The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Thursday, October 22, 2009 commencing at
10:00 a.m.

1. CALL TO ORDER
As this is the first MPC meeting following the 2009 Organizational Meeting,
the Assistant Administrator called the meeting to order at 10:00 a.m.
2. NOMINATION ELECTION OF CHAIRMAN
The Assistant Administrator opened the floor for nominations /volunteers for
the position of Chairman. Councillor J. Harbinson nominated Councillor A.M.
Philipsen.

Councillor A.M. Philipsen was declared Chairman.

The Development Control Officer provided background information on
the proposed development permit.
P- 114/09 MOVED BY COUNCILLOR H. WUTZKE that the Municipal Planning
Commission APPROVE Development Permit #3408 for the construction of a
greenhouse building with retail garden center and related site features,
subject to the following conditions:
This permit is being granted only for construction of a greenhouse
building with retail garden centre and related site features, on lands
legally described as Lot 3, Block 2, Plan 041 3476, NW- 9 -19 -14 W4M.

Any additional development shall require prior approval of a separate
permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Industrial District.
c) All Alberta Building Codes where applicable.
d) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. These must be obtained from an
accredited inspection agency
And subject to the following conditions:
e) That this development is located as shown on the site plan approved
in this application and submitted September 22, 2009. Any changes
to that plan shall require the written approval of the Development
Officer.
f) That the developer obtain a building permit issued by a licensed,
accredited building inspection agency for the County of Newell. A
copy of this permit must be submitted to the Development Officer.
g) That the developer obtain a Roadside Development Permit from
Alberta Infrastructure and Transportation. A copy of this permit must
be submitted to the Development Officer.
h) That the developer obtain a Sign Installation Permit from Alberta
Transportation in order to install a sign advertising the business on
Secondary Highway 873. A copy of this permit must be submitted to
the Development Officer.
i) Development Notification: the developer shall notify the
Development Officer:
i. when actual development commences, and
ii. upon completion of the development
j) That the following minimum number of parking spaces are provided
for this use: 14 stalls.
k) That the developer submit a landscaping plan to the Development
Officer within six (6) months of development approval, by May 1,
2010. Landscaping of the property must be completed within two
years of the date of approval, by October 31, 2011.
I) That the following setbacks are maintained for this development:
Front: 20 ft (6.1 m)
Side: 5 ft (1.5 m)
Rear: 20 ft (6.1 m)

regarding the position paper titled "Municipal Perspectives: A Position

Paper on the South Saskatchewan Regional Plan Topics discussed
included the proposed name change and sub regions.

endorse the position paper "Municipal Perspectives: A Position Paper on the
South Saskatchewan Regional Plan" written by ORRSC

It was noted that any concerns could be submitted directly to the South
Saskatchewan Regional Advisory Committee separately from the
position paper.

Construction of 2 visitor parking lots
The Development Control Officer provided background information on
the proposed development permit. The Board discussed various
conditions that could be placed on the development, including
landscaping, RV parking, gravel /paving, signage and handicap parking.
While it was noted that the County has a duty to impose enough
conditions to ensure acceptable development, input from the Block 1
Condo Board should be considered.
P 99/09 MOVED BY COUNCILLOR 3. HARBINSON that the Municipal Planning
Commission APPROVE Development Permit #3407 and grant approval for
the construction of 2 visitor parking lots at Lake Newell Resort, subject to
the following conditions:
This permit is being granted only for the construction of 2 875 m
(9419 ft visitor parking lots on lands legally described as Lot 1, Block
10, Plan 021 0823, NW 6 -18 -14 W4M. Any additional development shall
require prior approval of a separate permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes
and standards.

b) The provisions of Land Use Bylaw #1626 -07, and amendments

approved in this application and submitted September 21, 2009.
Any changes to that plan shall require the written approval of the
Development Officer.

The Development Control Officer provided background information
on the proposed development permit application. She presented
pictures that were taken of the site.
MOVED BY COUNCILLOR J. HARBINSON that the Municipal Planning
Commission APPROVE Development Permit #3409 and grant approval
for construction of a single family dwelling with attached garage and
patio, and with variances to the front and side yard fence wall heights,
subject to the following conditions:
This permit is being granted only for the construction of a 4058 ft
(377 m single family dwelling with attached garage and patio, and
with variances to the front and side yard fence wall heights, on
lands legally described as Lot 3, Plan 941 1173, NW 6 -18 -14 W4M.
Any additional development shall require prior approval of a separate
permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes
and standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Resort Residential District.
c) All Alberta Building Codes where applicable.

d) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. These must be obtained from
an accredited inspection agency.
And subject to the following conditions:
e) That this development is located as shown on the site plan
approved in this application and submitted September 25, 2009.
Any changes to that plan shall require the written approval of the
Development Officer.
f) That the developer provide the Development Officer with a copy
of the building permit issued by a licensed, accredited building
inspection agency for the County of Newell.
g) Development Notification: the developer shall notify the
Development Officer:
i) when actual development commences, and
ii) upon completion of the development
h) That the property is not used for conducting a business or
commercial operation without first obtaining the required
permits.

on the proposed home occupation 2 permit.
P 102/09 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning
Commission APPROVE Home Occupation Permit #210, granting a
permanent Home Occupation 2 permit to operate a mobile mechanics and
repair shop, subject to the following conditions:
This permit is being granted only for the operation of a mobile
mechanics and repair shop, on lands legally described as SW 34 -17-
14 -W4M. Any additional development shall require prior approval of
a separate permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes
and standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Agricultural District and the Home
Occupation requirements (Schedule 13).
c) All Alberta Building Codes where applicable.
d) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. These must be obtained from
an accredited inspection agency.
And subject to the following conditions:
e) That this development is located as shown on the site plan
approved in this application and submitted September 14, 2009.
Any changes to that plan shall require the written approval of the
Development Officer.
f) That there are no non resident employees.

g) That no more than one vehicle is used in conjunction with the
Home Occupation Permit. No other commercial vehicles shall be

placed flat against the building or fence.
i) That there is no outside storage of goods or materials related to
this Home Occupation Permit.
j) That no noise, vibration, smoke, dust or odours, which may
affect adjacent landowners or development, are created from this
home occupation major.
k) That all hazardous waste and materials are disposed of in
regulated facilities.
I) That there is no contamination of soil, surface water or
groundwater from this use.

The County Planner provided background information on the proposed
subdivision. This application will require a waiver to the 7 acre vacant
parcel size stated in Land Use Bylaw 1626 -07. Discussion followed
regarding the undeveloped road allowance that would be used to
access the proposed parcel. It was noted that the canal that fragments
this quarter is not a registered canal.

Commission APPROVE subdivision #2009 -0 -205, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the applicant submit to the subdivision authority a copy of a sketch
from an Alberta Land Surveyor that certifies the location and dimensions
of the existing buildings and the exact dimensions of the lot to be
subdivided.
3. That the applicant enter into an agreement with the County of Newell for
the installation of any required road approaches to the proposed and /or
remnant parcels.
4. That the applicant or owner shall enter into a development agreement
with the County of Newell that requires that any approaches, roads, or
road upgrades be constructed to the satisfaction of the County of Newell
Public Works Department prior to finalization.

Councillor Philipsen asked if there was a policy about whether or not letters
received on the day of the meeting had to be considered. She stated that it
doesn't allow for adequate time to review the information prior to a
meeting. The County Planner noted that not considering information
received could open the County up to appeals. Public Hearings could be
recessed and applications tabled until information has been considered.
