MUNICIPAL PLANNING COMMISSION MEETING
February 11, 2010
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Thursday, February 11, 2010 commencing
at 9:59 a.m.

a) January 7, 2010
P -8/10 MOVED BY COUNCILLOR M. DOUGLASS that the minutes of the January
7, 2010 Municipal Planning Commission meeting be adopted as presented.

The Chairman called for post agenda items.
5. ADOPTION OF AGENDA
P -9/10 MOVED BY COUNCILLOR A. EASTMAN that the agenda be adopted as

8. DEVELOPMENT PERMITS
a) DP #3357 NE 13 -21 -16 -W4M, Lot 1, Block 2, Plan 9410388,
Division 4
N. William Roselynn Easter (Owner /Applicant)
Construction of a single unit dwelling with attached garage. Variance
request to front yard setback.
The Development Control Officer provided background information on
the proposed development permit. Discussion followed regarding the
variance to the required setback being 66' instead of 100' to align
with houses on adjacent properties.
P -10/10 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning
Commission APPROVE Development Permit #3357 and grant approval for
the construction of a dwelling with attached garage, with a variance to the
front yard setback requirement, and subject to the following conditions:
This permit is being granted only for the construction of a single unit
dwelling with attached garage, and with a variance to the front yard
setback requirement, on lands legally described as Lot 1, Block 2, Plan
941 0388, NE 13 -21 -16 W4M. Any additional development shall
require prior approval of a separate permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes
and standards.
b) The provisions pertaining to the Country Residential District and all
relevant schedules, as outlined in the County of Newell Land Use
Bylaw #1626 -07
c) All Alberta Building Codes, where applicable. If the developer is
required to obtain! a building permit, it is his her responsibility to

do so, and furthermore, this permit must be obtained from an
accredited inspection agency.
d) All Alberta Safety Codes, where applicable. If the developer is
installing a new sewage disposal system, he /she is required to
obtain a Private Sewage Disposal System Permit, issued by a
licensed, accredited inspection agency.
e) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. All permits must be issued by a
licensed agency.
And subject to the following conditions:
f) That this development is located as shown on the site plan
approved in this application and submitted January 15, 2010. Any
changes to that plan shall require the written approval from the
Development Officer.
g) That the following setbacks on all sides are maintained for this
development:
Front (east to RR 16 -0):66 ft (20 m) variance from 100 ft (30 m)
Side (south and north):20 ft (6 m)
Rear (west): 20 ft (6 m)
h) Development Notification: the developer shall notify the
Development Officer:
i. prior to the commencement of actual development thereon,
and
ii. upon completion of the development
i) That the property is not used for conducting a business or
commercial operation without first obtaining the required permits.
j) That any residence and /or structures are located a minimum
distance of 100 m' (328 ft) from any gas or oil well on or adjacent
to the property. A variance of this distance may only be provided
by the ECRB.

Construction of a school building
The Development Control Officer provided background information on
the proposed development permit including options for reconfiguring
the quarter line. The applicant has indicated that the two quarters will
be consolidated. Further discussion followed regarding why it was
necessary to consolidate the neighbouring quarter sections. The
County Planner indicated that without consolidation the proposed
building would encroach on the adjacent quarter.

P -11/10 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning
Commission APPROVE Development Permit #3356 and grant approval to
construct a 5400 ft (501.7 m school building, subject to the following
conditions:
This permit is being granted only for the construction of a 5400 ft
(501.7 m school building, on lands legally described as S 1/2 2 -24 -16
W4M. Any additional development shall require prior approval of a
separate permit application.
The proposed development complying with:
a) The provisions pertaining to the Agricultural District and all relevant
schedules, as outlined in the County of Newell Land Use Bylaw
#1626-07.
b) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
c) All Alberta Building Codes, where applicable. If the developer is
required to obtain a building permit, it is the developer's
responsibility to do so. Furthermore, this permit must be obtained
from an accredited inspection agency.
d) All Alberta Safety codes, where applicable. If the developer is
installing a new sewage disposal system, it is the developer's
responsibility to obtain a Private Sewage Disposal System Permit,
issued by a licensed, accredited inspection agency.
e) Any other required permits, including electrical, heating

And subject to the following conditions:
f) That this development is located as shown on the site plan

g) That the applicant consolidates SW 2 -24 -16 and SE 2 -24 -16 by
survey plan. The parcel must be consolidated so that it cannot be
resubdivided without going through the subdivision process. This
consolidation process must be completed within 6 months of this
permit approval, by August 31, 2010.
h) That the developer obtains a Roadside Development Permit from
Alberta Transportation. A copy of this permit must be submitted to
the Development Officer.
i) That there is a 2 m (6.6 ft.) separation distance between the new
building and any other buildings on the site.
j) That the structure is not used for conducting a business or
commercial operation without first obtaining the required permits.
k) That this structure is located a minimum distance of 100 m (328 ft)
from any gas or oil well on or adjacent to the property. A variance
of this distance may only be provided by the ECRB.
I) Development Notification: the developer shall notify the
Development Officer:
i. prior to the commencement of actual development thereon,
and
ii. upon completion of the development

10. SUBDIVISIONS
a) #2010 -0- 016 -SE 30 -18 W4M
Cliff Sewall (Owner /Applicant)
To subdivide a 144.0 acre (58.27 ha) parcel to create 3 lots of various
sizes for light industrial use.
This subdivision will be brought back to a future Municipal Planning
Commission Meeting, after the County City IMDP Committee has
provided a recommendation for the County's MPC to consider.

Al and Barbara Zandbelt (Owner /Applicant)
To subdivide an unsubdivided quarter section to create one new parcel
for country residential use.
The County Planner provided background information on the proposed
subdivision. Further discussion followed regarding the required setback
from the property line for the lagoon. An alternate solution would be to
install a septic field instead of adjusting the proposed property lines due
to the placement of the existing lagoon.
P -13/10 MOVED BY COUNCILLOR W.DANIELS that the Municipal Planning
Commission APPROVE subdivision #2010 -0 -020, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of
Newell.
2. That the applicant submit to the Subdivision Authority a copy of a
tentative subdivision sketch from an Alberta Land Surveyor that certifies
the location and exact dimensions of the lots to be subdivided, which
also includes the effluent lagoon.
3. That the property lines be adjusted to ensure that a 100 foot setback as
per the Alberta Private Sewage Systems Standard of Practice 2009 is
achieved from the edge of the effluent lagoon to the new boundary line
or the applicant install a septic field.

a) 2009 Planning and Development report
The Development Control Officer reviewed the 2009 planning and
development report and responded to questions.

11. POST AGENDA ITEMS
a) Update on MDP
The County Planner provided an update on the Municipal Development
plan indicating that questionnaires had been mailed out, and are
currently being returned. She reminded MPC about the public
meetings beginning next week.

There were no in camera items.
13. QUESTION PERIOD

14. ADJOURN
Being that the agenda matters have been concluded the meeting adjourned
at 10:30 a.m.
