CALL TO ORDER The Vice Chair called the meeting to order at 10:02 a.m. 2. EXCUSED FROM MEETING P -50/10 MOVED BY COUNCILLOR M. DOUGLASS that Councillor A.M. PHILIPSEN be excused from the meeting. MOTION CARRIED 3. MINUTES a) April 8, 2010 P -51/10 MOVED BY COUNCILLOR B. DEJONG that the minutes of the April 8, 2010 Municipal Planning Commission meeting be adopted as presented. MOTION CARRIED 4. CALL FOR POST AGENDA ITEMS The Chairman called for post agenda items. 5. ADOPTION OF AGENDA P -52/10 MOVED BY COUNCILLOR A. EASTMAN that the agenda be adopted as presented. MOTION CARRIED 6. BUSINESS FROM MINUTES The County Planner distributed a map to each member showing the service areas for the irrigation districts in Alberta. It was noted that the EID covers most of the County of Newell. During the discussion that followed, it was also noted that the boundaries for the County of Newell were established during the same period as the boundaries for the Eastern Irrigation District. 7. SUBDIVISIONS a) #2010 - - 064 - NE 27- 17- 14 -W4M, Division 2 Jim & Jennifer Aleman (Owner / Applicant) To subdivide a previously subdivided quarter section to create one new parcel for Country Residential use. The County Planner provided background information on the proposed subdivision. It was noted that the application had been previously reviewed and a motion to approve subdivision 2010 -0 -064 had been tabled during the April 8, 2010 MPC meeting, P - 53/10 MOVED BY COUNCILLOR A. EASTMAN that Subdivision Application 2010 - 0 - 064 which was previously tabled be lifted from the table. MOTION CARRIED The County Planner gave background as to why the application was tabled. The EID has indicated that the pipeline that services the property does not have the capacity to service an additional residential parcel which is why EID denied irrigation service for the proposed parcel at this time. The County Planner spoke with the landowner regarding this issue, and it was suggested that the parcel size could be reduced if necessary. EASTMAN that the Municipal Planning Commission APPROVE subdivision #2010 -0 -064, subject to the following conditions: 1. That all outstanding property taxes shall be paid to the County of Newell. 2. That the applicant enters into an agreement with the County of Newell for the installation of any required road approaches to the proposed and /or remnant parcels. MOTION CARRIED 8. AGRICULTURAL SUPPORT SERVICE & HOME OCCUPATION PERMITS a) HO #112 - RENEWAL - Ptn. SE 17 -21 -16 -W4M, Plan 951 1326, Block 1, Division 7 Dean & Donna Darago (Owner / Applicant) Renewal of an existing oilfield vehicle maintenance and repair business The Development Control Officer provided background information on the proposed home occupation renewal permit. It was noted this is a permanent permit. P -55/10 MOVED BY COUNCILLOR I. SCHROEDER that the Municipal Planning Commission APPROVE Home Occupation Permit #112 and grant approval for an existing oilfield vehicle maintenance and repair business subject to the following conditions: This permit is being granted only for the existing oilfield vehicle maintenance and repair business, on lands legally described as Block 1, Plan 951 1326, SE 17 -21 -16 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. b) The provisions of Land Use Bylaw #1626 -07, and amendments thereto, pertaining to the Agricultural District and the Home Occupation permits. c) All Alberta Building Codes where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. All permits must be obtained from an accredited inspection agency. Subject to the following conditions e) That this development is located as shown on the site plan approved in this application and submitted April 6, 2010. Any changes to that plan shall require the written approval from the Development Officer. April 22, 2010 Municipal Planning Commission Page 3 Llj -"-. f) That there are no more than 2 resident employees and no non- resident employees involved in the operation. g) That the developer obtains a Roadside Development Permit from Alberta Transportation. A copy of this permit must be submitted to the Development Officer. h) That there is no advertising or display of produce being permitted on the property except for one indirectly illuminated sign of 1 m placed flat against the building or fence. i) That any residence or structure is located a minimum distance of 100 m (328 ft) from any gas or oil well on or adjacent to the property. A variance of this distance may only be provided by the ECRB. b) HO # 128 - RENEWAL - Ptn. NE 5- 15- 13 -W4M, Division 1 Richard Schuett / RMS Construction Ltd. (Owner / Applicant) Renewal of an existing construction contractor business The Development Control Officer provided background information on the proposed home occupation renewal permit. The business is run by 2 residents and 3 non residents. The company vehicles are stored at the job sites with very little traffic to the home. It was noted that this is a permanent permit. P - 56/10 MOVED BY COUNCILLOR 3. HARBINSON that the Municipal Planning Commission APPROVE Home Occupation Permit #128 and grant approval for an existing construction contractor business subject to the following conditions: This permit is being granted only for the existing construction contractor, RMS Construction Ltd., on lands legally described as NE 5- 15-13 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) All Federal, Provincial and Municipal statutes, regulations, codes and standards. b) The provisions of Land Use Bylaw #1626 -07, and amendments thereto, pertaining to the Agricultural District and the Home Occupation permits. c) All Alberta Building Codes where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. NW 24 -16 -16 -W4M, Block 2MR, Plan 841 0735, Division 4 Grasslands School Division / Ferrari Westwood Babits Architects (Owner / Applicant) Construction of an addition; compliance for an existing school The Development Control Officer provided background information on the proposed development permit. It was noted by Council that the project includes plans to modify the existing gym for other uses rather than demolish it. P - 57/10 MOVED BY COUNCILLOR R. ANDREWS that the Municipal Planning Commission APPROVE Development Permit #3374 and grant approval for the construction of an addition and compliance for an existing school subject to the following conditions: This permit is being granted only for compliance of the existing Alcoma School, and construction of a 566 m (6092 ft gymnasium and vestibule, on land legally described as Block 2MR, Plan 841 0735, NW 24 -16 -16 W4M. Any additional development shall require prior approval of a separate permit application. The proposed development complying with: a) The provisions pertaining to the Agricultural District and all relevant schedules, as outlined in the County of Newell Land Use Bylaw #1626-07. b) All Federal, Provincial and Municipal statutes, regulations, codes and standards. c) All Alberta Building Codes, where applicable. If the developer is required to obtain a building permit, it is his / her responsibility to do so, and furthermore, this permit must be obtained from an accredited inspection agency. d) All Alberta Safety Codes, where applicable. If the developer is installing a new sewage disposal system, he /she is required obtain a Private Sewage Disposal System Permit, issued by a licensed, accredited inspection agency. e) Any other required permits, including electrical, heating & ventilation, gas and /or plumbing. All permits must be issued by a licensed agency. April 22, 2010 Municipal Planning Commission Page 5 \-1J And subject to the following conditions f) That this development is located as shown on the site plan approved in this application and submitted March 24, 2010. Any changes to that plan shall require the written approval of the Development Officer. g) That the developer obtains a Roadside Development Permit from Alberta Infrastructure and Transportation. A copy of this permit must be submitted to the Development Officer. h) That access can be provided for Emergency Services vehicles to all sides of the building. i) That any residence and /or structures are located a minimum distance of 100 m (328 ft) from any gas or oil well on or adjacent to the property.
