EXCUSED FROM MEETING All members were present. 3. MINUTES a) February 25, 2010 171/11ffit P -30/10 MOVED BY COUNCILLOR 5. HARBINSON that the minutes of the February 25, 2010 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P -31/10 MOVED BY COUNCILLOR W. DANIELS that the agenda be adopted as presented. MOTION CARRIED 6. SUBDIVISIONS a) #2010 016 SE 30 -18 -14 -W4M Cliff Sewall (Owner) (Applicant) To subdivide a 144.0 acre (58.27 ha) parcel to create 3 lots of various sizes for industrial use. The County Planner noted this matter had been reviewed by the County City IMDP Committee on March 10, 2010. Further information related to that discussion was yet to be received. She requested that the matter be defer. The Chairman confirmed that the application would be deferred as requested. 7. Agricultural Support Service Home Occupation Permits a) HO 246 Ptn. SW 18 -19 -15 -W4M, Plan 031 3053, Block 2, Lot 2 Division 5 Barbara Mossa (Owner) (Applicant) Home Pedicure Business The County Planner provided background information on the proposed development permit. A question was raised regarding a reference in the proposed conditions to the applicants use of a personal vehicle in conjunction with the home occupation. It was noted that there is no need to apply a condition pertaining to the use of a personal vehicle. P 32/10 MOVED BY COUNCILLOR 5. HARBINSON that the Municipal Planning Commission APPROVE Home Occupation Permit #246 for a Home Pedicure Business subject to the following conditions: This permit is being granted only for a home pedicure business, on lands legally described as Lot 2, Block 2, Plan 031 3053, SW 18 -19 -15 W4M. Any additional development shall require prior approval of a separate permit application. a. All Federal, Provincial and Municipal statutes, regulations, codes and standards. The provisions of Land Use Bylaw #1626 -07, and amendments thereto, pertaining to the Country Residential District and the definition of a Home Occupation 2 operation. c. All Alberta Building Codes where applicable. If the developer is required to obtain a building permit, it is his her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d. Any other required permits, including electrical, heating ventilation, gas and /or plumbing. All permits must be obtained from an accredited inspection agency. And Subject to: e. That this development is located as shown on the site plan approved in this application and submitted February 12, 2010. Any changes to that plan shall require the written approval from the Development Officer. f. That there is no more than 1 resident employee and no non resident employees. g. That there is no advertising or display of produce being permitted on the property except for one indirectly illuminated sign of 1 m placed flat against the building or fence. 8. DEVELOPMENT PERMITS a) Permit #3367- Ptn. NW 6 -15 -13 -W4M, Lot 1N, Block 1, Plan 2123FB, Division 1 Wilhelm Dyck (Owner Applicant) Construction of an accessory building (garage); request for a variance to rear yard setback. The County Planner provided background information on the proposed development permit. It was noted that there is already a Manufactured home on the property and the accessory building does not require a variance, as the setbacks for an accessory buildings is Tess than those for dwellings. It was decided to remove the setback condition from the permit since the setbacks originally applied for is permitted within the Land Use Bylaw. P 33/10 MOVED BY COUNCILLOR A. EASTMAN that the Municipal Planning Commission APPROVE Development Permit #3367 and grant approval for construction of an accessory building (garage) subject to the following conditions: This permit is being granted only for an accessory building (garage), on lands legally described as Lot 1N, Block 1, Plan 2123FB, SW 6 -15 -13 W4M. Any additional development shall require prior approval of a separate permit application. a. All Federal, Provincial and Municipal statutes, regulations, codes and standards. b. The provisions of Land Use Bylaw #1626 -07, and amendments thereto, pertaining to the Hamlet Residential District. c. All Alberta Building Codes where applicable. If the developer is required to obtain a building permit, it is his her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. Any changes to that plan shall require the written approval from the Development Officer. f. That there is a 2 m (6.6 ft.) separation distance between the new building and any proposed accessory buildings. g. That the property is not used for conducting a business or commercial operation without first obtaining the required permits. h. That the proposed accessory building is not used for living purposes. i. Development Notification: the developer shall notify the Development Officer: I. prior to the commencement of actual development thereon, and II. upon completion of the development MOTION CARRIED 11.
