Commission APPROVE subdivision #2009 0 224.

To subdivide a 3.62 acre parcel from a previously subdivided quarter

The County Planner provided background information on the proposed
subdivision.
P 130/09 MOVED BY COUNCILLOR B. DE TONG that the Municipal Planning
Commission APPROVE subdivision #2009 -0 -225, subject to the following
conditions:
1. That the 10% reserve requirement be provided as money in place of
land on the 3.62 acres at the market value of $3000.00 per acre with
the actual acreage and amount to be paid to the County of Newell No. 4
at the final stage for Municipal Reserve purposes.
2. That all outstanding property taxes shall be paid.
3. That the easement(s) as required by ATCO gas or any other utility
agency or the municipality shall be established prior to finalization of the
application and are to be registered simultaneously with the legal plan of
the subdivision.

The County Planner provided background information on the proposed
subdivision.
P- 131/09 MOVED BY COUNCILLOR H. WUTZKE that the Municipal Planning
Commission APPROVE subdivision #2009 -0 -231, subject to the following
conditions:
1. That all outstanding property taxes shall be paid.
2. That the applicant submit to the Subdivision Authority a copy of a sketch
from an Alberta Land Surveyor that certifies the location and dimensions
of the existing buildings and the exact dimensions of the lot to be
subdivided.
3. That the application file a letter from the NRCB indicating that the
deemed permits for the existing confined feeding operation on the parcel
being created have been cancelled.
Councillor Eastman declared a pecuniary interest due to his ownership of the NW 13-21-16
W4M and left the meeting at 10:19 a.m.

will be reconfigured so that the new parcel would not result in any
increase in parcel density
The County Planner provided background information on the proposed
subdivision.
P- 132/09 MOVED BY COUNCILLOR 3. HARBINSON that the Municipal Planning
Commission APPROVE subdivision #2009 -0 -236, subject to the following
conditions:
1. That all outstanding property taxes shall be paid.
2. That the 8.4 acre portion of NE 1 /4 13 -21 -16 -W4M be consolidated with
the residual adjacent portion of the NW 1 /4 13 -21 -16 -W4M in a manner
such that the resulting Certificate of Title could not be subdivided
without the approval of the Subdivision Authority.
3. That the applicant submit to the Subdivision Authority a copy of a sketch
from an Alberta Land Surveyor that certifies the location and dimensions
of the existing buildings and the exact dimensions of the lot to be
subdivided.

Commission APPROVE Development Permit #3422, granting approval for the
The Development Control Officer provided background information on
the proposed development permit indicating that the storage area is
already in existence and that approval of this permit would bring the
operation into compliance.
This permit is being granted only for outdoor storage of clean oilfield
pipe, on lands legally described as Lot 6, Block 2, Plan 031 2492, NW
19 -18 -14 W4M. Any additional development shall require prior approval
of a separate permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Industrial District.
c) All Alberta Building Codes where applicable.
d) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. These must be obtained from an
accredited inspection agency
And subject to the following conditions:
e) That this development is located as shown on the site plan approved
in this application and submitted October 8, 2009. Any changes to
that plan shall require the written approval of the Development
Officer.

construction of a detached oversized garage, and granting compliance for an
existing manufactured dwelling, and subject to the following conditions:
This permit is being granted only for the construction of a 900 ft (83.6
m detached oversized garage, and compliance for a 1428 ft (133 m
manufactured dwelling, on lands legally described as Lot 16 of Westridge
Acres, Block 4, Plan 001 1930, SW 1 -19 -15 W4M. Any additional
development shall require prior approval of a separate permit
application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Manufactured Home Park District.
c) All Alberta Building Codes where applicable.
d) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. These must be obtained from an
accredited inspection agency
And subject to the following conditions:
e) That this development is located as shown on the site plan approved
in this application and submitted October 27, 2009. Any changes to
that plan shall require the written approval of the Development
Officer.
f) That the developer provide the Development Officer with a copy of
the building permit issued by a licensed, accredited building
inspection agency for the County of Newell.
g) Development Notification: the developer shall notify the
Development Officer:
i) when actual development commences, and
ii) upon completion of the development
h) That the following setbacks on all sides are maintained for this
development:
Side (west): 10 ft (3 m)
Rear (north): 5 ft (1.5 m)
i) That the developer obtain a Roadside Development Permit from
Alberta Infrastructure and Transportation. A copy of this permit must
be submitted to the Development Officer.

a) Discussion regarding the MDP and LUB
The County Planner provided a recommendation to the Commission to
amend the Municipal Development Plan. She indicated that an update to
the Land Use Bylaw would also be beneficial at this time, and that both
projects could use the same public consultations. Discussion followed
regarding the type of public consultation that would be used and the
timeframe for completion of this project. The County Planner will bring a
project proposal back to a future MPC meeting.

a) South Saskatchewan Regional Plan Open Houses
P 135/09 MOVED BY COUNCILLOR H. WUTZKE that all Councillors be permitted to
attend the South Saskatchewan Regional Plan Open House as a function of
Council.

9. POST AGENDA
The SSRAC has scheduled open houses regarding the South
Saskatchewan Regional Plan. The Brooks open house will take place on
December 7 with a session for municipalities from 1 -3 and a session
for the public from 4 -7.
