MUNICIPAL PLANNING COMMISSION MEETING
February 25, 2010
The regular Municipal Planning Commission Meeting of the County of Newell No. 4 was
held in the County Office at Brooks, AB on Thursday, February 25, 2010 commencing
at 10:00 a.m.

The Development Control Officer provided an update to DP 3362 which
appeared on the Development Report last month. She indicated that the
property is zoned both direct control and small holdings and that the
direct control zoning listed on the report was incorrect as the
development permit was issued for development on the small holdings
portion of the parcel.
Left the Meeting
Councillor Andrews declared a pecuniary interest due to ownership of the property and left
the meeting at 10:02 a.m.
7. SUBDIVISIONS

Ryan Shannon Andrews (Owner) (Applicant)
To subdivide a previously subdivided quarter section to create one new
parcel for country residential use.
The County Planner provided background information on the proposed
Subdivision.
P 18/10 MOVED BY COUNCILLOR M. DOUGLASS that the Municipal Planning
Commission APPROVE subdivision 2010 -0 -015, subject to the following
conditions:
1. That the 10% reserve requirement be provided as money in place of
land on the 14.32 acres at the market value of $990 per acre with the
actual acreage amountto be paid to the County of Newell No. 4 be
determined at the final stage, for Municipal Reserve Purposes.
2. That all outstanding property taxes shall be paid to the County of
Newell.

To create one (1) new lot from a titled area of 6.32 acres (2.55 ha) for
country residential use.
The County Planner provided background information on the proposed
Subdivision. Further discussion followed regarding the condition about
soil testing.
P 19/10 MOVED BY COUNCILLOR B. DE JONG that the Municipal Planning
Commission APPROVE subdivision 2010 -0 -026, subject to the following
conditions:
1. That all outstanding property taxes shall be paid to the County of Newell
2. The applicant or owner or both enter into a Development Agreement
with the County of Newell which shall be registered concurrently with
the final plan against the title being created.
3. The applicant submit to the Subdivision Authority a copy of a sketch
from an Alberta Land Surveyor that certifies the location and dimensions
of the lot to be subdivided.
4. That, the applicant has a professional soils tests /analysis done at their
expense to ensure that the soil characteristics for a multi -lot subdivision
are capable of supporting multiple septic fields. The analysis must
include identifying and ,confirming the depth to water table to meet
provincial requirements. Analyses of the test must be performed and
approved by an engineer or approved agency under Alberta Labour, with
a copy of the report submitted and deemed acceptable to the
Subdivision Authority.

To subdivide an approximate 4.77 acre (1.93 ha) vacant parcel from a

The County Planner provided background information on the proposed
subdivision.
P 20/10 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning
Commission APPROVE subdivision 2010 -0 -032, subject to the following
conditions:
1. That the 10% reserve requirement be provided as money in place of
land on the 4.77 acre at the market value of $1950 per acre with the

actual acreage and amount to be paid to the County of Newell No. 4 be
determined at the final stage, for Municipal Reserve Purposes.

and /or remnant parcels.

8. AGRICULTURAL SUPPORT SERVICE HOME OCCUPATION PERMITS
a) HO #193 RENEWAL Ptn. SW 21- 19- 14 -W4M, Division 10

Renewal of an existing permit for an Oilfield Construction Business.
The Development Control Officer provided background information on
the proposed Home Occupation renewal permit. She indicated that
there was a separate development permit application for the
construction of a storage facility where the business will be located.
Further discussion followed regarding what happens if the applicant
changes the busines. It was noted that the permit would either be
amended by the Development Control Officer or brought back to MPC
depending on the severity of the change.
P 21/10 MOVED BY COUNCILLOR 3. HARBINSON that the Municipal Planning
Commission APPROVE Home Occupation Renewal Permit #193 for an
existing Oilfield Construction Business subject to the following conditions:
This permanent permit is being granted only for the existing oilfield
construction business, on lands legally described as SW 21 -19 -14 W4M.
Any additional development shall require prior approval of a separate
permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Small Holding District and to the definition
of a Home Occupation 2 business.
c) All Alberta Building Codes where applicable. If the developer is
required to obtain a building permit, it is his her responsibility to do
so, and furthermore, this permit must be obtained from an
accredited inspection agency.
d) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. All permits must be obtained from
an accredited inspection agency.
e) That this development is located as shown on the site plan approved
in this application 9nd submitted February 1, 2010. Any changes to
that plan shall require the written approval from the Development
Officer.
f) That the business maintains the present 1 resident employee and no
non resident employees. Since provisions for a Home Occupation 2
business in the Land Use Bylaw allow for up to 2 resident employees

and up to 5 non resident employees, this operation will be allowed to
expand to this extent without the need for any further permits.
However, if and when the business operator wishes to expand the
business, the land owner must consult with the Development Officer
before doing so.
g) That the following vehicles are permitted to be used in conjunction
with the Home Occupation Permit: 1 -semi truck and 1 business
truck. No other commercial vehicles shall be permitted without
obtaining written permission from the Development Officer.
h) That the developer obtains a Roadside Development Permit from
Alberta Transportation. A copy of this permit must be submitted to
the Development Officer.
i) That there is no advertising or display of produce being permitted on
the property except for one indirectly illuminated sign of 1 m placed
flat against the building or fence.

Jay DeJong (Owner) DeJong's Honey Farm (Applicant)
Application for existing honey processing and wholesale operation.
The Development Control Officer provided background information on
the proposed Home Occupation permit. DeJong's Honey Farm has never
had a home occupation permit until now. A permit is now required for
compliance due to the addition to the shop (DP 3353).
P -22/10 MOVED BY COUNCILLOR W. DANIELS that the Municipal Planning
Commission APPROVE Horne Occupation Permit #245 for an existing honey
processing and wholesale Business subject to the following conditions:
This permit is being granted only for the existing honey processing and
wholesale operation, qn lands legally described as Block 4, Plan 741
0106, SE 3 -19 -14 W4M. Any additional development shall require prior
approval of a separate permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Country Residential District, and the
definition of a Home Occupation business.
c) All Alberta Building Codes where applicable. If the developer is
required to obtain a building permit, it is his her responsibility to do
so, and furthermore, this permit must be obtained from an
accredited inspection agency.
d) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. All permits must be obtained from
an accredited inspection agency.
And subject to the following conditions:
e) That this development is located as shown on the site plan approved
in this application and submitted February 5, 2010. Any changes to

that plan shall require the written approval from the Development
Officer.
f) That there are no more than 2 resident employees and 4 non-
resident part-time summer employees.
g) That the developer obtains a Roadside Development Permit from

h) That the following vehicles are permitted to be used in conjunction
with the Home Occupation Permit: 1 -semi truck, 2 -1 -ton trucks; 1-
3 -ton truck; 1 -Y /2 ton truck and 1 water truck. No other commercial
vehicles shall be permitted.

Construction of an outdoor storage facility.
The Development Control Officer provided background information on
the proposed development permit. Discussion followed regarding the
items that would be permitted in the storage area.

Commission APPROVE Development Permit #3348 for the construction
of an outdoor storage facility subject to the following conditions:
This permit is being granted only for an outdoor storage facility,
on lands legally described as NW 7 -19 -14 W4M. Any additional
development shall require prior approval of a separate permit
application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations,
codes and standards.
b) The provisions of Land Use Bylaw #1626 -07, and
amendments thereto, pertaining to the Industrial District.
c) All Alberta Building Codes where applicable. If the developer
is required to obtain a building permit, it is his her
responsibility to do so, and furthermore, this permit must be
obtained from an accredited inspection agency.
d) Any other required permits, including electrical, heating
ventilation, as and /or plumbing. All permits must be
obtained from an accredited inspection agency.
And subject to the following conditions
e) That this development is located as shown on the site plan
approved in this application and submitted November 26,
2009 and finalized February 10, 2010. Any changes to that
plan shall require the written approval of the Development
Officer.

f) That the development is not used for the sale, service and /or
maintenance of any type of vehicle.
g) That the development is not used for storage of wrecked or
damaged vehicles or any components associated with
wrecked or damaged vehicles.
h) That no building(s) are constructed in accordance with this
development, without obtaining the proper permits.
i) That the outdoor storage facility is fenced using an 8 ft (2.4
m) high chain link security fence, complete with security gate.
j) That the development will have no more than 200 stalls for
rent and that no more than 2 items will be stored per stall.
k) That the following storage items will be permitted:
i. C -cans 10 ft (3 m) to 14 ft (4.3 m) in length
ii. Skidded Deranway unit building 10 ft (3 m) wide and
up to 20 ft (6 m) in length
iii. Wheeled long term storage: personal vehicles, RVs,
trailers, boats, motorhomes
I) That all parking and maneuvering areas be dust proofed by
pavement or crushed rock.

The Development Control Officer provided background information on
the proposed development permit.
P- 24/10 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning
Commission APPROVE Development Permit #3353, for construction of an
addition to an existing shop, and also approved variance to sideyard setback
requirement, subject to the following conditions:
This permit is being granted only for an addition to an existing shop,
with variance to side yard setback requirements, on lands legally
described as Block 4, Plan 741 0106, SE 3 -19 -14 W4M. Any additional
development shall require prior approval of a separate permit
application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Country Residential District.
c) All Alberta Building Codes where applicable. If the developer is
required to obtain a building permit, it is his her responsibility to do
so, and furthermore, this permit must be obtained from an accredited
inspection agency.

g) That the developer obtains a Home Occupation permit for the existing
honey production business that is presently operating in the building
that is being added to.
h) That access can be provided for Emergency Services vehicles to all
sides of the building.
i) Development Notification: the developer shall notify the Development
Officer:
i. prior to the commencement of actual
development thereon, and
ii. upon completion of the development

Operation of a Fill Dirt Pit
The Development Control Officer provided background information on
the proposed development permit. Discussion followed regarding
possible solutions to the noise and dust issues. E. Foisy representing
Smith Trucking Services explained that due to the location of the fill dirt
pit not being properly portrayed on the circulated map and several
details not having been established, that he was in favor of the
application being tabled. P. Humphreys voiced concerns over the short
time frame given for responses. The County Planner indicated that the
time frame was appropriate based on both our Land Use Bylaw and the
Municipal Government Act.
P -25/10 MOVED BY COUNCILLOR W. DANIELS that the Municipal Planning Commission
APPROVE Development Permit #3364, for the operation of a Fill Dirt Pit subject
to the following conditions:
This permit is being granted only for the use of the parcel listed in the
application as a fill dirt pit, on lands legally described as SW 3 -19 -15
W4M. Any additional development shall require prior approval of a
separate permit application.

a) The provisions pertaining to the Agricultural District and all relevant

furthermore, this permit must be obtained from an accredited inspection
agency.
d) All Alberta Safety Codes, where applicable. If the developer is installing a
new sewage disposal system, he /she is required obtain a Private
Sewage Disposal System Permit, issued by a licensed, accredited
inspection agency.
e) Any other required permits, including electrical, heating ventilation,
gas and /or plumbing. All permits must be issued by a licensed agency.
And subject to the following conditions:
f) That this development is located as shown on the site plan approved in
this application and submitted February 4, 2010. Any changes to that
plan shall require the written approval of the Development Officer.
g) That the developer submits a reclamation plan to the County within 2
years of permit approval, by February 28, 2012.
h) That the developer obtains a Roadside Development Permit from Alberta
Transportation. A copy of this permit must be submitted to the
Development Officer.
i) Development Notification: the developer shall notify the Development
Officer:
i. prior to the commencement of actual development thereon,
and
ii. upon completion of the development
j) That the developer submits a plan to address potential issues regarding
dust, noise, nuisance, and any other issues identified by the
Development Officer for the site prior to any work being started on the
removal of fill dirt.

The Development Control Officer provided background information on
the proposed development permit. She explained that this development
will take place over a period of 5 years. Additional permits will be
required for proposed structures not included in this permit.

P -27/10 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning
Commission APPROVE Development Permit #3361, for the concept plan for the
Regional Agricultural Fair and Rodeo Grounds subject to the following conditions:
This permit is being granted only for the implementation of the attached
Concept Plan for the Regional Agricultural Fair and Rodeo Grounds, on
lands legally described as NW 20 -18 -14 W4M. Any additional
development shall require prior approval of a separate permit
application
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Urban Fringe District.
c) All Alberta Building Codes, where applicable. If the developer is
required to obtain a building permit, it is his her responsibility to do
so, and furthermore, this permit must be obtained from an
accredited inspection agency.
d) All Alberta Safety Codes, where applicable. If the developer is
installing a new sewage disposal system, he /she is required obtain a
Private Sewage Disposal System Permit, issued by a licensed,
accredited inspection agency.
e) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. All permits must be issued by a
licensed agency.
And subject to the following conditions:
f) That this development is implemented as shown on the Concept Plan
approved in this application and submitted January 29, 2010. Any
changes to that plan shall require the written approval of the
Development Officer.
g) That access can be provided for Emergency Services vehicles to all
areas of the site.
h) That the following items are included in this development permit:
1. Levelling and contouring the site in preparation for development,
including construction of a swale for drainage purposes
(completed by the EID in fall 2009);
2. Construction of up to 2 washrooms on the site by the City of
Brooks. The final placement of these washroom facilities is
subject to approval by the County Development Officer;
3. Installation of 2 food booths operated by the Kinette and Lions
Clubs to be moved from the existing rodeo grounds. The final
placement of these booths is subject to approval by the County
Development Officer;
4. Operation of a Midway and Agricultural Fair, including all
development requirements associated with the proper operation
of a Midway and Fair;
5. Operation of a rodeo, including all the facilities necessary for the
proper operation of a rodeo (bleachers, infield, fencing, pens).
6. Construction of a maintenance building the purpose of the
building is for the storage of maintenance equipment used on the
site. The size and location of the building is subject to approval
by the County Development Officer;

7. Construction of a designated gravel parking area, including any
necessary fencing and traffic controls; also including an area for
overflow parking, if required; an area for RV parking may be
designated, if desired;
8. Construction of a designated stock trailer and contestant parking
area. Overnight parking and RV camping will be permitted by
contestants. However, no hook -ups, sewage disposal site or
other RV campground facilities will be provided;
9. Designation of a specific site for setting off fireworks. All codes
and policies required by Provincial and Federal government
agencies that regulate fireworks shall be followed;
10. Installation of a security trailer a manufactured home will be
installed as a dwelling for onsite security personnel. The final
placement of this dwelling is subject to approval by the County
Development Officer;
i) The following items are not included in this development permit:
1. Construction of a grandstand building;
2. Construction of any future barns and additions to existing barns,
or any other building not listed under g) above;
3. Overnight camping for any spectator at any time, other than
rodeo contestants;

dwelling and existing 2 car garage.
The Development Control Officer provided background information on
the proposed development permit. It was noted that the reason a permit
was required was because the size of the shop exceeds the permitted
size in the small holdings district.

APPROVE Development Permit #3363, for the construction of an accessory
building and compliance for an existing dwelling and existing 2 car garage
subject to the following conditions:
This permit is being granted only for the construction of a 6400 ft (595
m storage building, and compliance for an existing 3375 ft (314 m
dwelling and an 861 ft (80 m 2 car garage, on lands legally described
as SW 21 -19 -14 W4M. Any additional development shall require prior
approval of a separate permit application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) All Alberta Building Codes, where applicable. If the developer is
required to obtain a building permit, it is his her responsibility to do
so, and furthermore, this permit must be obtained from an

accredited inspection agency.
c) All Alberta Safety Codes, where applicable. If the developer is
installing a new sewage disposal system, he /she is required obtain a

d) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. All permits must be issued by a
licensed agency.
And subject to the following conditions:
e) That this development is located as shown on the site plan approved
in this application and submitted February 1, 2010. Any changes to
that plan shall require the written approval of the Development
Officer.
f) That the developer obtains Roadside Development Permit from
Alberta Transportation. A copy of the permit must be submitted to
the Development Officer.
g) That the property is not used for conducting a business or
commercial operation without first obtaining the required permits.
h) That the proposed 6400 ft (595 m storage building and existing
861 ft (80 m garage are not used for living purposes.
i) That any residence and /or structures are located a minimum distance
of 100 m (328 ft) from any gas or oil well on or adjacent to the
property. A variance of this distance may only be provided by the
ECRB.
j) That the following setbacks on all sides are maintained for this
development:
Front: 20 ft (6.1 m)
Side: 5 ft (1.5 m)
Rear: 20 ft (6.1 m)
k) Development Notification: the developer shall notify the
Development Officer:
i. prior to the commencement of actual development

oversize shop and compliance for an existing accessory building subject to the
following conditions:
This permit is being granted only for an addition to an existing shop,

additional development shall require prior approval of a separate permit
application.
The proposed development complying with:
a) All Federal, Provincial and Municipal statutes, regulations, codes and
standards.
b) The provisions of Land Use Bylaw #1626 -07, and amendments
thereto, pertaining to the Country Residential District.
c) All Alberta Building Codes where applicable. If the developer is
required to obtain a building permit, it is his her responsibility to do
so, and furthermore, this permit must be obtained from an
accredited inspection agency.
d) Any other required permits, including electrical, heating
ventilation, gas and /or plumbing. All permits must be obtained from
an accredited inspection agency.
And subject to the following conditions:
e) That this development is located as shown on the site plan approved
in this application and submitted February 4, 2010. Any changes to
that plan shall require the written approval from the Development
Officer.
f) That the following setbacks on all sides are maintained for this
development:
Front (west): 20 ft (6 m)
Side (north): 10 ft (3 m) variation to required 20ft (6 m) setback
East and South:20 ft (6 m)
g) That the developer obtains a Roadside Development Permit from
Alberta Transportation. A copy of this permit must be submitted to
the Development Officer.
h) That the new shop (accessory building) is aesthetically compatible
with other buildings in the Sunset Trail subdivision.
i) Development Notification: the developer shall notify the Development
Officer:
i. prior to the commencement of actual development
thereon, and
ii. upon completion of the development

a) MDP Update
The County Planner informed MPC that the public meetings have been
completed, stating that approximately 70 residents were in attendance.
She nlso indicated that over 260 questionnaires had been returned and
that she planned to have an initial report ready to present sometime in
March.

13. QUESTION PERIOD
Councillor Eastman asked about the setbacks for development near
pipelines and other oil and gas facilities. The County Planner indicated that
setbacks are based on the type of development occurring and the type of oil
and gas facility nearby.
