part of the existing agricultural operation, on lands

legally described as SE 23 -22 -17 W4M. Any additional development shall
require prior approval of a separate permit application.
The proposed development complying with:

The County Planner directed the Commission to the handout distributed
by the Development Control Officer describing "family care dwellings
Discussion followed regarding whether it would be better to add garden
suites as a listed use in certain districts or a new schedule with policies
about 2nd dwellings. It was decided that garden suites should be looked
at as 2 dwellings since there is no way to ensure that once a family
member is no longer living in the suite that it won't turn into a rental
property. The County Planner will bring back a proposed schedule to an
upcoming meeting.
a) Proposed Amendments to the LUB
Adding greenhouses as a discretionary use in the Industrial District
Adding requirements for kennels

A discussion was held regarding proposed land use bylaw amendments.
The proposed amendment regarding adding greenhouses as a listed use
in the Industrial District will be brought back to a future meeting. The
County Planner provided some information regarding kennel regulations
that could be added as a schedule to the Land Use Bylaw. It was
suggested that a policy be included regarding conforming to the
Canadian Veterinary Association Codes of Practice. The policy regarding
kennels will be brought to an upcoming Council meeting for approval.
8. DEVELOPMENT REPORT NAY 8 AUGUST 5, 2009
Councillor de Jong noted that Industry Canada should be contacted for their
concerns regarding DP #3337, which involves the installation of a 100 ft.
flag pole. The Development Control Clerk will contact Industry Canada.

To subdivide an approximate 1.07 acre parcel from a lot legally known
as 2 MR, Plan 841 0735 located within the NW 24 -16 -16 -W4M, adjacent
to the Hamlet of Rainier.
The County Planner provided background information on the proposed
subdivision noting that there are no conditions of approval.

Commission APPROVE subdivision #2009 -0 -140.

The County Planner provided background information on the proposed
subdivision.
P -79/09 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning
Commission APPROVE subdivision #2009 -0 -140, subject to the following
conditions:
1. That all outstanding property taxes be paid.
2. That the applicant submit to the Subdivision Authority a copy of a
sketch from an Alberta Land Surveyor that certifies the location and
dimensions of the existing buildings and the exact dimensions of the
lot to be subdivided.

b) Alberta Utilities Commission Notice of Application
MOTION CARRIED
The County Planner distributed a questionnaire created by ORRSC about
the Position Paper that will be submitted to the South Saskatchewan
Regional Advisory Committee. The list of questions was discussed with
topics including transportation and pipeline /utility corridors, agriculture,
access to water, country residential development, urban growth and
development, striking a balance between natural resources, recreation
and conservation and whether or not existing plans should take
precedence over regional plan policies. Once ORRSC's report is
complete, it will be available for review.
d) Alta Link Transmission line between Brooks and Medicine Hat
There will be Public Hearings held in the Brooks area regarding the
construction of this new transmission line, and at that point comments
from the County would be appreciated.
Councillor Andrews inquired regarding the pond location on the parcel
adjacent to the area to be subdivided as approved subdivision 2009 -0 -140
and whether or not it should have been included in the subdivided area.
Councillor Schroeder replied that the pond needed to remain part of the
adjacent parcel as it supplies fire protection for the school.
a) Request for Comments by City Subdivision 2009 SUB 002
The County Planner was directed to respond to the application,
indicating that the County of Newell has no concerns regarding the
application, and noting that this application should be referred to the
IMDP Committee for further review.
Councillor Daniels inquired about the proximity of the Transmission
line to our South access road near Silver Sage. Since this road may be
included as part of our South Truck Route Bypass we should ensure
that the new line allows for an adequate setback from the road.
